Carminati entered into a contract with Mary L. Wolte and to provide materials and/or to perform labor necessary for the construction and erection or the alteration and repair of (a) building(s) upon those certain pieces or parcels of land situated in Dickinson Township, Cumberland County, Pennsylvania, being more particularly bounded and described as follows: See attached Schedule nAn NOW, THEREFORE, it is hereby stipulated and agreed by and between the said parties, as part of the said contract and for the consideration therein set forth, that neither the undersigned contractor, any sub- contractor or materialman, nor any other person furnishing labor or materials to the said contractor under this contract shall file a lien, commonly called a mechanic's lien, for work done or materials furnished to the said building or any part thereof. This stipulation is made and intended to be filed with the County Prothonotary within ten (10) days after date, in accordance with the requirements of Act of Assembly of Pennsylvania, in such case provided. (SEAL) (SEAL) Contrilctor) (SEAL) 1, SCHEDULE A ALL that certain tract of unimproved land situate in Dickinson Township, cumberland county, Pennsylvania, more particularly bounded and described as follows: BEGINNING at a point in the center line of the public road leading to Barnitz Mill, being L.R. 21034 (Burnt House Road), which point is at line of land now or formerly of Lester E. Dum; thence by the center of said public road, North 330 West 18B.5 feet to a point at line of land formerly of the Grantor herein, now or formerly of cynthia E. Pitts; thence by the same, North BlO East 247 feet to a point at line of other land now or formerly of said Lester E. Dum; thence by the same, south 260 50' East 164 feet to a stake; thence by the same, South 760 30' West 221.5 feet to a point in the center of said public road, the place of BEGINNING. SUBJECT, NEVERTHELESS, to the restrictions contained in the hereinafter recited deed. BEING the same tract of land which Woodrow J. stitt by deed dated February 10, 1995, and recorded in the Office of the Recorder of Deeds in and for Cumberland county, Pennsylvania, in Deed Book , Page , granted and conveyed to Mary L. Wolfe, Mortgagor herein.
