4. The accident causing the minor plaintiff's injuries
occurred when Phu U. Nguyen failed to stop at a Stop Sign and ran
into the vehicle driven by Connie Heckard, an insured of Horace
Mann Insurance Company through a policy of insurance bearing policy
number 46769200. The minor plaintiff was a passenger in the
Heckard vehicle. Phu U. Nguyen was fleeing from Douglas Chandler
at the time of the accident, because phu U. Nguyen and Chandler had
been involved in a collision just prior to the subject accident.
5. At the time of the accident, defendant phu U. Nguyen was
driving an automobile owned by Ann M. Nguyen and insured under an
automobile policy issued by All State Insurance Company.
6. As a result of this accident, the minor plaintiff, Nathan
Douglas Eppley, sustained a facial laceration extending from his
right upper eyelid through his forehead. The minor plaintiff was
treated at Holy Spirit Hospital and released.
7. All State Insurance Company has tendered to the
Petitioners, based upon the bodily injury claim, its policy limits
of Fifteen Thousand and no/l00 ($15,000.00) Dollars, which the
Petitioners hereby acknowledge receipt of same. The Petitioners
were unrepresented at thet proceeding and are presently
unrepresented.
8. petitioners understand and waive their right to obtain
counsel to advise them regarding this settlement.
9. The defendant, Horace Mann Insurance Company, while not
admitting to liability, has offered to pay to the Plaintiffs the
sum of Ten Thousand and no/l00 ($10,000.00) Dollars towards an
amicable resolution of the under insured claim, which is based upon

a policy of insurance identified above, covering the vehicle
operated by Connie Heckard, said policy bearing number 46769200
with coverage extending from December 1, 1990 through June I, 1991.
10. The Plaintiffs acceptance of the sum of Ten Thousand and
no/l00 ($10,000.00) Dollars shall be in exchange for Court approval
of this settlement, a Release of any and all claims, and a
discontinuance of the above-captioned matter, a true and correct
of said Release is attached hereto and incorporated herein by
reference and marked as Exhibit "B."
11. The Petitioners, the minor plaintiff, and the defendant
agree that the sum of Ten Thousand and nO/100 ($10,000.00) Dollars
payable on behalf of Nathan Douglas Eppley, a minor, shall be
deposited in a federally insured savings bank in the name of the
minor, with the provisions that no withdrawals can be made from
such account until the minor reaches his majority or except as
authoriz~d by prior order of this Court.
WHEREFORE, Petitioners respectfully request that this Court
enter an Order approving the foregoing compromised settlement
directing the distribution of proceeds thereof as set forth above,
authorizing the Petitioners, upon payment of the aforesaid sums,
to discontinue the action brought and to execute a good and
sufficient General Release.

GENERAL RELEASE
KNOH ALL MEN BY THESE PRESENTS THAT HE, Douglas Eppley and
Kathy Eppley, individually and as parents and natural guardians of
Nathan Douglas Eppley, a minor, and in consideration of the sum
of Ten Thousand and no/l00 ($10,000.00) Dollars, receipt of which
is hereby acknowledged, we, Douglas Eppley and Kathy Eppley,
individually and as parents and natural guardians of Nathan Douglas
Eppley, a minor, do hereby remise, release and forever discharge
Horace Mann Insurance Company, its servants, agents, and employees,
and all of its successors, assigns, heirs, executors and
administrators, of and from all, and all manner of, actions and
causes of action, suits, debts, dues, accounts, bonds, covenants,
contracts, agreements, judgments, claims and demands whatsoever in
law or equity, especially all claims and liability arising out of
or in any way connected with a motor vehicle accident which
occurred on April 4, 1991, wherein the minor, Nathan Douglas
Eppley, was injured as a result of a motor vehicle accident
involving a motor vehicle operated by Phu U. Nguyen and a motor
vehicle operated by Connie Heckard in which the minor, Nathan
Douglas Eppley, was a passenger; said accident occurring at the
intersection of Wertzville and Pine Hill Roads in East Pennsboro
Township, Cumberland County, Pennsylvania, which released claim was
made the subject of a suit and an underinsurance claim brought by
Douglas Eppley and Kathy Eppley, individually and as parents and
natural guardians of Nathan Douglas Eppley, a minor, in the Court
of Common Pleas of Cumberland County to No. 95-749 Civil, and an
underinsurance claim against the policy of insurance covering a
1985 Buick Skylark; said policy bearing No. 467679200, in which
Nathan Douglas Eppley was a passenger, which against the said
Horace Mann Insurance Company and its servants, agents, and
employees, we, Douglas Eppley and Kathy Eppley, individually and
as parents and natural guardians of Nathan Douglas Eppley, a minor,
ever had, now have, or which our heirs, executors, administrators,
successors or assigns, or any of them, hereafter can, shall or may
have, for, or by reason of any cause, matter or thing whatsoever,
from the beginning of the world to the date of these presents.
In further consideration of the premises, we, Douglas Eppley
and Kathy Eppley, individually and as parents and natural guardians
of Nathan Douglas Eppley, a minor, hereby agree and direct that the
aforementioned law suit commenced to No. 95-749 civil shall be
marked dismissed with prejudice.
We, Douglas Eppley and Kathy Eppley, individually and as
parents and natural guardians of Nathan Douglas Eppley, a minor,
do further agree and understand that the settlement of the within
matter is not to be considered or treated as an admission of
liability on the part of Horace Mann Insurance Company and its
servants, agents and employees, and that the law of the

