AND NOW, comes Cassius Mullen, by and through his attorneys,
Broujos, Gilroy & Houston, P.C., who avers as follows:

The Plaintiff is Cassius Mullen, an adult individual, t/d/b/a
Cassius Mullen I s Autocare Center, with its principal place of
business being located at 473 East North Street, Carlisle,
cumberland County, pennsylvania.

The Defendant is Garfield A. Hewitt, an adult individual, who is
currently residing at 1908 Susquehanna Street, Harrisburg, Dauphin
County, Pennsylvania.

The Plaintiff is the owner of an automotive repair center, which is
located at 473 East North street, Carlisle, cumberland County,
Pennsylvania.

The Defendant is the owner of a 1985 Jeep Cherokee.

On or about September l2, 1994, the Defendant called Plaintiff and
advised that his 1985 Jeep had an electical wiring harness problem.

The Defendant was advised by Plaintiff that the approximate cost of
the repairs would have been around $800 to $900, but that it was
difficult to give a specific quote because of the potential
complexity of the work involved.

The Defendant advised Plaintiff that it was necessary for the work
to be performed and that he would have his vehicle towed to the
Plaintiff and that he would also supply the Plaintiff with a wiring
harness.

Plaintiff diagnosed that the problem with the Defendant's vehicle
was a faulty ignition switch which was causing the wir.es in the
dash to burn.

Due to the complexity of the repairs, Plaintiff in fact expended
3l.5 hours in rewiring the vehicle, which would have resulted in a
total labor charge of $l,4l7.50, exclusive of parts.

Plaintiff wished to honor his previous estimate given to the
Defendant and, therefore, in order to have the bill not exceed the
estimate of a maximum of $900, the Plaintiff reduced the labor
charge for the services to $585.55.

In addition to the labor charge, there was the cost for parts
needed to complete the repairs totaling $l24 and a towing charge of
$50.

The total repair invoice for services rendered for the repairs
authorized by the Defendant totaled $805.l2, including sales tax.
Attached hereto and marked as Exhibit A and incorporated herein by
reference is a copy of the repair order.

On September 23, 1994, Plaintiff contacted the Defendant and
advised that the vehicle had been completed and the Defendant
advised that he did not have money to pay the bill but stated that
he would be by to pick up his vehicle.

The Plaintiff advised the Defendant that he was not able to pick up
his vehicle until payment had been made in full and the Defendant
was further advised that payment was to be made within a reasonable
time period and that if the vehicle was not picked up and the
services paid for, that a storage fee of $lO per day would be
assessed.

As of October 5, 1994, the vehicle had still not been picked up nor
had the service invoice been paid for and, accordingly, Plaintiff
contacted the Defendant to again remind him to pick up his vehicle
and to pay the invoice.

On or about October 5, 1994, the Defendant advised the Plaintiff
that he was not going to pay the invoice.

As of February 23, 1995, there was due and owing for storage of
Defendant's vehicle, calculated at the rate of $lO per day the
total sum of $l,530, which continues to accrue at the rate of $lO
per day.

The Plaintiff has successfully completed the repairs to the
vehicle, as authorized by the Defendant, and the vehicle is in full
operational order.

The Defendant has made no complaints regarding whether or not the
repairs to his vehicle were satisfactorily performed.

The Defendant has breached his agreement to pay for the services
performed by Plaintiff for the repair of Defendant's vehicle.

The Defendant's conduct in failing to pay Plaintiff for the
services rendered in a timely fashion and his obdurate and
vexatious conduct during the pendency of these proceedings entitles
Plaintiff to a claim for attorney's fees.
WHEREFORE, Plaintiff requests this Honorable Court to enter
jUdgment in favor of the Plaintiff and against the Defendant for
the total sum of $2,335.l2 due as of February 23, 1995, an
additional amount of $lO per day from February 23, 1995, until the
date of the entry of judgment, and attorney's fees and costs.

HEARING MEMORANDUM
I. FACTS
The Plaintiff performed repairs to Defendant's vehicle, which
repairs were consented to by the Defendant. The issue for
resolution by the panel of arbitrators is the dollar amount
that Plaintiff could charge for those repairs. In addition to
the repairs, the Plaintiff has submitted a claim for storage
of the vehicle starting from the date that the repairs to the
vehicle were completed.
Plaintiff has a clearly posted sign at his place of employment
noting that there is a $10 per day storage fee for all
vehicles for which repairs have been completed and Plaintiff
further advised the Defendant that he would be charged for
these storage fees.
II. ISSUE
IS THE PLAINTIFF ENTITLED TO CLAIM A STORAGE FEE?
Suggested Response: In the affirmative.
III. ARGUMENT
It is well settled in this Commonwealth that a garage man
pocesses a common law lien for services rendered to the motor
vehicle. Apartment Owners and Manaqers. etc.. v Brown, PA
382 A2d 473 (1977)
The aforesaid conunon law lien arises from an agreement, either
expressed or implied, between the owner of the vehicle and
the garage man who renderes the service with respect to the
automobile. In other words, if the automobile owner consents
to having the vehicle repaired the garage man as a common law
lien with respect to the labor, skill and materials utilized
in repairing the vehicle.
In Pennsylvania, a garage man also has the right to assert a
possessory lien for the storage of a vehicle so long as there
is an expressed or implied consent of the owner. The critical
factor is whether or not the owner has authorized, expressed,
or implied, that the Plaintiff can store the vehicle and
charge for said storage. "His (garage keeper) common law lien
will arise where he has repaired, stored, or otherwise
provided service to an automobile at the request of the
owner... however, the lien will not attach as against the one
who has not authorized, expressly or impliedly the repairs or
services rendered." Associates Fin. Ser. Co. v. O'Dell, pa
396 A2nd 1324, 1326 (1979),
The testimony at the Hearing will be that the Plaintiff has a
sign posted at his garage indicating the storage fee of $10
per day will be charged for any vehicle stored on the
premises. Testimony will further be presented by the
Plaintiff that the Defendant was clearly advised of the fact
that he would be charged a storage fee. The Defendant never
visited the Plaintiff's garage; however, the Defendant was
clearly advised that there would be a storage fee if the
vehicle was not picked up or paid for.
IV. CONCLUSION
The Plaintiff is entitled to charge a storage fee for the
storage of the vehicle on the premises. The Defendant was
advised that there would be a storage fee if he failed to
pick up the vehicle and pay for the repairs. In failing to
pick up the vehicle and pay for the repairs, the Defendant
consented to the imposition of the storage fees. The
Plaintiff continues to have a possesory lien in the vehicle
for all storage fees and costs of repair.
