AND NOW, comes the Plalntlll: Leonard S. Leo. by and Ihrough his allorneys. MARTSON.
DEARDORFF, WILLIAMS & OTTO and hmby avers liS follows:
I. The PlaintltT is an adult Individual residing at 34 Bentley Place. Carlisle.
Pennsylvania 17013
2. The Defendanls are adult Individuals resldln!! at 414 Norlh Bedford Street. Carlisle.
Pennsylvania 17013,
3. On or about October 24, 1993, the Defendants signed an Agreemenl of Sale to
Purchase Real Estate from the IllaintllT A copy of Ihat Agreement of Sale Is hereby auached as
Exhibil "A".
4, The Agreement of Sale requil'ed a down payment of $6,000.00 which was put in
escrow wllh Ginny Mowery, who was the real estate agent.
~. An Addendum to Ihe Agreement of Sale was signed by the Defendants on OClOber
24. 1994 and by the PlalntilT on Octobllr 3 I. 1994
6. That Addendum to the Agreement of Sale removed the l1nancing contingency which
had allowed for I1nanclng of $80.000.00 and changed the requiremenllo cash at selllement
7, The Addendum to the Agreement of Sale also authorized a change of the settlement
date from December 23. 1994 to November 23,1994.
8. At all times. the PlaintllTwas ready, willing. and able to consummale the sale of the
real eSlate and tender the property to the Defendants,
9. On or about November 4, 1994. Defendants sought return oflhelr deposit money and
indicated their unWillingness to go Ihrough with Ihe Agreement, which actions conslitute an
anllclpatory breach of Ihe Sales Agreement
10. The Plalntift'hll8 compli~'(1 in 11I1 respects wilh the Agreemenl of Sale tor Ihe Purchase
of Real ESlale and the Addendum and has pertbrrned all conditions precedent.
II. The Defendanls have breached the Agreemenl of Sale by titilinglo complele the
pertbrmonce of Ihe conlract by following through and purchasing the property.
12. The Defendanls, prior to the date of the ming of this Complaint, have not made the
Plainlltlaware ofany way in which the Plalntitf hos tidied 10 live up to the Sale Agreement or any
way in which Plaindft' has otherwise breached the Soles Agreement.
13. On or MOUI December 7, 1994, PlointitT through counsel made II formal demand for
the releose of the $6,000.00 which is being held In escrow.
14 Despite the demWld tor payment, the Defendants have titlled III release the $6,000.00
which the real estale agent, Ginny Mowery, IS holding in escrow.
I S. The DetimdWlts have not indicated any legal basis under which Ihey would be endtled
10 the relurn of their down payment or deposit.
16. Since the Defendanls have breached the Agreement by the failing to take the
necessary steps to consummate the sale and make the further payments. The Defendanl8 are in
defaull under Paragraph 20 of the Agreement of Sole
WHEREFORE, Plaintiff demands Judgement againsl the Defendanls in the amount of
$6,000.00 plus interest from November 24, 1994 and allorney's fees ond costs.
