WHEREAS, VICTORIA GLEN ASSOCIATES, of 4075 Market Street, Camp Hill, PA 17011,
is about to execute contemporaneously herewith, a contract, with ItAUBERT HOMES, INC., of 15 Central
Boulevard, Camp Hill, PA 17011 for the construction of a dwelling located upon premises commonly kno;vn
as Lot 94 Fairwinds, Phase IH, Hampden Township, Cumberland County, Pennsylvania, as set forth in the
Deed dated November 13, 1987, and recorded December 15, 1987, at Deed Book C, Volume 33, Page 304,
in the Recorder's Office for Cumberland County, Pennsylvania, as more specifically described in Exhibit "A"
which is incorporated herein and attached hereto.
NOW, July .~ ! ,2002, at the time of and immediately before the execution of the principal
contract, and before any authority has been given by the said Owner to the said Contractor to commence work
on the said building, or purchase materials for the same in consideration of the making of the said contract with
Contractor and the further consideration of One Dollar ($1.00), to Contractor paid by Owner, it is agreed that
no lien shall be filed against the building by the Contractor, or any subcontractor, nor by any of the
materialmen or workmen or any other person for any labor, or materials purchased, or extra labor or materials
purchased for the erection of said building, the right to file such liens being expressly waived.
WITNESS, our hands and seals the day and year aforesaid.

ALL TI/AT CERTAIN tract or parcel of land being situate in Hampden Township, Cumberland County,
Pennsylvania, more particularly bounded and described as follows, to wit;
BEGINNING at a point on the southern right-of-way line of Inverness Drive, a 50 foot wide street, said
point being the northeastern corner of Lot No. 95; THENCE along said right-of-way line along a curve to
the fight having a radius of 1475.00 feet and an arc length of 82.01 feet, said arc being subtended by a chord
of North 71 degrees 41 minutes 52 seconds East a distance of 82.00 feet to a point, said point being the
northwestern comer of Lot No. 93; TItENCE along the western line of said lot South 16 degrees 42 minutes
34 seconds East a distance of 126.68 feet to a point, said point being on the northern line of Lot No. 87;
THENCE along the northern line of said lot South 75 degrees l0 minutes 28 seconds West a distance of
75.22 feet to a point, said point being the southeastern corner of Lot No. 95; THENCE along the eastern
line of said lot North 19 degrees 53 minutes 42 seconds West a distance of 122. I I feet to a point, the

CONTAINING: 9,797.88 square feet or 0.2249 acres.
SAID Lot is being subject to halfofa 20 foot wide Drainage Easement following the southern boundary line
as being shown in greater detail on Final Plat Sheet 2 of 4 of Phase 3 of Fairwinds Subdivision revised
