COMPLAINT
AND NOW COKES, the Plaintiff~ Suzanne F. Medvidovich, by and
through her attorneys, Reager & Adler, P.C. and John J. McNally,
III, Esquire, to make the following Complaint:
1. Plaintiff, Suzanne F. Medvidovich, is an adult individual
residing at 1034 Chelmsford Drive, Mechanicsburg, pennsylvania,
17055 (hereinafter "Plaintiff").
2. Defendant, Michael W. Boukis, is an adult individual
residing at 410 Market Street, New cumberland, Pennsylvania, 17070
(hereinafter "Defendant").
8. In 1994, Defendant attempted to make repairs to the
damaged areas of the floor.

9. The attempted repairs did not correct the problem, and
further damaged the floor.
10. The cause of the aforementioned problem was Defendant's
failure to use accepted construction practices and materials when
he originally installed and subsequently attempted to repair the
subflooring.
11. In or about March of 1993, plaintiff began to experience
significant water accumulation in the basement of the house.
12. The said water accumulation was immediately brought to
Boukis' attention.
13. Defendant attempted, without success, to remedy the
situation in or about the spring of 1993 by redistributing fill
around the foundation.
14. Defendant failed to construct the basement in accordance
with accepted construction practices.

15. At the time she closed on the purchase of the house,
Plaintiff did not and could not know of the aforomentioned
defective work since it was latent and not such as would be
discoverable to a prudent person upon reasonable inspection.
16. The failure by Defendant to properly install the flooring
and subfloors in the house and construct the basement so that it
was waterproof was a breach of the implied warranty of habitability
and reasonable workmanship contained in the Agreement.
17. Plaintiff has had the defective flooring work remedied at
the following expense:
(a) replacing subfloor and tile -- $11,250.00;
(b) repairs to drywall -- $500.00;
(c) painting areas affected by repairs -- $1,700.00;
(d) repairs to subfloor in carpeted areas -- $1,000.00;
and
(e) cleaning made necessary by repairs -- $700.00.

(a) Defendant did represent the goods to have certain
characteristics, uses and benefits which they did not have,
namely that the floors were safe, secure and functional, and
that the basement would be waterproof; and
(b) The construction performed by Defendant and the
repairs allegedly made were inferior or below a particular
standard in the industry.
23. The Unfair Trade Practices and Consumer Protection Law
provides for treble damages and counsel fees in the event of
violation of the statutorily prohibited conduct averred above.
WHEREFORE, Plaintiff respectfully requests that this Honorable
Court treble damages awarded under Count I, and to award Plaintiff
her counsel fees and costs.

Mr, Boukis has been in the Dauphin Counly prison conlinuously since the fall of 1995, He
is not scheduled to be released unlillhe end of June or early July. Obviously, neilher he nor I can
conlrol when he will be released,
I know of no way Ihat I can adequalely take his leslimony, by deposition or otherwise,
while he is in prison, Unlil he hears Ihe case presenled by Ihe PlainlilT al the hearing, he will nol
be able 10 respond 10 il in his testimony. II is vilallo his case Ihal he appear and be heard al the
evenlual hearing in the case,
It makes no reason 10 put everyone 10 Ihe inconvenience of a hearing if my clienl will not
be available 10 tesliiY and I will have to eilher petilion the court 10 poslpone Ihe hearing or simply
lake an appeal from your decision and force everyone to the expense and inconvenience of a jury
lrial. The case has already languished some lime (and, in facl, was filed years after Ihe problems
were originally discovered), I see no reason why anolher Iwo or Ihree months are going 10 kill
anyone, Accordingly, I request that you schedule a hearing for lale July, by which lime my client
should be oul of jail and should be available 10 leslify,

and makes the following Answer to Plaintiff's Complaint:

5. Dcfendant denies that thc floor tiles throughout the first tloor ot the house
were separating trom the subt100ring and avers that, to the contrary, only a tew tiles
became loose and that the Detendant subsequently repaired those tiles.
6, Denied. The subt100ring under the carpeted areas ot the residence did not
come loose.
7. It is admitted that the P1aintitf complained to Defendant of these problems
but it is denied that she accurately described lhe alleged problems,
8. Denied as stated. Defendant made repairs to the P1aintitt's home and repaired
thc alleged damage.

9, Denied. The work done by the Defendant corrected the problem and did not
further damage the floor.
10. Denied. Defendant used construction practices and materials acccpted in the
construction industry at the p1acc and time they were used,
11. Denied as stated. It is admitted that some water ran into Plaintiff's
basement, but it is denied that there was a "significant water accumulation,"

13. Denied as stated. Defendant did some work on the residence to repair the
problem.
14. Dcnied. Defendant constructed the entire residence in accordance with
construction practices accepted in the construction industry at the time and place the
building was constructed,
15. Defendant denies there was any defective work on thc home purchased by the
Plaintiff. To the extent there were any defects in the home, however, they were
readily apparent and observab1c by the Plaintiff upon her inspection of the home prior
to entering the agreement to purchase it.
16. Denied. There was no implied warranty of habitability and reasonable
workmanship contained in the agreement between the partics, To the contrary, the
agreement specifically and exprcss1y stated there were 110 such warranties or
understandings. Bven if such warranties existed, Defendant did not breach them bccause
he installed the flooring and sub floors properly and constructed the basement properly.
11. Defendant admits that Plaintiff had addi tiona1 work done to hcr home but
specifically denies that the items listed in Paragraph 11 of Plaintiff's Complaint
remedied thc problems of which Plaintiff now complains, were necessary to remedy such
problems, or were reasonable costs to remedy sllch alleged problems,

23. Thc said statute speaks for itself and no characterization of it is necessary
here. Defendant denies. however, that he is liable to Plaintiff for damages of any
type or for counsel fees.
WHEREFORE, Defendant prays this Court to dismiss Plaintiff's Complaint.

AND NOW comes the above-named Defendant, by his attorneys, Andcs, Vaughn & Bangs.
and makes the following New Hatter to Plaintiff's Complaint:
24. The agreemcnt of sale between the parties. which is attached to Plaintiff's
complaint, expressly waives and disavows any warranties, promises or understandings
bctween the parties not set forth thcrein.
25. Plaintiff is obligated to take reasonable steps to mitigate her damagcs.
26. Plaintiff has failed to take reasonable steps to mitigate hcr damages and
has, in fact, by her own conduct, aggravated her financial loss,
27. Plaintiff's action, particularly that portion requesting treble damages and
counsel fees, is contrary to the law of Pennsylvania and contrary to the intentions of
the statute on which Plaintiff claims to bring that action.
~IEREFORE, Defendant prays this Court to dismiss Plaintiff's Complaint and to
enter Judgment, together with an award of counsel fees, in favor of Defendant and
against Plaintiff.

contractors after Defendant's attempts failed and Defendant's
