In the Court of Common Pleas of
Cumberland County, Pennsylvania

Whereas, David L. and Robin M. Hittie of North Middleton Township,
Cumberland County, Pennsylvania are about to execute contemporaneously
herewith a Construction Agreement with 84e,~,Y-~,~, Yanek Custom Homes,
Inc., 8 South Ridge Road, Boiling Springs, Cumberland County, Pennsylvania,
for the construction of a dwelling house upon a lot of land situate at 125 Channel
Drive, Carlisle, Cumberland County, Pennsylvania (hereinafter "Property").
Now, this /~'~'" day of July, 2002, at the time of and immediately
prior to the executi(~n of the principal contract, and before any authority has been
given by David L. and Robin M. Hittie to S~-Y~k, Yanek Custom Homes,
Inc. to commence work on the said dwelling house or purchase materials for the
same, in consideration of the making of the Construction Agreement with David
L. and Robin M. Hittie, and the further consideration of one Dollar to~te~e
Y=a~I~, Yanek Custom Homes, Inc. paid by David L. and Robin M. Hittie, it is
agreed that no lien shall be filed against the dwelling house or Property by the
contractor, or by any sub-contractor, or by any of the material men or workmen or
any other person for any labor, or materials purchased, or extra labor or
materials purchased for the construction of the said dwelling house, the right to
file such liens being expressly waived.