Commonwealth of Pennsylvania shall govern the interpretation and
legal effect of this General Release.

AND NOW, this _ day of

hearing, the Court approves a compromised settlement of the above
claim with Horace Mann Insurance Company for the sum of Ten
Thousand and no/l00 ($10,000.00) Dollars. The Court directs that
the sum of Ten Thousand and no/l00 ($10,000.00) Dollars be
deposited in a savings account insured by the united States
Government with the stipulation that no funds may be withdrawn
until the minor obtains the age of Eighteen (18) years without
further Order of this Court. The Court would request the proof of
depositing said monies into an account as directed within two (2)
weeks after the above deposit is made. The Court directs that this
proof be forwarded directly to the Judge whose signature has been
placed upon this Order.

PETITION TO SETTLE THE CLAIM OF A MINOR
The Petitioners, Douglas Eppley and Kathy Eppley, husband and
wife, individually and in their own right and as Parents and
Natural Guardians of Nathan Douglas Eppley, a minor, respectfully
represent:
1. The Petitioners, Douglas Eppley and Kathy Eppley, husband
and wife, are adult individuals who currently reside at. 5217
Terrace Road, Mechanicsburg, Cumberland County, Pennsylvania 17055.
2. The minor plaintiff, Nathan Douglas Eppley, is currently
seventeen (17) years old; having been born on August 10, 1977. He
resides with his parents and natural guardians, Douglas Eppley and
Kathy Eppley.
3. The circumstances giving rise to the instant claim
occurred on April 4, 1991. On that date, Nathan Douglas Eppley was
a passenger in a vehicle hit by Phu U. Nguyen (hereinafter
defendant "Nguyen") at the intersection of Wertsville and Pine Hill
Roads in East pennsboro Township, Cumberland County, Pennsylvania.
Attached hereto and incorporated herein by reference as Exhibit
"A," is a copy of a Police Accident Report.
4. The accident causing the minor plaintiff's injuries
occurred when Phu U. Nguyen failed to stop at a Stop Sign and ran
into the vehicle driven by Connie Heckard, an insured of Horace
Mann Insurance Company through a policy of insurance bearing policy
number 46769200. The minor plaintiff was a passenger in the
Heckard vehicle. Phu U, Nguyen was fleeing from Douglas Chandler
at the time of the accident, because Phu U. Nguyen and Chandler had
been involved in a collision just prior to the subject accident.
5. At the time of the accident, defendant Phu U. Nguyen was
driving an automobile owned by Ann M. Nguyen and insured under an
automobile policy issued by All State Insurance Company.
6. As a result of this accident, the minor plaintiff, Nathan
Douglas Eppley, sustained a facial laceration extending from his
right upper eyelid through his forehead. The minor plaintiff was
treated at Holy Spirit Hospital and released.
7. All State Insurance Company has tendered to the
Petitioners, based upon the bodily injury claim, its policy limits
of Fifteen Thousand and no/l00 ($15,000.00) Dollars, which the
Petitioners hereby acknowledge receipt of same. The Petitioners
were unrepresented at that proceeding and are presently
unrepresented.
8. petitioners understand and waive their right to obtain
counsel to advise them regarding this settlement.
9. The defendant, Horace Mann Insurance Company, while not
admitting to liability, has offered to pay to the Plaintiffs the
sum of Ten Thousand and no/l00 ($10,000.00) Dollars towards an
amicable reRolution of the under insured claim, which is based upon

