PRAECIPE FOR ENTRY OF DEFAULT JUDGMENT
TO: Lawrence Welker, Prothonotary
Pursuant to Pa.R.civ.p. 1071 and 237.1, enter judgment
against Defendant for possession the items of personal property
listed in the Complaint to wit:
heirloom cast iron skillet
VCR
19 inch color TV
World Book Set of Early Learning
together with costs of suit, or, if the specific items no longer
exist, for the value of same together with interest at the legal
rate, based upon the following:
1. Plaintiff commenced this action on 2/13/95 by filing an
appeal from the judgment of a district justice.
2. Plaintiff filed his complaint on 2/21/95.
3. Plaintiff served the Complaint by certified mail sent to
Defendant's last known address. Defendant received the Complaint
on 2/25/95, as evidenced by the U.S. Postal service Return
Receipt Card attached liereto as Exhibit A.
4. Defendant did not file any written response to the
Complaint prior to April 3, 1995, which was more than twenty (20)
days after the Complaint was served.

5. On April 3, 1995 plaintiff mailed to Defendant the
Notice of Default required by pa.R.Civ.P. 237.1. A copy of the
Notice, and a U.S. Postal Service Form 3817 evidencing mailing of
same are attached hereto as Exhibit B.
6. At no time after April 3, 1995 has Defendant filed or
served a response to the complaint.
I verify that the statements in this praecipe are true and
correct to the best of my knowledge, information, and belief. I
acknowledge that any false statements herein are made subject to
the penalties of 18 Pa.C.S. section 4904 relating to unsworn
falsification to authorities.
