1.

Defendant executed a mortgage bond or note in
Plaintiff, dated April 8, 19B8, the same being
as Exhibit A. and incorporated herein by reference
2. The same provides for the confession of judgment
in the event of certain default.
3. A judgment was entered by a proceeding filed on
February 9, 1995.
4. The said bond, Exhibit A, voluntarily signed by
Defendant, constitutes an effective waiver by the Defendant
of Defendant's constitutional rights of due process, and
constitutes a waiver of any challenge as to any
constitutional or other infirmities of Pennsylvania
confession procedures.
5. Upon the execution of said bond, Exhibit A, the
Defendant is permitting the issuance of a writ of execution
and also other proceedings in connection therewith, without
providing any means for a pre-deprivation hearing or other
type of post seizure or sale relief.

6. The Defendant agrees that he "forever waives and
releases all errors in said proceedings, waives stay of
execution, the right of inquisition and extension of time of
payment, agrees to condemnation of any property levied upon
by any such execution, and waives all exemptions from levy
and sale of any property that is or hereafter may be
exempted by law."
7. The waivers and understandings are implicit in the
authority granted by Defendant, who thereby waived any pre-
deprivation hearing, any due process rights, any post-
seizure relief, or sale relief, all waivers made with the
understanding and voluntary consent of the debtor.

B. The debtor owns various parcels of real estate, is
an active real estate investor, was a licensed real estate
agent, and is aware that he was giving away important rights
to notice and hearing, and that his creditor, the Plaintiff,
under the power of state law, had the authority and
permission from debtor-defendant, to enlist the state's
power of legal compulsion to seize and sell the debtor's
property in order to satisfy or secure debtor's debt.
9. Plaintiff intends to proceed with execution
proceedings on the Judgment entered as aforesaid.
lO. Plaintiff requests that the Court issue a Rule on
the Defendant to show cause why the Judgment should not be
confirmed and execution proceedings pursued thereon.
WHEREFORE, Plaintiff prays that the Court issue to
Defendant, a Rule to Show Cause, if any he has, why the
Judgment should not be deemed proper and execution
proceedings commence and pursued forthwith with the service
of said Rule to be served by regu ar mail, with a
certificate of mailing. '

Jr. regarding the note and mortgage executed by you on April B,
198B. As you know, you are required under the contract and bond to
pay regular monthly installments on the debt of 59,000.00.
You have failed to make payments as and when required.
Accordingly, you are in default on both instruments;
therefore, the obligations are accelerated and payment in full is
now due.
We would ask that you arrange the payment in full within ten
