AND NOW comes ISIIWOREE M. PARISER, by her attorney, JAMES M.
BACH, and files the within ANSWER TO PETITION TO STAY
EXECUTION.

It is ADMITTED that the Court Order is in arrears, however
the Respondent lacks sufficient knowledge to either admit
or deny the Plaintiff's reasons for going into arrears.

It is ADMITTED that the Master requested certain information
from the parties at the last meeting, however, it is DENIED
that Mrs. pariser has not supplied such information. This
information was supplied as of February 17, 1995.

The Sheriff was asked to levy upon the property set forth
therein and it was the responsibility of Benjamin Pariser
to deal with that levy. At no time did respondent request
a sale.

The respondent herein is using a legal remedy to enable
her to obtain, from the Petitioner, thoso amounts of money
due her under a lawful Court Order.

There is no equitable consideration that would allow the
Petitioner, a medical doctor, to not pay his obligations
under a lawful Order of Court. His complaint about needing
money for his college expenses for his son is unfounded
to this extent: The Court lowered the alimony pendento
lite from $1,900.00 to $1,200.00 per month when the medical
doctor brought this mattor to the Court's attention by way
of a petition for Reconsideration.
The Court therefore has already taken this into account
and made their decision.
The medical doctor did not exercise any of his legal rights
such as a petition to ro-consider, or a petition for a
reduction of alimony pendente lite. He unilaterally and
arbitrarily stopped paying alimony pendente lite, well
knowing that his wife, Ishworee Pariser, relies on this
for her day-to-day necessary living expenses. It should
also be noted that on or about the time the payments
stopped, this Court did direct the sum of $30,000.00
out of an injury settlement be directed to Ishworeo pariser.
The doctor has not paid any money since the date of that
Order awarding to Ishworee Pariser $30,000.00.
WHEREFORE, tho Respondent respoctfully prays that this Court
immediately reinstate the Writ of Execution.

NOW comes Benjamin J. Pariser, Defendant above, by and through his counsel. Flower.
Morgenthal, Flower and Lindsay, and petitions this Honorable Court as follows:
1. Respondent is subject to an Order of alimony pelldell/e lite entered by this Honorable Court
initially on July 19, 1993. and modified most recently on September 19, 1994. According to said Order,
Petitioner is to pay to Respondent $1,200.00 per month effective October I. 1994. A copy of the
Court's Order of September 19, 1994 is attached hereto as Exhibit "A".
2. Petitioner paid alimony pelldel/te lite pursuant to the Court's Order, but became into
arrears in the amount of $6,017.59 for two reasons:
A. The Support Order, issued in a monthly umount, was paid by the Respondent on
a bi-monthly basis, However, through mis-communication, Petitioner was given
a bi-weekly amount for payment. As a result of the calculation, he came into
arrears in the amount of approximately $2,000,00 over a period of approximated
18 months.
B, On October 21, 1994, this Court ordered escrow agent, Frank Cori, Esquire, to
pay to Respondent $30,000.00 from the award of a Board of Arbitrators in
Respondent's personal Injury case. A copy of the Court's Order of October 21,

1994 is attached hereto a~ Exhibit "B". At or about the same time, a $2,500.00
payment was due by the Petitioner on account of tuition and costs for the parties'
sons education at LnSaUe University. Because of the necessity of making this
payment, and with the assurance that Respondent had adequate funds in the
$30,000.00 awarded her by the Court. Petitioner did not make alimony pendente
lite payments In their fuU amounts for a period In the Winter of 1994, A copy of
the payment record from the Office of Domestic Relations is attached hereto as
Exhibit "C".
3. The parties have been before the Divorce Master for two days of hearings, the first on
December 16, 1994 and the second on January 25, 1995. The testimony taken at the two hearings
concerned marital misconduct and other factors relating to alimony.
4. After the two hearings mentioned, in order to facilitate a final resolution of the case, the
Master asked the parties to submit summaries of marital debt paid and owing and marital assets. All
such information has been provided by the Respondent, but the Petitioner has not provided any of the
information requested by the Master.
5. On February 3, 1995. Respondent entered judgment against the Defendant on account
of the alimony pendente lite arrears in the amount of $6,017.59, A copy of the Praecipe is attached
hereto as Exhibit "D".
6. On or about February 3. 1995. Petitioner filed a Praecipe for a Writ of Execution seeking
to sell all medical equipment, machines, supplies and all furniture and furnishings in Respondent's

office and garnishing Respondent's bank accounts. A copy of the Writ of Execution is attached hereto
as Exhibit "E".
7, While inhibiting the resolution of this case by failing to provide Information requested
by the Master, Petitioner seeks to eliminate Petitioner's ability to earn his living by sel1ing the
equipment which is necessary to pursue his occupation and to support not only Petitioner, but the three
children in his custody.
8. Pennsylvania Rule of Civil Procedure 3121(d) confers on the Court the authority to stay
execution for legal or equitable considerations.
9. Petitioner believes and therefore avers that ample equitable considerations exist for the
Stay of Execution pending a decision by the Master.
WHEREFORE, Petitioner prays this Honorable Court to slay temporarily the execution in the
captioned case, and to issue u Rule upon Respondent why the Writ of Execution should not be set
aside.
