1. The Plaintiffs, Alan Bailey and Donna Bailey are adult
individuals with principal offices at 6498 Carlisle Pike,
Cumberland County, Pennsylvania.
2.
The
Defendant,
Burdland Inc.
is a
Pennsylvania
Corporation with offices at 220 N. York Street, Mechanicsburg,
Pennsylvania 17055.
3. The Defendan t was a tenant in possession of premises
located at Seven Silver Spring Drive, Mechanicsburg, Cumberland
County, Pennsylvania, when the Plaintiff purchased the property on
September 24, 1993.
4. The Plaintiffs originally believed that no written lease
existed for the premises but were told by Denton Burd, one of the
eorporate officers, that a written lease was executed for the
premises and that he had a copy of same but repeatedly refused to
produee it for the Plaintiffs.
5. The Defendant was paying rent in the amount of $2500 per
month for the ~foresaid premises, which rent was due on the first
of the month and which the Defendant paid on a sporadic basis.
6. The Defendan t was in possession of the premises in
November and December 1994 and only Pilid $500 in ren t, leaving a
balance of $4500 due.
7. Late charges were due and owing in the sum of $50 for
each day that the rent was due. The Defendant remained in a past
due status for 132 days commencing with July 1994, thereby accruing
$6600 in late charges.
8. The Defendant has repeatedly been asked to pay the
aforesaid sums, all of which are due and which the Defendant
refuses to pay.
WHEREFORE, the Plaintiffs request judgment against the
Defendant in the sum of $11,100 together with interest, attorney
fees and costs.