a policy of insurance identified above, covering the vehicle
operated by Connie Heckard, said policy bearing number 46769200
with coverage extending from December 1, 1990 through June 1, 1991.
10. The Plaintiffs acceptance of the sum of Ten Thousand and
no/l00 ($10,000.00) Dollars shall be in exchange for Court approval
of this settlement, a Release of any and all claims, and a
discontinuance of the above-captioned matter, a true and correct
of said Release is attached hereto and incorporated herein by
reference and marked as Exhibit "B."
11. The Petitioners, the minor plaintiff, and the defendant
agree that the sum of Ten Thousand and no/l00' ($10,000.00) Dollars
payable on behalf of Nathan Douglas Eppley, a minor, shall be
deposited in a federally insured savings bank in the name of the
minor, with the provisions that no withdrawals can be made from
such account until the minor reaches his majority or except as
authorized by prior Order of this Court.
WHEREFORE, Petitioners respectfully request that this Court
enter an Order approving the foregoing compromised settlement
directing the distribution of proceeds thereof as set forth above,
authorizing the Petitioners, upon payment of the aforesaid sums,
to discontinue the action brought and to execute a good and
sufficient General Release.

KNOW ALL MEN BY THESE PRESENTS THAT WE, Douglas Eppley and
Kathy Eppley, individually and as parents and natural guardians of
Nathan Douglas Eppley, a minor, and in consideration of the sum
of Ten Thousand and no/l00 ($10,000.00) Dollars, receipt of which
is hereby acknowledged, we, Douglas Eppley and Kathy Eppley,
individually and as parents and natural guardians of Nathan Douglas
Eppley, a minor, do hereby remise, release and forever discharge
Horace Mann Insurance Company, its servants, agents, and employees,
and all of its successors, assigns" heirs, executors and
administrators, of and from all, and all manner of, actions and
causes of action, suits, debts, dues, accounts, bonds, covenants,
contracts, agreements, judgments, claims and demands whatsoever in
law or equity, especially all claims and liability arising out of
or in any way connected with a motor vehicle accident which

intersection of Wertzville and Pine Hill Roads in East pennsboro
Township, Cumberland County, Pennsylvania, which released claim was

Natural Guardians of Nathan Douglas Eppley, a minor, respectfully
represent:
1. The Petitioners, Douglas Eppley and Kathy Eppley, husband
and wife, are adult individuals who currently reside at 5217
Terrace Road, Mechanicsburg, Cumberland County, pennsylvania 17055.
2. The minor plaintiff, Nathan Douglas Eppley, is currently
seventeen (17) years old; having been born on August 10, 1977. He
resides with his parents and natural guardians, Douglas Eppley and
Kathy Eppley.
3. The circumstances giving rise to the instant claim
occurred on April 4, 1991. On that date, Nathan Douglas Eppley was
a passenger in a vehicle hit by phu U. Nguyen (hereinafter
defendant "Nguyen") at the intersection of Wertsville and Pine Hill
Roads in East pennsboro Township, Cumberland County, Pennsylvania.
Attached hereto and incorporated herein by reference as Exhibit
"A," is a copy of a police Accident Report.
4. The accident causing the minor plaintiff 0 s injuries
occurred when Phu U. Nguyen failed to stop at a Stop Sign and ran
into the vehicle driven by Connie Heckard, an insured of Horace
Mann Insurance Company through a policy of insurance bearing policy
number 46769200. The minor plaintiff was a passenger in the
Heckard vehicle. Phu U. Nguyen was fleeing from Douglas Chandler
at the time of the accident, because Phu U. Nguyen and Chandler had
been involved in a collision just prior to the subject accident.
5. At the time of the accident, defendant Phu U. Nguyen was
driving an automobile owned by Ann M. Nguyen and insured under an
,
automobile policy issued by All State Insurance Company.
6. As a result of this accident, the minor plaintiff, Nathan
Douglas Eppley, sustained a facial laceration extending from his
right upper eyelid through his forehead. The minor plaintiff was
treated at Holy Spirit Hospital and released.
7. All State Insurance Company has tendered to the
Petitioners, based upon the bodily injury claim, its policy limits
of Fifteen Thousand and noll00 ($15,000.00) Dollars, which the
Petitioners hereby acknowledge receipt of same. The Petitioners
were unrepresented at that proceeding and are presently
unrepresented.
8. Petitioners understand and waive their right to obtain
counsel to advise them regarding this settlement.
9. The defendant, Horace Mann Insurance Company, while not
admitting to liability, has offered to pay to the Plaintiffs the
sum of Ten Thousand and noll00 ($10,000.00) Dollars towards an
amicable resolution of the underinsured claim, which is based upon

