AND NOW, comes David A, Kruluc, Plaintiff, by and through Frey & Tiley Attorneys
at Law and respectfully stutes us follows:
I. Pluintiff is David A. Kruluc, an adult individual, residing in Mechanicsburg,
Cumberland County, Pennsylvuniu.
2. Defendan is Robert Kindler un adult individuul, Defendunt Robert Kindler resides ut
1925 Chathum Drive, Camp Hill, Cumberland County, Pennsylvania,
3. Defendant is not u member of the urmed services.
4, Defendant wa~ an owner of real estate located in Silver Spring Township, Cumberland
County, Pennsylvaniu, known us 328 Ridge Hill Road,
5. On or about January 31, 1994, Plaintiff and Defendant entered into an Agreement for
the sule und purehuse of the said real estate. A true, correct and complete copy of this Agreement
is attached hereto und incorporated herein by reference us Exhibit "A".
6, Pursuant to said Agreement at puragraph 8, Defendant warranted that he had no notice
of municipal improvements,
7. Pursuant to said Agreement at puragraph I I of the Addendum, Defendants warranted
that certain items, including the water softener, would be conveyed with the real estute at the time
of linal settlement and thut these items would be in working condition at thut time,
8. Finul settlement on the Agreement was scheduled for Murch 21,1994,
9. Pluintiff perfomled u linul inspection prior to settlement and discovered that hot water
WIlS not tumed on, Plaintiff noted this at the time of settlement,
10, Plaintiff detennined to continue with linul settlement even though no one could explain
why the hot water WIlS not working,
11, Plaintiff learned the nextllloming that the calise for the lack of hot wuter WllS thllt the
coil for domestic hm water supply wus dumuged due to mineml build up and corrosionlUtd wus
not repairuble,
12, Plaintiff repluced the domestic coil with un oil-burning wuter heuter uta cost of
$1,197,00.
13, Because Ihe damage was cuused by minerul build up from the wuter supply, Pluintiff
ulso hud Ihe water softener checked und discovered that it was inoperable, it hud not worked for
several months or longer, und required replacement,
14, Pluintiff replaced Ihe water softener al u cost $1,032,18.
IS. Plaintiff had been lold both verbully by Defendunt Robert Kindler und in writing us u
part of Ihe Agreement of sule Ihal Defendunl had not received any nOlifieution from uny
municipalily regarding any required improvements to the property. (Exhibit "A", Pnrugraph 8).
16. On August 3, 1994, Pluintiff received written confirmution from Silver Spring
Township that he was required 10 have Ihe property connected to the public sewer which was to
extended to the urea, He wus further informed Ihutthe cost for the connection permit was
$2,468.00. A true, correct, and complete copy of the leller front Silver Spring Township is
Ulluched hereto and incorporuted herein by reference us Exhibit "B".
17, Plaintiff wus informed thut ull property owners uffected, including Defendunt were
given notice of the required improvements on or before January 17, 1994. two months prior to
final selllement on the Agreement of sale und upproximately two weeks prior to the signing of the
Agreement of Sale.
18, Neither Defendant nor any ugent acting on his behulf informed Plaintiff that such
improvements were required,
19, In uddition to puying the ubove-stuted connection permit, Plaintiff is required by Silver
Spring Township to puy for the cost of extending plumbing front the reul estate to the sewer
lateral. Plaintiff's cost for having this work perfornted is between $1,050,00 und $2,400,00.
20, The representutions us 10 the condition of Ihe fixtures and us to the nonexistence of
municipal improvement responsibilities were materiul parts of the contruct and were specificully
mude purt of Ihe wrillen Agreement.
21, Defendunl knew or should huve known thutthe representulions mude by him were
incorrect.
22. Defendnnt knew or should have known tlmt Plaintiff would rely on the representations
made by him.
23. Plaintiff did rely on the representations made by Defendant.
24, Plaintiff has suffered dllll1ages us a result of his reliance on Defendunt's representations
in the fonn of costs for repuir, replacement, und instullation of municipal improvements us follows:
Cost of replacement of wuter heater $1,197,00
Cost of replacement of water softener $1,032,18
Cost of Township imposed sewer connection pennit $2,468,00
Cost of connection to public sewer $2.400,00
Total $7,097,18

Dear Mr, Krulic:
I am responding to your letter received in this office on July
15, 1994 regarding your property located at J28 Ridge lIill Road. I
will answer your questions in the order asked:
1. Yes - PUblic sewer is currently beJng installed and it is
anticipated that connections can be made in August or September.
2. Notices will be mailed by the 'l'ownship after final
inspection of the system, After notification home owners will have
90 days to connect,
3, Permit fees are $2468,00 and must be picked up at the
Township office prior to connection, It is the responsibility of
the property owner to have a plumber install the lateral. This cost
is in addition to the authority permit fees,
4. Notices were mailed by Hartman & Associates the week of
January 10, Home owners should have received them by January 17,
1994, This notice wasn't mailed certified,
5, Questions about taxes are handled through the Township'
Tax Collector, Deborah Wiest, 697-1294,

DEFENDANT'S PRELIMINARY OBJECTIONS
TO PLAINTIFF'S COMPLAINT
AND NOW comes Robert Kindler, Defendant, by and through his
attorneys, Mirin & Jacobson, and respectfully states as follows:
l. Plaintiff is David A. Krulac, an adult individual,
residing in Mechanicsburg, Cumberland County, Pennsylvania.
2. Defendant is Robert Kindler, an adult individual residing
at 1925 Chatham Drive, Camp Hill, Cumberland County, Pennsylvania.
3. The Defendant was one of two owners of real estate
located in silver spring Township, Cumberland County, Pennsylvania,
known at 328 Ridge Hill Road.
4. Marilyn Kindler was also an owner of the property located
at 328 Ridge Hill Road in silver Spring Township, Cumberland
County, Pennsylvania.
5. On or about January 3l, 1994, Plaintiff and Defendant
allegedly entered into an agreement for the sale and purchase of
said real estate.
6. Pursuant to Pennsylvania Rule of Civil Procedure
l028(a) (5), when a plaintiff fails to join a necessary party, as in
the case at bar, the Plaintiff's complaint may be stricken by the
Court or amended as of right by the Plaintiff in order to cure the
defect.

WHEREFORE, pursuant to the reasons stated herein, the
Plaintiff respectfully requests that this Honorable Court strike
the Plaintiff's Complaint or in the alternative require the
Plaintiff to amend his pleading to conform to the Pennsylvania
Rules of civil Procedure.
