Whereas, A.P. Williams Company. (Owner,) a Pennsylvania limited liability
company, with its principal office located at 3035 N. Prom:ess Avenue, Harrisburg, PA
17110 is about to execute contemporaneously herewith, a contract, with
A.P. '~ILLIAMS, Inc. a Pennsylvania corporation, Contractor, of 3035 North Progress
Avenue, Harrisburg, Pennsylvania, for the erection of
upon a lot of land situate in.East Pennsboro Townstdp., ~!~, more fully
described on Erdaibit A attached hereto and made part hereof.
Now, J e 21 2002, at the time of and immediately before the execution of
the principal contract, and before any authority has been given by the said Owner to the
said Contractor to commence work on the said building or purchase materials for the
same in consideration of the making of the said contract with Contractor and the further
consideration of one dollar, to Contractor paid by Owner it is agreed that no lien shall be
filed against the building by the contractor, or any sub-eontmctor, nor by any of the
material men or workmen or any other person for any labor, or materials purchased, or
extra labor or materials purchased for the erection of said building, the right to file such
liens being expressly waived.

All that certain tract of land situate in East Permsboro Township, Cumberland County,
Pennsylvania, bounded and described as follows:
Beginning at an iron pipe located at the southeast corner of lands of/enry E. & Goldie M. Ash,
(Parcel #1), said point being on the common line with A~ P. Williams Company (Parcel ~T2).
Thence f~om said point of beginning, along lands now or formerly of lames R. Rice & Deborah
L. Park, North 75 degrees 24 minutes 05 seconds West a distance of 49.35 feet; thence along
Parcel 1, on a course parallel to the centerline of Sherman Street, North 11 degrees 45 minutes 00
seconds West a distance of 210.06 feet; thence along Parcel #1 North 22 degrees 32 minutes 35
seconds West a distance of 78.28 feet to an iron pin; thence along the same, South 66 degrees 48
minutes 25 seconds West a distance of 104.44 feet to a point on the original eastern legal fight-
of-way line of Humer Street; thence along said right-of-way North 7 degrees 51 minutes 00
seconds East a distance of 78.00 feet to a point; thence along the southern fight-of-way line of
Fulton Street, North 81 degrees 11 minutes 00 seconds East a distance of 233.82 feet to a point
on the original western right of line of an Sherman Street, an unopened 14 foot wide all~y; thence
along said fight-of-way, South 11 degrees 45 minutes 00 seconds East a distance of 399.15 feet
to an iron pipe located on the northern fight-of-way line of Perry Street, an unopened 40 foot
wide street; thence along said right-of-way; South 78 degrees 15 minutes 00 seconds West a
distance of 89.01 feet to an iron pipe; thence along lands now or formerly of James R. Dice and
Deborah L. Park, North 22 degree~ 32 minutes 35 seconds West a distance of 50.39 feet to the
point of beginning.
Said area described contains 1.405 acres, and subject to 0.189 acres of dedicated rights-of-way
along Humer Street, Sherman Street and Perry Street, and other easements as depicted on the
recorded in Cumberland County Cotu~thouse in Plan Book "~ ~ , Page - ~--~ .
