AND NOW, this 6th day of February, 1995, comes the
Appellant, Jeanne H. Bereznicki, by and through her attorney,
Gary I,ysaght, Esquire, and respeotfully appeals the suspension ot
her driving privileges.
1. The Appellant, Jeanne H. Bereznicki, pennsylvania
Operators Number 943999232286, resides at 2901 Sooiety Hill Dr.,
Apartment 1112, camp Hill, PA 17011. (Formerly at 5 East
Louther st, Carlislo, PA 17013).
2. Penndot sent a Notice of Suspension letter to Appellant
on January 6, 1995
3. The suspension is to become effeotive 2/10/95 for a
period of one year as a result of Appellant's alleged violation
ot Seotion 1547 of the Vehicle Code, chemioal Test Refusal, on
12/20/94.
4. Appellant was arrested without probable cause to believe
that Appellant was driving under the influence. Therefore,
Appellant was under no obligation to submit to a ohemical test to
