not been able to determine the truth of the allegation. The same is
therefore denied and proof thereof is required at trial, if relevant.

rent amount filled-in.

8, Admitted in part and denied in part, There is no notice
attached for January 8, 1995. However, there is a notice for December
8, 1994, which is not referred to in the Complaint. The balance of the
this averment is admitted.
9. Admitted in part and denied in part. Admitted as to
plaintiff'S intent, It'S denied that the defendant is a habitual late
payer of rent.
10. Admitted.

11, At the present time, defendant is paid up' to -date on the
rent, hnvinQ paid the March rent to the prothonotary's office.
12, On each occasion when the monthly rent was paid late, to
wit, June, Auquut, Septcmber and December of 1993, defendant paid same
no more than sevcn days late (inCluding late fees).
On each such
occasion, defondant would forewarn the office manager, a Janice Davis,
that hcr rcnt would be a few days late because of the day defendant
received her pay from the Dauphin County Home (or on the occasion of the
lete Decembcr, 1993 rent, that her lateness would be due to having to pay
o school tax) and the said representative of plaintiff advised defendant
that it would be satisfactory as long as it was within a week or 50 as
long aR the penalty payment was made.
WIIEREFORE, defendant requests the Court to dismiss the
complaint,

COM P L A I N T
1. Plaintiff is Orchard Apartments, a housin~ development
project with its principal office at 2204 Cedar. Run Drive,
Extended, Camp Hill, Cumberland County, Pennsylvania 17011.
2. Defendant is Barbara Wilkerson, an adult individual, a
tenant of plaintiff and lives at 2200-E Cedar Run Drive, Camp Hill,
Cumberland County, Pennsylvania 17011.
3. Plaintiff I s housing proj ect is a subsidized housing
.,
project under Section 8 of the Housing and Urban Development Act,
and because of the federal subsidies certain special rules and
regulations apply.
4. On September 14, 1992, the parties hereto entered into a
lease agreement whereby plaintiff agreed to rent to defendant, and
defendant agreed to rent from plaintiff the said apartment at 2200-
E Cedar Run Drive Extended, for a thirteen month term beginning
December I, 1992, and defendant has resided there ever since. A
copy of said lease is attached hereto, incorporated herein by
reference, and marked Exhibit "A".
5. Pursuant to Paragraph 3 of the said Lease, the monthly
rental was $ 323.00
6. Pursuant to Paragraph 5 of the said Lease provides for
penalty charges for the late payment of rent, and further, that
Landlord may terminate the Lease Agreement for non-payment of rent.
7. Pursuant to Paragraph 23 of the said Lease, the Landlord
may terminate the Lease Agreement for Material Non-compliance,
which includes repeated late payments of rent.
B. On June B, 1994, August B, 1994, September 9, 1994 and
January B, 1995 defendant was sent notices for the late payment of
her rent and given eviction notices therefor. Copies of said
Notices are attached hereto, incorporated herein by reference and
marked Exhibit B, Cr 0 and E.
9. Orchard Apartments has opted to terminate the said Lease,
pursuant to paragraphs 3, 5 and 23 thereof, for tenant's material
non-compliance in that she is a habitual late payer of her rent.
10. Defendant has failed or refused to vacate the premises
pursuant to said notices.
