CIVIL ACTION -- COMPLAINT IN MORTGAGE FORECl.OSURE
1. The Plaintiff 'rhe PruQential lIome Mortgage Company,
Inc., formerly known as The Prudent ial Home Mortgage Company, A
Joint Venture 1a a corporat.ion having been organized under the laws
of the State of New Je/:'sey and having its principal place of
busi~ess at 5325 Spectrum Drive, 82, Frederick, Maryland 21701.
2. (a) Defendant Frank J. Costanza is an individual whose
last known address is 53 Honeysuckle Drive, Mechanicsburg, PA
17055.
(b) Defendant Jean Ann Costanza is an individual whose
last known address is 53 Honeysuckle Dd ve, Mechanicsburg, PA
17055,
(c) Defendant Frank J. Costanza holds an interest in the
subject property as a mortgagor and real owner.
(d) Defendant Jean Ann Costanza holds an interest in the
subject property as a mortgagor and real owner.
(e) If any of the above named Defendants are deceased,
this action shall proceed against the deceased Defendant's heirs,
assigns, successors, administrators, personal representatives
and/or executors through their estat.e whether tht!! estate is
probated.
3. (a) The residential mortgage being foreclosed upon is
secured by property located at within 53 Honeysu<;1ltle Drive,
Mechanicsburg, Cumberland County, Pennsylvania.
(b) All documents eVidencing the residential mortgage
have been recorded in the Recorder of Peeds' Office in Cumberland
County, Pennsylvania.
(c) The Mortgage was executed on April 6, 1987 and was
recorded on April 8, 1987 in Mortgage Book 859/ at Page 9,7.
(d) The legal description tor this parcel is attached
and incorporated as Exhibit "~" (Mortgaged Premises) ,
(e) The herein named Plaintiff has standing to bring tha
instant action by virtue of Assignments of Mortgage, duly and
publicly recorded as belowr

Assignee: The Prudential Home Mortgage Company

(f) By virtue of Pennsylvania Rules of Civil Procedure
Rule 11.47 (1) and 1019 (g) / and on the basis of environmental
responsibility, Plaintiff is not obliged to append copies of the
aboVfl mentioned publicly recorded documents to this mortgage
foreclosure action. These documents are, however, appended hereto
and incorporated heruin by reference as Exhibit "B".
4. The mortgage is in default because the Defendants above
named failed to timely tender the monthly payment of $1,011.85 on
May 1, 1994, and thereafter fa iled to make the monthly payments,
5. As authorized under the mortgage instrument, the loan
obligation has been accelerated.
(b) If the mortgagtJ arrears are to be reJ,nstated or
paid-off prior to the Sheriff's Sale, Plaintiff's actual attorneys'
fees (calculated at counsel's hourly rate) will be charged based
upon work actually performed.
8, (a) The original principal balance of the Mortgage is
more than Fifty Thousand ($50,000,00) Dollars,
(b) Under Pennsylvania's ACT 6 of 1974, Plaintiff
Mortgagee is not obligated t.o serve Notice of its Intention to
Accelerate the mortgage obligat ion by cert ified and by regular
ma.iling, pdor to init iating foreclosure proceedings,
9. (a) 'l'he subject. mortgage is gov'lrned by ACT 91 of 1983.
(b) Under Pennsylvania'S ACT 91, Plaintiff Mortgagee is
obligated to serve the Defendants with notice of their rights under
the "Homeowners Emergency Mortgage Aasist.ance Act", by regular
mailing, prior to initiating foreclo~ure proceedings.
(e) Appended hereto and incorporated herein by reference
as Exhibit "C" are copies of the Notices required, havIng been sent
on the date set forth on the Notice.
(d) The Pefendant has failed to make a timely
application for financial assistance with the Pennsylvania Housing
Finance Agency.

5. Denied. The statements contai~ed in Paragraph 5 of the
Defendant's Preliminary Objections are misleading, The Defendant
has not been able to consummate a forbearance arrangement, nor has
he acted in good faith, yet improperly insists that his inability
to cure the arrears constitutes grounds for Preliminary Objections.
