Box 103 Blglervllle, Pennsylvania 17307 VS, Case No, 95-880 Civil Term Defendent(s): Bill Foust B & R Express & Recycling 8370 Baseshore Road Mechanlcsburg, Pennsylvania 17055 COMPlAINT The Pallet Outlet Company, Incorporated (P.O.C.) began doing business with Mr, William Foust (B & R Express) In May of 1994, The verbal agreement took place over the phone between myself (Mark Schaffer- President) and William Foust- Owner, B & R Express. Mr. Foust agreed to compensate P.O.C. an Initial amount of $35.00 per 45' truckload of wood chips delivered to B & R Express- Mechanlcsburg, Pennsylvania. In addition, this Initial figure would Increase to an agreed amount of $50.00 per truckload In June 1994, P.O.C. delivered 28- 45' truckloads of wood chips to B & R Express between May and October 1994, Mr. Foust made only (1) one payment which covered the first (5) five truckloads delivered (S88 photocopy of check). P.O.C.'s collection department repeatedly phoned B & R Express attempting to collect past due debt owed P.O.C, (!!!! photocoPY of collection's call record worksheet), After exhausting all collection efforts, P.O,C, mailed a final letter to Wllllam- FousttB & R on November 17, 1994, discussing future action. Unfortunately, this was not a written agreement. It was, however, a verbal contract which P.O.C, entrusted Mr. Foust would up-hold. P,O.C,- was aware and familiar with B & R Express through previous business contacts. We did not have any reason to believe a failure on B & R's obligation to compensate P,O.C. for services rendered. P.O,C. has provided complete documentation and history for all transactions Including: Signed delivery receipts, computer generated Invoices for each delivery receipt, collection records for past due Invoices and a copy of the first check received from B & R for services rendered, proving there was an agreement. P.O.C. has presented all documentation In Chronological order showing the history of this account. P,O.C. has gone to a lot of added expense: phone calls, correspondence and court costs, Including this statement to collect debt that Is rightfully due to P,O.C. from B & R Express for services rendered. In addition to the chronology that Mr. Schaffer has set forth, I (Russell Eves- Controller) was present at the Civil Hearing on January 4, 1995. At that hearing, P,O.C. was denied the opportunity to present documentation In support of P.O.C,'s position, However, the unsupported erroneous statements expressed by Mr. Foust were deemed credible, resulting In a wrongful Judgment against P.O.C..