a policy of insurance identified above, covering the vehicle
operated by Connie Heckard, said policy bearing number 46769200
with coverage extending from December 1, 1990 through June 1, 1991.
10. The Plaintiffs acceptance of the sum of Ten Thousand and
no/l00 ($10,000.00) Dollars shall be in exchange for Court approval
of this settlement, a Release of any and all claims, and a
discontinuance of the above-captioned matter, a true and correct
of said Release is attached hereto and incorporated herein by
reference and marked as Exhibit "B."
11. The Petitioners, the minor plaintiff, and the defendant
agree that the sum of Ten Thousand and no/l00' ($10,000.00) Dollars
payable on behalf of Nathan Douglas Eppley, a minor, shall be
deposited in a federally insured savings bank in the name of the
minor, with the provisions that no withdrawals can be made from
such account until the minor reaches his majority or except as
authorized by prior Order of this Court.
WHEREFORE, Petitioners respectfully request that this Court
enter an Order approving the foregoing compromised settlement
directing the distribution of proceeds thereof as set forth above,
authorizing the Petitioners, upon payment of the aforesaid sums,
to discontinue the action brought and to execute a good and
sufficient General Release.

GENERAL RELEASE
KNOW ALL MEN BY THESE PRESENTS THAT WE, Douglas Eppley and
Kathy Eppley, individually and as parents and natural guardians of
Nathan Douglas Eppley, a minor, and in consideration of the sum
of Ten Thousand and no/l00 ($10,000.00) Dollars, receipt of which
is hereby acknowledged, we, Douglas Eppley and Kathy Eppley,
individually and as parents and natural guardians of Nathan Douglas
Eppley, a minor, do hereby remise, release and forever discharge
Horace Mann Insurance Company, its servants, agents, and employees,
and all of its successors, assigns" heirs, executors and
administrators, of and from all, and all manner of, actions and
causes of action, suits, debts, dues, accounts, bonds, covenants,
contracts, agreements, judgments, claims and demands whatsoever in
law or equity, especially all claims and liability arising out of
or in any way connected with a motor vehicle accident which
occurred on April 4, 1991, wherein the minor, Nathan Douglas
Eppley, was injured as a result of a motor vehicle accident
inVOlving a motor vehicle operated by Phu U. Nguyen and a motor
vehicle operated by Connie Heckard in which the minor, Nathan
Douglas Eppley, was a passenger; said accident occurring at the
intersection of Wertzville and Pine Hill Roads in East Pennsboro
Township, Cumberland County, Pennsylvania, which released claim was
made the subject of a suit and an underinsurance claim brought by
Douglas Eppley and Kathy Eppley, individually and as parents and
natural guardians of Nathan Douglas Eppley, a minor, in the Court
of Common Pleas of Cumberland County to No. 95-749 Civil, and an
underinsurance claim against the policy of insurance covering a
1985 Buick Skylark; said policy bearing No. 467679200, in which
Nathan Douglas Eppley was a passenger, which against the said
Horace Mann Insurance Company and itc servants, agents, and
employees, we, Douglas Eppley and Kathy Eppley, individually and
as parents and natural guardians of Nathan Douglas Eppley, a minor,
ever had, now have, or which our heirs, executors, administrators,
successors or assigns, or any of them, hereafter can, shall or may
have, for, or by reason of any cause, matter or thing whatsoever,
from the beginning of the world to the date of these presents.
In further consideration of the premises, we, Douglas Eppley
and Kathy Eppley, individually and as parents and natural guardians
of Nathan Douglas Eppley, a minor, hereby agree and direct that the
aforementioned law suit commenced to No. 95-749 civil shall be
marked dismissed with prejudice.
We, Douglas Eppley and Kathy Eppley, individually and as
parents and natural guardians of Nathan Douglas Eppley, a minor,
do further agree and understand that the settlement of the within
matter is not to be considered or treated as an admission of
liability on the part of Horace Mann Insurance Company and its
servants, agents and employees, and that the law of the

Commonwealth of Pennsylvania shall govern the interpretation and
legal effect of this General Release.
IN WITNESS WHEREOF, and intending to be legally bound hereby
we, Douglas Eppley and Kathy Eppley, individually and as parents
and natural guardians of Nathan Douglas Eppley, a minor, have
caused this General Release to be executed this