6. Denied. The statements contained at Paragraph 6 of the
Defendant's pleadings do not give rise to any Preliminary Objection
under PA RCF Rule ~028, and therefore, they do not require a
response by the Plaintiff, Instead I they refer to conversations
and settlement negotiations which are improper grounds for
preliminary Objections.
By way of further response to the Prell minary Obj ections
raised by the Defendant Frank J. Costanza, Plaintiff's counsel
avers as followsl
7, The Defendant Frank J. Costanza received notification in
accordance with ACT 91 (35 P.S. 81840,401c, at seq.) on or about
July 11, 1994, which notice the Defendant has acknowledged receipt.
8. The Defendant Frank J. Costanza contacted the Plaintiff,
The Prudential Home Mortgage Company, Inc., and negotiations were
undertaken, ostenBibly in good faith, to arrange a forbearance plan
which would negate the need for foreclosure or Chapter 13 f.iling by
the Defendant.
9. The Defendant Frank J. Costanza was unable to raise
monies sufficient to cure even half the arrears which continued to
aCCl'ue during the pendency of prolonged negotiations,
10, When it became evident that no forbearance could be
reached, the Defendant was advised that foreclosure proceedings
would be commenced,
11. The Complaint in Mortgage Foreclosure was filed with the
Cumberland County Court of Common Pleas on February 7, 1995, more
Costan~a was attempting to rekindle or continue negotiations with
prudential.
16, Plaintiff respectfully draws this Honorable Court's
attention to the final sentence of the first paragraph of Exhibit
"B"l "A copy of the preliminary objections will be forwarded to
you as soon as they are filed with the Prothonotary of Cumberland
County".
17, On May 3, 1995, counsel for Plaintiff spoke with Mr. Wilt
regarding the minimum requirements which Prudential would accept
towards a forbearance arrangement with Mr. Costan~a.
18. On May 8, 1995, counsel for Plaintiff spoke directly with
Mr. Wilt and advised that his c1 ient' s forbearance terms were
unacceptable and suggested that if his client had any other offers
to make, they should be made before the case further proceeded,
19. On May 11, 1995, counsel for Plaintiff spoke directly
with Mr. Wilt. He indicated in that conversation that he wanted to
receive reinstatement figures on behalf of his client as soon as
possible, but acknowledged that Plaintiff could, in the meantime,
proceed with its foreclosure action,
20, On May 20, 1995, reinstatement figures were forwarded by
telefacsimile transmi~sion to Mr. Wilt.
21, On May 24, 1995, Plaintiff's counsel received a telephone
call from the CUmberland County Prothonotary's Office, advising
that Plaintiff's Praecipe for Entry of Default Judgment could not
be filed, as Preliminary Objections had been filed on behalf of the
Defendant Frank J. Costan~a on March 24, 1995, by Walter W. Wilt,
Esquire. Written confirmation of this information followed by
mail to Plaint if f' s attorneys, (Exhibit "C" I Civil Case Inquiry
in the instant mortgage foreclosure act ion, printed on May 25,
1995) .
22. In response to the Prothonotary's telephone call,
Plaintiff's counsel immediately telephoned Mr. Wilt's office,
asking to speak with him. A message was left asking him to return
the call.
23, Having heard nothing from Mr, Wilt by mid-afternoon on
May 24, Plaintiff's counsel again telephoned his office and, as Mr.
Wilt was not present, asked to speak with his secretary. Mr.
Wilt' B secretary, Stacey, and discussed this matter. Stacey
acknowledged that it did not appear as though a copy of the
Preliminary Objections had been served upon Plaintiff or its
counsel of record, and further, no Certificate of Service had been
filed with the Court of Common Pleas for Cumberland County,
24. Upon Plaintiff's counsel's requests, Stacey provided the
undersigned with a telefacsimile copy of the Preliminary Objections
filed of record by Mr. Wilt on behalf of Mr. Costanza, (Exhibit
"0"1 Copy of Preliminary Objections, together with Fax Cover
Sheet, dated May 14, 1995 at 3157 P.M,). Plaintiff respectfully
draws this 1I0norabh Court's at tent ion to the time -stamp on the
face sheet of the Preliminary Objections. Defendant's counsel
knew that his Preliminary Objections had been filed of record.
