Appellant, I<erry Keane, by and through his undersigned
oounsel, brings thie Motion to Reinstate Appeal, and in support
thereot avers as tolloWSI
1. The instant aotion arises trom a landlord-tenant
dispute and was initiated by way ot Complaint on November 17,
1994, by Plaintirt S.c. Oldt ("Appellee") against, inter &lJ.A,
defendant, Kerry I<eane ("Appellant"). A true and oorrect oopy ot
the Complaint is attached hereto as Exhibit "A".
2. On January 4, 19915, a judgment wae entered by Distriot
Justice Donald W. Daihl, in tavor ot Plaintift and against
Derendants.
3, On February 3, 19915, Detendant I<erry Keane tiled a
timely notioe or appeal to this Court. A true and oorrect copy
ot appellant's notioe of appeal is attached hereto as Exhibit
"B".

4, On February 7, 199~, Appellant'. oounsel reoeived trom
the Prothonotary a .igned oopy ot Notice ot Appeal, Praeoipe to
Enter Rule to File Complaint and Rule to File. A true and
oorreot copy i. attaohed hereto as Exhibit "C".
~. On the same day, February 7, 199~, Appellant's coun.el
mailed the Notioe ot Appeal to Distriot Ju.tioe Donald W. Daihl
and the Notioe ot Appeal and Rule to File Complaint to Appellee's
attorney, sally J. Winder. True and oorreot oopie. ot counsel'.
oorrespondenoe and reoeipts tor oertitied mail are attached
hereto as Exhibit "0".
6. On February 16, 199~, Appellant's oounsel reoeived tho
return receipt signed ny Appellee'a oounsel, The receipt
evidenoed delivery ot the Notice ot Appeal and Rule to File
Complaint on February 10. 199~. A true and oorreot copy ot the
.igned return receipt ie attached hereto as Exhibit liE".
7. On February 17, 1995, Appellant's oounsel reoeived the
return receipt signed by a representative ot the District Justice
Donald W. Daihl. The return receipt evidenced delivery of the
Notioe ot Appeal on February 13, 1995. A true and correct copy
of the al.gned return receipt is attached hereto as Exhibit "F".
B. On February 21, 1995, Appellant's counsel mailed to the
Prothonotary a signed and notarized copy of the proof ot service
to Notice of Appeal and Rule to File complaint, with copies ot
the receipts for certified mail and return receipts. A true and
correot oopy of the proof of service is attached hereto as
Exhibit "Q",

9. On February 28, 1995, Appellant'a coun.el received from
Appellee'a attorney a copy of a praecipe to strike Appeal for
failure ot appellant to file proof ot service within ten (10)
day. after filing Notice of Appeal. A true and correct copy of
Appellee's Praecipe to Strike Appeal is attached hereto aa
Exhibit "H".
10. Under Pennsylvania Law, an appeal for failure to file
proof of aervice within ten day. may be reinstated by thA Court
upon good oause shown.
11. In the instant caee, Appellant's failure to file proof
of servioe within ten (10) days was due to Appellant's coun.el'.
clerical error of diarying the due date for tiling proof of
service within ten days from the date of receipt of the ssnder's
return reoeipt.
12. Appellant's oounsel's good faith is demonstrated by the
faot that ooun6el did mail Proof of Service to the Prothonotary
on the next. business day following receipt ot the sender's return
receipt.
13. Appellee is not prejudiced by the late filing of the
Proof of Service, as Appellee was sent the Notice of Appeal and
Rule to File complaint on the same day it wes reoeived from the
CoUrt. (See Exhibits "cn, "0" and "E").
14. Appellant's oouneel's simple olerioal error is good
oau.e to reinstate the within appeal and should not preolude
Appellant trom maintaining his appeal.

oounsel, brings this Memorandum of Law in support of Motion to
Reinstate Appeal, and in support thereof avers as followSI
I, FACTS
The instant aotion arises from a landlord-tenant dispute and
was initiated by way of complaint on November 17, 1994, by
plaintiff S.C. Oldt ("Appellee") against, inter Alli, defendant,
1<erry I<eane (IIAPpell.antll). A true and oorreot oopy of the
complaint is attaohed hereto as Exhibit "A".
On January 4, 1996, a judgment was entered by Distriot
JUltioA Donald W. Daihl, in favor of plaintiff and against
Defendants. A timely appeal to this court was subsequently filed
by Defendant 1<erry 1<eane. See Exhibit liB".
On the same day Appellant's counfiel received the .i9ned copy
ot the Notice ot Appeal, Praecipe to Enter RUle to File complaint
and RUle to File, trom the Prothonotary (February 7, 1995),
Appellant's counsel mailed the Notice ot Appeal to District
Justice Donald W. Daihl and the Notice ot Appeal ~nd Rule to File
Complaint to Appellee's attorney, Sally J. Winder, (See Exhibits
>>c>> and >>0>>). Receipt ot the Notice ot Appeal by Appellee's
counsel and the District Justice is evidenced by the attached
return receipt cards, Exhibits "E>> and >>1".>>
Solely due to Appellant's counsel's clerical error ot
diarying the date due tor tiling proot ot service as ten (10)
days trom receipt ot the return receipts, the proot ot Service
was not filed with the prothonotary until after the actual ten
(10) day period had expired. However, Appellee's counsel and the
District JUs~ice were served promptly, and the proot ot Service
was mailed to the Prothonotary on the next businees day tollowin9
reciept of the last return receipt.
On February 28, 1995, Appellant's counsel received tram
Appellee's attorney a copy ot ft praecipe to strike Appeal tor
tailure ot appellant to tile proot ot service within ten (10)
days atter tiling Notice ot Appeal. (See Exhibit >>H>>).
II. LEGAL ARGUMENT
The Court ot common Pleae may, upon good cause shown,
reinstate an appeal which has been stricken tor tailing to timely
file proot ot service ot notice ot appeal. Pa,R.C.P.D.J. Rule
1006. The determination ot good cause shown is trUsted to the

The Pennsylvania Superior Court has consistently held that
there is qood cause tor reinstatement where the notice ot appeal
hae neen timely filed on appellee and the District Justice and no
prejudice has resulted to appellee. pel Varma v. Pavlinsky/ 40~
Pa. Super 443, ~92 A.2d 746 (1991). ~ llIg Ouarato y.

(dafendant's tAilure to comply with rule 100~b disreqarded whara
detendant failed to timely tile proot of service but evidence

Similarly, proof of .ervioe wa. mailed to the prothonotary on the

But for Appellant'a oouna.l'. olerioal error of diarying the due
date for filing proof of servioe for ten (10) days following
receipt of the return reoeiptB, instead of ten (10) day. from the
date of filinq, the proof of aervice would have been timely
filed. AI timely notice of the inltant appeal hea been provided
to Appellee and the District Justice and there i. no prejudioe
whatsoever to Appellee, Appellant'. oounsel's simple clerical
error i. good oause for reinstatement of the appeal under
Slauahter and the numftrou. authoritie. whioh are in acoord.
III. QgHCLUSION
Where the notioe of appeal i. timely filed and .erved upon
the non-appealing party and the di.trict justice, the intent
underlying rule 1006 has been fulfilled and no further purpo.e
remains to be .erved by penalizing the appealing party for
failing to timely file the proofs of service. con.equently, the
mere failure to file the proofs of servioe in a timely manner
will be disreqarded where it is clear that the oppo.ing pa~ty ha.
reoeived notioe of the appeal and that the purpose of the rUle.
