In consideration of the mutual promises, covenants and undertakings hereinafter set forth
and for other good and valuable consideration, receipt of which the parties acknowledge, Wife

Each party shall have the right to II vc separate and apuJt from the other party, free from

, 2 - WAIVER OF RIGIITS AND MUTUAL RELEASES
Except as provided In this agreement, both parlies absolutely and unconditionally release
and forever discharge each other and Iheir heirs, executors, admlnislrators, assigns, property and
estates from any and all rights, claims demands or obligations arising out of or by virtue of the
marital relationship, whether such claims exist now or arise In the future. This release shall be
effective regardless of whether such claims arisc out of former or future acts, contracts,
engagcments or liabilitics of the parties or by way of dowcr, curtesy, widow's rights, family
exemption or similar allowance, or under the Inteslale luws, or the right tll take against the
spouse's will, or the right to treat a lifetime conveyallce by Ihe other as testnrtlcnlary, or all
other rights of a surviving spouse tll purtlcipale in a deceased spouse's eslllle, whcther arising

stricken. In all other respects. this agreement shall hc valid and continuc In full force, effect

, 7. ADDITIONAL INSTRUMENTS
Concurrently with the execution of this agreement, both parties shall execute aftidallits
of consent and waivers of notice of Intention to seek entry of the divorce decree. Counsel for
Husband shall me ali documents necessary to finalize the divorce action and secum entry of the
decree. Within ten (10) days after a request to do so, each party shall execute, acknowledge and
deliver to the other any and all Instruments, assignments, releases, satisfactions, deeds, notes
or other writings that may be necessary to give full force and effect to this agreement. Subject
to the fund-holders' requirements for transfer, the parties will effect the transfer the assets as
set forth In paragraph 18 within ten (0) days of the execution of this agreement.

This agreement shall be blndlnf on and shall enure to the benefit of the parties and their
respective heirs, executors, administrators. successors and assigns,

Each party confirms that there has been disclosure to the (lther of such income, assets
and liabiHtles. Each party waives uny right to further disclosure, valuation, enumeration or
statement of Income, assets or liabilities, Neither party desires to nll\ke or append to this
agreement any addilional enumcratlon or statemcnt. Neither party shall sue the other party or
that party's heirs, executors, administrators or assigns, alleging denial of any right tl) full

If either party subsequently discovers any property Interest not Identified In this
agreement, that property shall be divided equally, If, however, one party knowingly concealed

separate property of the other, The concealing party shall pay all costs associated with the

1. Marital Residence, The partlcs own as tcnants by Ihc cntiretles Improved real
estate located at 4 Riddle Road, Camp Bill, Cumberland County, Pcnnsylvanla ("marital resi-
dence"). Concurrently with the exccutlon of this agreement, Wife shall exe~ute the listing
contract prepared by Millie Gnrrell, The parties agree to list the property at $89,9000 and shall
accept all bo"ajldl' offers from qualified buyers who arc not family member" of $88,~OO.OO or
higher. When the six.mmllh listing contract expires, the parties shall have the right to lower or
raise the listing price based on applicable markct factors and 10 rc-lIstthe property with an agent
or broker acceplllble to both parties. Elich party shnll execute the oeed and all other documcnts
necessary to finalllc the sale of the property.
At seulement, Husband shnll receive I1fty-l1vc percent (55 %) of thc net proceeds; Wife
shall receive forty.l1ve (45 %) of thc net procceds, "Nct pml'ccds" is defincd as the sales price
minus all brokers' and realtors' li'~s, trnnst'er taxcs, sClllcn\crll costs and seller's expenses,
including the mortgage.

Any necessnry rcpairs or Improvements In excess of $100 shall be apportioned equally
between the parties after receipt of two (2) bids for the work. "Necessary repairs or
improvements" Is defined as non-cosmetic expenditures necessary to market the property, sueh
as replacement of the furnace or water heater. The tcrm excludes those repairs or Improvements
which are covered by homcowners' Insurance. Paymcnt for such work shall be made to the
provider at senlement, with such expense being paid Immedilltely lifter the mortgllge is satisfied.
If the listing agent Is unable to arrange for such deferred pllymcnt, Wife may eleet to pay her
one-half portion up-front to Husbllnd, who shall assume responsibility for paYlllent of the
remainder of the obligation. If Wife docs not pay her fifty percent (~O%) upon demand by
HUsband, then Husband shall charge the repllirs or Improvements on a credit card, with the
entire amount, iududlng Interest charges applicable to that charge only, to be pllid In (ull at
settlement Immediately aner the mortgage Is satisfied and prior 10 distribution of the proceeds
to the parties.

freezer; and a Tiffany chandelier, With the exception of the frcezer, which needs to be moved
from the basement, Husband shall bring these items 10 the front door entrancc of the marital
residence. Wife shall rctrieve thesc items no latcr than ten (0) days after the execution date
of this agreement. If Wifc docs nut provide a replacement lighting t1xlllre he fore the parties sign
a cuntract for sale of thc mnrilnl residence, then the chandelier shall he reserved tu the parties
on the sales contract and Wi fc shall assumc p()sseslon of the chnndcller prior to the scttlemcnt
datc.