25, Despite his express representation to the contrary in his
corresporldence dated March 23, 1995, and no less than three (3)
telephone conversations with Plaintiff's counsel, and explicit:
representations by Defendant's counsel that Plaintiff could proceed
with its fox'eclolElure action, Defendant's counsel deliberately
failed to disclose that pleadings had been filed to delay and
forestall the foreclosure action.
26. Upon receiving and reviewing a copy of the Preliminary,
Objections from Stacey at Mr. Wilt's office, Plaintiff's counsel
attempted to communicate with Mr, Wilt by telefacsimile. (Exhibit
"E", Telefacsimile transmission from Barbara A. Fein, Esquire, to
Walter W. Wilt, Esquire, dated May 24, 1995, together with
confirmation that the transmission was received by counsel) .
27. Plaintiff's counsel telephoned Mr, Wilt's office twice on
May 25, 1995, and left messages for him, askillg that he return her
calls. Mr, Wilt did not respond to these messages.
28. On Tuesday, May 30, 1995, counsel for Plaintiff spoke
with a receptionist at Mr. Wilt's office, who advised that Mr, Wilt
would not take her telephone call.
29, Plaintiff believes, and therefore avers, that the
allegations contained in Defendant Frank J, Costanza's Preliminary
Objections are disingenuous and are x'endered scandalous and
impertinent by virtue of the Defendant's actions in this matter.
While allegedly negotiating in good faith, the Defendant's counsel
failed to comply with Pennsylvania Rules of Civil Procedure,
specifically disregarding Rules 1026, 1028, and with Rules of
Professional Conduct governing the conduct of Pennsylvania
attor.neys, including, but not limited to Rule 4.2.
30, By virtue of his failurf.l to comply with the Rules of
Civil Procedure and the Rules of Professional Conduct, Plaintiff's
civil action has been improperly delayed. Indeed, Defendant's
counsel knew or had reason to know that had he, in fact, properly
lfIorved notice that Preliminary Objections had been filed on or
about the date on which they were filed with the Cumberland CQunty
Prothonotary'lfI office, they would have already been ruled upon by
this Honorable Court. Moreover, Defendant's counlflel allflo knew or
had reason to know that had he, in fact, properly lfIerved notice
that Preliminary Objections had been filed on or about the date on
which they were filed with the Cumberland County Prothonotary's
Off ice, Plaint iff, The Prudent ial Home Mortgage Company, Ina.,
would have ended IfIsttlement negotiations much earlier,
m~EREFORE, the Plaintiff, The Prudential Home Mortgage
Company, Inc. , relflpectful1 y requests that the Prel iminary
Objections raised by the Defendant Frank J. Costanza be dismilfllflsd,
and that the pending foreclolflure action proceed. Moreover,
Plaintiff seeks reimbursement of its counsel fees and costs in the
amount of Five Hundred and 00/100 ($500.00) Dollars, representing
sanctions against Wilt & Freeman for its failure to act properly
within its scope and duty as counsel of record for the Defendant
Frank J, COlfltanza, in accordance with Court Rules and Rules of
Profelfllflional Conduct.

