As ot January 31/ 1995/ the outstanding balance on said Condominium fees is $7/126.00. (See Exhibit "D" attached). 10, Defendants are acting in contravention to the Declaration of Condominium by not paying said condominium tees, 11, According to Article XIV, Section 14,4 of the Declaration of Condominium, a unit owner, by accepting the deed to his unit, shall be deemed to have appointed anyone or more executive board member attorney-in-fact to confess judgment against such unit owner in any court of comp~tent jurisdiction in Pennsylvi!nia, for any such unpaid assessments and for so doing, a copy ot Article XIV of the Declaration of Condominium and deed, both verified by affidavit, shall be a sufficient warrant. 12. According to Article XIV, Section 14,3 of the Declaration ot Condominium, Defendants are obligated to pay the condominium fee in arrears as well as the maximum legal interest rate, p$nalties imposed by the association, and any costs, including attorney fees associated, with collecting the delinquent assessments.
