GROVE MANUFACTURING, INC" COMPLAINT AND NOW, come the plaintiffs, Russell H. Christy, Jr, and crystal A. Christy, by their attorneys, Fowler, Addams, Shughart & Rundle, and make the following complaint: 1. The plaintiffs are Russell H. Christy, Jr. and Crystal A. Christy, adult individuals residing at 2634 Orrstown Road, Shippensburg, PA 17257-9317. 2. The defendant is Grove Manufacturing, Inc., also known as Grove North America, a corporation with its offices and principal place of business in Shady Grove, Franklin County, PA 17256. 3. On May 10, 1993 Defendant Grove Manufacturing, Inc. delivered a load of steel tubing to Cumberland Valley Welding, 118 West Orange Street, Shippensburg, Cumberland County, PA. 4. Plaintiff Russell H. Christy, Jr. was employed by Cumberland Valley Welding. 5. The steel had been improperly bundled by defendant and had come apart. As Mr. Christy attempted to push the loose pieces back onto the skid, another part of the load slid toward him and lacerated the middle and index fingers of his left hand -.. ~ /- ~.'l .', ' , { I '.",'.". .' . t -'" .,' '., I . '. ., . . ' ,~ ' _ , :' . . . because the sharp edges of the tube had not been properly de burred by Defendant Grove, 6. The plaintiff's injury was caused by the negligence and carelessness of defendant in: A. Failing to properly secure and band its steel tubing on the skid; B. Failing to properly deburr the steel tubing prior to shipment, and C. Failing to warn the plaintiff of said dangerous conditions. COUNT I RUSSELL H, CHRISTY. JR, v, GROVE MANUFACTURING. INC. 7. Paragraphs 1-6 are incorporated herein by reference. 8. As a result of the negligence and carelessness of the defendant, Plaintiff Russell H. Christy, Jr. sustained a laceration of his left middle finger including laceration of the extensor tendon and severe laceration to the left index finger requiring surgical repair at the Chambers burg Hospital. 9. As a result of his injury Plaintiff Russell H. Christy, Jr. was required to incur medical expense for treatment and will incur same in the future. 10. Plaintiff was unable to work for three months following his injury. 11. Plaintiff was forced to undergo extreme mental and physical pain and sUffering and will undergo same in the future, and has experienced a loss of life's pleasures, VERIFICATION Russell H. christy, Jr. and crystal A. It is admitted that defendant has a principal place of business in Shady Grove, Pennsylvania. It ib denied, however, that defendant has been properly named. On the contrary, defendant's proper name is Grove North America, Division of Kidde Industries, Inc. 3, Admitted. 4. Admitted. 5. Denied. Defendant denies that the load of steel had been improperly bundled, On the contrary, the load of steel sent to Cumberland Valley Welding by defendant was, in all respects, properly secured to the skid designed for its transportation. With regard to the other averments of this paragraph, after reasonable investigation defendant is without knowledge or information sufficient to form a belief as to their truth, and proof thereof of hereby demanded at trial, if relevant. 6. Denied. Defendant denies that plaintiff's injury, if he suffered any at all, was caused by either negligence or carelessness on its part, including but not limited to the assertions of negligence set forth in subparagraphs A through C. On the contrary, defendant's conduct with respect to the load of steel sent to Cumberland Valley Welding on May 10, 1993, and otherwise, was careful and free of negligence in all respects. The complaint fails to state a claim upon which relief can be granted. 16. The damages allegedly sustained by the husband plaintiff were caused solely, or were contributed to, by his own negligence, lack of due care, or other fault. The degree of such negligence was equal to or greater than any fault of defendant, which is specifically denied. 17. The damages complained of by plaintiffs resulted from uncontrollable circumstances, or the conduct of third parties over which defendant had no control or right of control, or which could not reasonably be anticipated by defendant. 18. Plaintiffs' cause of action is barred, in whole or in part, by the Pennsylvania Comparative Negligence statute, 42 Pa. C.s. 5 7102 ~ ~., or the doctrines of comparative and contributory negligence. -4- 19. The conduct of the husband plaintiff, including acts and failures to act, estops plaintiffs from recovery. 20. The husband plaintiff assumed the risk of the injuries he allegedly sustained because he voluntarily chose to encounter a risk he knew to exist. 21. The damages alleged in the complaint were caused by the negligence, lack of due care, defective product, intentional act, recklessness, breach of warranty, or other fault of a person, corporation, firm, association, governmental entity or agency, or organization (or more than one) other ~ defendant, its agents, directors, servants, employees, subsidiaries, vendors, predecessors, or related corporations. 22. Plaintiffs are barred from recovery because the husband plaintiff'S own negligence, lack of due care, or other fault caused or contributed to the cause of the incident described in the complaint; alternatively, plaintiffS' recovery, if any, must be diminished in the proportion that the husband plaintiff's culpable conduct bears to the culpable conduct of all parties and other persons found to have caused the incident described in the complaint.