I am in receipt of the aforementioned complaint and would like to respond to said complaint In
writing In order to document all that has proceeded over the Illst year in reference to said mortgage, I
have encountered extraordinary personal difficulties both In the Ilnancial area and of a deeply personal
nature, At the close of this correspondence, I would also like to propose a solution to the present
Impasse,
The history of this account Is at best a gross case of miscommunication in which I anume equal
accountability with Prudential, Last May I encountered Ilnancial difficulties that were brought on In areat
part due to a year ot' personlll hardships, Beginning with my mother's unexpected death and burial on my
47th birthday in December of 1992, my world crumbled around me, In the spring of 1993 my spouse and
I went through corporate and personal bankruptcies that caused severe emotional and Ilnanclal strees, In
September of 1993 my spouse announced that she wanted to end our marrlaae, In November of 1993 I
started visiting a professional counselor when it became apparent to me that thoughts of luiclde aeemed
euy to contemplate as a viable solution to my problems, My counselors and putorl saw me throullh
some very difficult times, The climax of which was my spouse's move out of our house in late April
1994, The emotional crash put my life in tunnoil, In May of 1994, due to ellpen..s beyond my control I
failed to make my mortgaae payment and failed for the next two months to Itabllize my IlnanciaJ pOliti on
enough to brlna my account current.
Durlna the summer of 1994 the severe emotional strain took its toll and I did not behave totally
responsibly where household ellpenses were concerned, With the help of my counselorl and pastorll
tried to recover ITom the family losses caused by the two bankruptcies, In which I reaffirmed bath my
first and second mortgages to protect my home,
Over the last two and a half years I have been out of work for a total ofeleven months, Even
while out of work I attempted at all costs to keep my housing payments current, but MayoI' 1994 wal the
bottom ormy emotional roller coaster, On luly II, 1994, I received your certified letter of intent to
foreclose and immediately contacted Prudential to try to resolve the murage,

In your lelter of July II, 1994, I was given the option to work with Prudential QJ: a desillnated
consumer credit counseling agency, I chose to work with Prudential and upon conlacting Prudential was
IlIianed to an account counselor, who requested historical financial data from me for review, Isent
copies of my tax returns and other dala requested, I olTered at that time to make a partial payrnent to
Prudential as"good faith moneys" until a resolution of this mailer could be found, I was informed at that
time by the account counselor that I should IlQ1send any payments until Prudential had time to review
my clle and get back to me, During that conversation I informed the counselor of the impending no.fault
divorce and my spouse and my decisions concerning the house, Since my spouse was an at.home mother
throughout the marriage and had not contributed financially to the mortgage payments, she asked her
allomey to request her name be removed from both our mortgages and the deed to the joint property,
After Wilting for several weeks and havlnll not heard from Prudential I called (in early September)
to see what progrell had been made, I W81 informed then that Prudential had not received my documents
and would I please send another copy, Once again upon asking about making payments I was told to
makellll payments until Prudential had time to review my case and get back to me, I was made aware at
that time oflellers my spouse's altorney had sent to Prudential. Those lellers were concerning the
removal of her name from the mortgage, Her altorney also received no response from prudential. While
awaiting response from Prudential, my employment becamt: unstable as documented in the explanation
below,
In early November 1994, I left my position at Exel1.oglstics ($21Ihour) to work as an
independent consultant at $Blhour on several work requests I had received, I saw this as an opportunity
to increase my income and help alleviate my growing debt. Not long after starting work on the project,
the client I W81 working for changed the project requirements out to November 1995, I was now
unemployed and searching for work. I allempted to I1nd other consulting work throughout December
1994 and January 1995, while stili not hearing from Prudential or receiving any wrillen response to my
second copy of flnancial data, In late January 1995, I received and accepted an olTer of a full.time
position with Alternative Resources Corporation, The olTer inciuded full family benel1ts, a rate of
SJOlhour In a non.salaried position and a review In six months that could result in a pay Increase,
I wlIsurprised on the morning of February 16, 1995 to be served papers concerning your civil
action as I had JlIY1[ received any correspondence in response to my request to reconcile this maller, In
light of the aforementioned historical data I would olTer to you the following proposal as a solution to
thia Impasse:
I) I would like to honor Jean Ann Costanza's wishes to remove her name from the mortgage, I
have enclosed a copy ofthe deed in my name alone prepared by her allorney along with a copy of
the final decree of divorce,
2) I wish to take full responsibility for the remainder of the debt and all arrearages,
