COMPLAINT UNDER PENNSYLVANIA
RULES OF CIVIL PROCEDURE 2951. ET SEO.
1. The Plaintiff is a corporation incorporated under
the law of the state of Pennsylvania, and has a place of
business located at 1300 Market street, P.O. Box 622,
Lemoyne, Pennsylvania 17043.
2. The Defendant, Powell & Houser, an unincorporated
entity doing business in the county of Dauphin, Pennsylvania
at 1300 Plaza West, 1300 Market street, Suite 302, Lemoyne,
Pennsylvania.
3. The Defendant, Kathy M. Powell, an adult individual
and a resident of the County of Dauphin, Pennsylvania
residing at 510-B Granview Drive, Lewisberry, Pennsylvania
and is a principal in the business known as Powell & Houser
in the County of Dauphin, Pennsylvania.
4. The Defendant, Mathew P. Houser, an adult individual
and a resident of the County of Dauphin, Pennsylvania
residing at 598 Shoop Lane, Halifax, Pennsylvania and is a
principal in the business known as Powell & Houser in the
County of Dauphin, Pennsylvania.
5. On February 24, 1994, Defendants, Kathy M. Powell
and Mathew P. Houser, D/B/A Powell & Houser entered into a
leasing agreement identified as "Commercial Lease" with the
Plaintiff, Property Management, Inc., agents for ADG-1300
Plaza West Associates. A true and correct copy of the
Leasing Agreement which contains the warrant of Attorney upon
which JUdgment is confessed is attached hereto, made a part
hereof, and marked as Exhibit "A".
6. Defendants, Powell & Houser and Defendants Kathy M.
Powell, and Mathew P. Houser, individually defaulted on their
obligation to make payments, pursuant to the terms of the
Commercial Lease, on or about May 1, 1994, and therefore,
Defendants, Powell & Houser and Defendants Kathy M. Powell,
and Mathew P. Houser, individually have defaulted on the
Commercial Lease.
7. Pursuant to the terms of the Commercial Lease,
jUdgment may be entered by confession against the Defendants
for all monies due, without notice or demand.
8. Pursuant to the terms of the Commercial Lease and by
reason of Defendant's default, the following amounts are
currently due and owing Plaintiff by Defendants:

Interest (1.5% per mo.)
Late charges
Attorney's commission (10%)

9. The Commercial Lease in this matter which contains a
Warrant of Attorney upon which judgment is confessed, has not
been assigned.
10. Judgment on the Warrant of Attorney contained in the
Commercial Lease executed by the Defendants in this matter
has not been entered against any of the Defendants in any
jurisdiction.
WHEREFORE, the Plaintiff requests judgment be entered
against the Defendants Powell & Houser and Kathy M. Powell,
individual and in favor of the Plaintiff in the sum of
$2,822.40, together with all costs associated therewith.
11. Pursuant to the terms of the Commercial Lease
executed between the parties, $2,822.40 is currently due and
owing Plaintiff from the Defendants, and although demand has
been made Defendants have failed and/or refused to pay the
amount due and owing to the Plaintiff.
12. Judgment can not be entered against Defendant,
Mathew P. Houser individually, as he filed for protection
from the United states Bankruptcy Court by filing a Chapter 7
bankruptcy petition on July 12, 1994, Case No. 94-01l63RJW.

HOLDING OVER AS nnNBWAL
A hold over by Lessee beyond the terms of this Lease or any hereinbefore duly
authorized additional term, or failure of Lessee to glvo notice of Ite Intention to
vacate the Space at the end of such term at least 120 days prior to such end of
term, ehell, at the option of Lessor, be deemed a renewal of thle Lease on a
month-to-month basis, with the renewal being under and subject to all
provisions contained In this Lease, wlLh the exception of any provision for the
base rental rate. Monthly rent owed to Lessor during any hold over period
shall be two hundred percent (200\1 of the monthly rate. upon expiration of the
original term.
