building upon premises commonly known as LOT 39 LIBERTY WOODS, MT, HOLLY SPRINGS MT,
HOLLY SPRINGS, CUMBERLAND County, Pennsylvania, as set forth In the deed dated
.Inn, 27. 1995 recorded at Deed Book lL8 ,Page 80 ,in the Recorder's Office for
CUMBERLAND County, Pennsylvania, as more specifically described In Exhibit . A" which Is
incorporated herein and attached hereto,
NOW, FEBRUARY 14, 1994, at the time of and immedlalely before the execution of the
principal contract, and before any authority has been given by the said Owner to the said Contractor 10
commence work on the said building, or purchase malerials for the same in considerallon of the making
of the said r~ntract with Contractor and the further conslderalion of One Dollar ($1,00), to Contractor
paid by Owner, it is agreed that no lien shall be filed against the building by the Contractor, or any
subcontractor, nor by any of the materialmen or workmen or any other person for any labor, or malerials
purchased, or extra labor or materials purchased for the erection of said building, the right 10 ,file such

ALL that certain tract of land situate in the Borough of Mount Holly Springs, Cumberland
County. Pennsylvania, bounded and described in accordance with a Plan prepared by Walter N,
Heine Associates, Inc" Engineers, dated December 8, 1989 and recorded in Plan Book 64, Page
90, as follows:
BEGINNING at a point on eastern dedicaled right-of-way line of Independence Drive at
Lot No, 40 of said Plan; thence along Lot No, 40, North 70 degrees 27 minutes 31 seconds East

CONTAINING 0.1823 acre and designated as Lot No, 39 on Plan of Liberty Woods,
SUDJECf to the following restrictions:
1. All residential struclures shall have a minimum of 1100 square feet of finished living
floor area,
2, No mobile homes shall be placed on any lot in this subdivision,
3, No dumping or stockpiling ofmaterinls or other items shall be pennitled nor the
accumulation of any junk or unlicensed vehicles on any lot within said subdivision,
4. Tree removal shall be kept to a minimum to pennit the construction ofa primary
residence and garage,
5, Lot owners shall be responsible for the installation and mainlenance of a sidewalk
along the street frontage of their lot, Sidewalk construclion musl be completed within one year of
lot purchase, The sidewalk must be constructed as per the specifications oCthe approved plan of
subdivision.
6, The driveway to the house must be paved with a biluminous or concrete finish within
one year of the completion orany residential structure,
7, A residential structure must be completed and habitable within two years of the
purchase price of the lot. Failure to accomplish this shall give the developer an exclusive option
to repurchase the 101 for Ihe same price as the original purchase, An owner of two or more
contiguous lols need not construct more Ihan one residence on those lots.
