THIS AGREEMENT made the~ of July, 2002, by and between
THE MCNAUGHTON COMPANY,
LOUIS J. LORE, JR. and KATHY I. LORE, hereinafter referred to as
Owner, whereby the former undertook and agreed to erect and
construct a single family dwelling on that certain lot of ground
situate in
5405 Barbara Drive, Mechanicsburg PA 17050 (see attached legal)
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for and in consideration of the sum of ($1.00) Dollar
to contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for themselves and their subcontractors, and
all parties acting through or under them, covenant and agree that
no mechanic's liens or claims shall be filed or maintained by
them or any of them against the said buildings and the lot of
ground appurtenant thereto for or on account of any work done or
materials furnished by them or any of them under said contract or
otherwise, for, towards, in, or about the erection and
construction of the said buildings on the lot above described,
and the said Contractor, for themselves, their subcontractors and
others under them hereby expressly waive and relinquish the right
to have, file, and maintain any mechanic's liens or claims
against the said buildings or any of them, and agree that this
instrument, waiving the right of lien, shall be an independent
covenant.

ALL THAT CERTAIN piece, parcel or lot of land, together with
improvements, situated in Hampden Township, Cumberland County,
Pennsylvania, and bounded and described as follows:
BEGINNING at a point on the Northern right-of-way line of Barbara
Drive (50.00 feet wide), said being located at the Southeastern
corner of Lot No. 309; then along the Eastern boundary line Lot
No. 309, North 10 degrees 59 minutes 07 seconds West, for a
distance of 125.00 feet to a point on the right-of-way line of
Skyport Road (50.00 feet wide); then along said right-of-way line
of Skyport Road (50.00 feet wide), North 79 degrees 00 minutes 53
seconds East, for a distance of 100.00 feet to a point at the
Northwestern corner of Lot No. 311; then along the Western
boundary line of Lot No. 311, South 10 degrees 59 minutes 07
seconds East, for a distance of 125.00 feet, to a point on the
Northern dedicated right-of-way line of Barbara Drive (50.00 feet
wide); then along said right-of-way line South 79 degrees 00
minutes 53 seconds West, for distance of 100.00 feet, to a point
and the place of BEGINNING.
This piece, parcel or lot of land contains approximately 12,500.00
square feet of land, has an address of 5405 Barbara Drive,
Mechanicsburg, Pennsylvania 17055, and is known and numbered as
Lot No. 310 on the Final Subdivision Plan for Good Hope Farms
South-Phase III, which is recorded in Cumberland County in Plan
Book 77, Page 82.
UNDER AND SUBJECT to any and all easements, licenses, leases,
exceptions, reservations, covenants, agreements, conveyances and
restrictions which affect the premises and are visible by
inspection of the premises.
ALSO UNDER A_ND SUBJECT to any and all easements, licenses, leases,
exceptions, reservations, covenants, agreements, conveyances and
restrictions contained in any and all prior documents,
agreements, instruments, deeds, grants and conveyances affecting
the premises.
ALSO UNqDER D_ND SUBJECT to the Declaration of Covenants and
Restrictions, recorded in Cumberland County in Miscellaneous Book
596, Page 1127, as may be applicable to the above described
property.
BEING THE SAME PREMISES which The McNaughton Company, by deed
to be recorded simultaneously herewith in the Cumberland County
Recorder of Deeds Office to grant and convey unto Louis J. Lore,
Jr. and Kathy I. Lore.
