PENSION RIGHTS WAIVER AGREEMENT

and between SUZETI'E RENE Sn.vIS (hereinafter referred to "Wife") and
CLARK PAUL Sn.vIS (hereinafter referred to as "Husband").
WHEREAS, the parties have entered into a Marital Separation Agreement
dated January 6, 1995, providing for the settling of their property rights and other
rights and obligations growing out of their marriage, and their intention to proceed
with a divorce action between themj and
WHEREAS, the parties now wish to clarify and confirm the terms of the
said Marital Settlement Agreement in regard to their respective pension or
retirement rightSj
NOW THEREFORE, in consideration of the mutual promises and
undertakings contained herein, the parties hereto, intending to be legally bound,
covenant and agree as follows:
1. PENSION RIGHTS: The parties acknowledge that they are each the
holder of certain interests in pension or retirement rights or claims through their
respective employers. They each hereby agree and stipulate that they each waive
any and all claims to or interest in any pension rights or retirement funds of the
other party, including any right of Wife to benefits due to or on account of
Husband's participation or entitlement through or under the Civil Service

3. Plaintiff's Affidavit required by Section 330l(c) or 3301(d) of the Divorce Code
was executed by the Plaintiff on May 15, 1995, and by Defendant on May 15, 1995.
4. There are no related claims pending. The parties agree to the entry of the
Property and Separation Agreement dated January 6. 1995, and the Pension Rights Waiver
Agreement, dated May 15, 1995, to be incorporated into the final Decree of Divorce
between them.

1. Plaintiff is Suzette Rene Silvis, who currently resides at 18 East Big Spring Avenue,
Newville, Cumberland County, Pennsylvania, 17241 and has since January 7, 1995.
2. Defendant is Clark Paul Silvis, who currently resides 327 East Louther Street, Carlisle,
Cumberland County, Pennsylvania, 17013, since January 24, 1995.
3, Plaintiff and Defendant have been bona fide residents in the Commonwealth for at
least six months immediately previous to the filing of this Complaint.
4, The Plaintiff and Defendant were married on September 8, 1985, in Carlisle,
Cumberland County, Pennsylvania.
5. There have been no prior actions of divorce or for annulment between the parties.
6. The marriage is irretrievably broken.
7. Plaintiff has been advised that counseling is available and that Plaintiff may have the
right to request that the court require the parties to participate in counseling.
8, Plaintiff requests the court to enter a decree of divorce,
WHEREFORE, the Plaintiff requests this Court to:

ninety days have elapsed from the date of fmng the Complaint,
3. I consent to the entry of a final decree of divorce.
4, I understand that I may lose rights concerning alimony, division of
property, lawyer's fees or expenses if I do not claim them before a divorce is
granted.
In addition, I specifically acknowledge that a fun and final settlement of all
property and other rights of the parties has been entered between the Plaintiff and
Defendant by a Marital Settlement Agreement.
