I. The plaintiff is John Allen Baer III residing at
11 E. Shady Lane Enola, Pa. 17025
2. The defendant is Carla Jean Linnane residing at
506 Susquehanna st. Marrysville, Pa 17053
3. Plaintiff seeks custody of the following childrenl

The children presently in the custody of Carla Jean Linna~e

6. Plnintiff has not 1'lD,rtici nated no a party or witness, or
in another canacity, in other litigation concerning the
custody of theese children in this or another court.
Plaintiff has no information of a custody proceeding
concerning theeoe children in a cou~t of thio Commonwealth.
Plaintiff does not know of a person not a narty ~o the
the proceedings who has nhysical custody or visitation
rights with respect to the children.
7. The best interest and oermanent welfare of the children
will be served by granting the relief requested because
1. Defendant works evenings leaving no adult sunervision.
2. Defendant has two bedroom house with at least four
people living there if not more.
3. Problems with local teenagers have arrisen making
the house an unsafe enviroment.
8. There are no other knolvn Dersons to have or claim
right to custody or visitation of theese children.
Wherefore, nlaintiff requests the court to grant
custody of the children.
I verify that the statements made in this Complaint
are true and correct. I understand that false state-
mens herein are made subject to the nenalties of 18
Pa. C. S. 4901~ relat~ng to unsworn falsification to
authorities.

ORDER OF COURT
AND NOW this 18th day of April 1995, the above matter was
scheduled for a conference before me on 28 March 1995. Neither
party appeared and I have received no explanation for their
failure to appear.
A review of the Complaint makes it clear that the children
have resided in Perry County for the past two years. Thus it
does not appear that Cumberland County has venue and I believe
the case should probably proceed in Perry County.
For these reasons, I am relinquishing jurisdiction and
returning the matter to the Court Administrator.
