SIMPSON, his wife, Owners vs. RICH VALLEY ASSOCIATES, Tenant IN TilE COURT OF COMMON PLEAS OF CUMBERLAND COUNTY, PENNSYLVANIA No. rr- 7f~ M'-b Term 1994 vs. : Peter Them Buildings, Inc., : Contractor STIPULATION AGAINST LIENS WHEREAS, Peter Them Builders, Inc., a Pennsylvania Corpo- ration with its principal office at 820 Fairview Road, Carlisle Pennsylvania 17013, is about to execute contemporaneously herewith, a contract with RICH VALLEY ASSOCIATES of 3609 Old Gettysburg Road, Camp Hill pA 17011, providing for this Stipulation Against Liens as general contractor for the original erection and construction of a dwelling on Lot #33 in Rich Valley Manor phase II, more particularly bounded and described as follows: ALL that certain tract or parcel of land situate in Silver spring Township, Cumberland county, Pennsylvania, more particularly bounded and described as follows: BEGINNING at a point on the Northern Right-of-Way line of Skyline Drive (a 60 I ROW) at the common front property corner of land now or late of Phyllis C. Mengle and lands of Grantor laid out in the Final subdivision Plan of Rich Valley Manor phase II prepared by Hartman and Associates and record- ed in the Office of the Recorder of Deeds in and for Cumberland County in Plan Book 64 at Page 11 as Lot #33, phase II; thence along the eastern property line of said Mengle land North twenty-five degrees, fourteen minutes, twenty seconds (N. 25", 14', 20" W.) West a distance of three hundred seventy-five and sixty-three one-hundredths (375.63 ') feet to a point at Lot 32 on said Plan; thence along Lot #32 North fifty-five degrees, fi fty-three minutes (N. 55", 53 I E.) East, a distance of one hundred twenty-five and thirteen "' ....' one-hundredths 1125.13') feet to a point at Lot #34 on the Plan hereinnbove described; thence along Lot #34 South thirty-four degrees, nineteen minutes, thirty second (S. 34", 19', 30" E.) East, a distance of three hundred seventy-seven and twenty-seven one-hundredths (377.27') feet to a point on the Northern Right-of-Way line of Skyline Drive; thence along said Right-of-Way South fifty-five degrees, forty minutes, thirty seconds (S. 55", 40', 30" W.) West, a distance of fifty-eight and fifteen one-hundredths (58.15') feet to a point; thence along the same on the arc of a curve to the right having a radius of one thousand one hundred seventy (1,170') feet, the arc distance of one hundred twenty-six and fifty-five one-hundredths (126.55') feet to a point, the place of BEGINNING. Being Lot #33 on Rich Valley Manor Phase II Plan afore- said containing 1 1/3 acres, more or less. BEING same premises which Peter Them Builders, Inc, by Deed dated and recorded in the Office of the ~order of je:!.fj in Cumberland County at Record Book ~ at Page , granted and conveyed to Jerry T. Simpson and lIilary M. impson, his wife. NOW THIS, J/~/.t.day of January 1995, at the time and immedi- ately before the execution of the principal contract, and before any authority has been given by the said RICH VALLEY ASSOCIATES to the said PETER TIIEM BUILDERS, INC., to conunence work on the said building, or purchase materials for the same, as consideration of the making of the said contract with RICII VALLEY ASSOCIATES and the further consideration of One ($1.00) Dollar paid to it by RICH VALLEY ASSOCIATES, it is agreed that no lien shall be filed against the building by the Contractor, or any sub-contractor, nor by any of the material men or workmen or any other person for any labor, or materials purchased, or extra ,". .... labor or materials purchased for the erection and construction of said building or other work with respect thereto.
