COURT ORDER
AND NOW, this ~ day of ~~ .~ I , 1995, upon consideration of
the attached Custody Conci iation Report, it is ordered and
directed as follows:
1. The Father, Derk E. Roberts, shall have legal custody and
primary physical custody of Derk W. Roberts, born July 27,
1983, Michael A. Roberts, born March 30, 1985, Ashley M.
Roberts, born March 24, 1987, Samantha J. Roberts, born
March 9, 1988, and Stephen S. Roberts, born August 24, 1989.
2. The Mother, Tonya L. Heilman, shall enjoy temporary physical
custody with the minor children as follows:
A. For a period of one week in the summer months upon
Mother giving Father at least thirty day written
notice and upon Mother providing transportation for
exchange of custody.
B. When the Mother is in the Cumberland County area and
has given Father at least seven (7) days notice, she
shall have unlimited temporary custody with the minor
children subject to the Father's ability to require
that the children not stay overnight with the Mother.
C. At such other times as agreed by the parties.
3. This Order is entered pursuant to the Conciliator's
recommendation as set forth in the attached report. In the
event the Mother desires to modify this Order, the Mother
may file a Petition with the Court to have the case again
scheduled with the Custody Conciliator.

CONCILIATION CONFERENCE: SUMMARY REPORT
IN ACCORDANCE WITH CUMBERLAND COUNTY CIVIL RULE OF PROCEDURE
1915.3-8(b), the undersigned Custody Conciliator submits the
following report:
1. The pertinent information pertaining to the children who are
the subject of this litigation is as follows:
Derk W. Roberts, born July 27, 1983, Michael A. Roberts, born
March 30, 1985, Ashley M. Roberts, born March 24, 1987,
Samantha J. Roberts, born March 9, 1988, and Stephen S.
Roberts, born August 24, 1989.
2. A Conciliation Conference was held on March 30, 1995, with the
following individual in attendance: '
Attorney, Michael R. Rundle, Esquire, representing the Father,
Derk E. Roberts. Mr. Rundle has filed an Affidavit of Service
indicating that the Mother, Tonya L. Heilman, had been served
with notice of the Conciliation Conference.
3. Attorney Rundle indicated to the Conciliator that the Mother is
residing in North Carolina and that he had had a conversation
with h~r on the telephone. He further indicates that the
Father has had primary physical custody of the minor children
since 1990 and that there was a discussion with respect to an
agreement on a Custody Order. The agreement is outlined in the
attached proposed Order which allows for the Mother to have
another Conference with the Conciliator in the event she is
dissatisfied with the proposed Order.
4. The Conciliator recommends an Order in the form as attached.

mail with restricted delivery, postage prepaid, return receipt

not been terminated and the person who has physical custody of
the children have been named as parties to this action.
WHEREFORE, plaintiff requests the court to grant custody of
the children to plaintiff.

notice and upon Mother providing transportation for
exchange o:f custody.
B. When the Mother is in the Cwnberland County area and
has given Father at least seven (7) days notice, she
shall have unlimited temporary oustody with the minor
children subject to the Father's ability to require
that the ~hildren not stay overnight with the Mother.
C. At such other times as agreed by the parties.
3. This Order is entered pursuant to the Conciliator's
recommendation as set :forth in the attached report. In the
event the Mother desires to modi:fy this Order, the Mother
may :file a Petition witlt the Court to have the case again
scheduled with the Custody Conciliator.
