The Plaintiff is The Prudential Stewart Real Estate, doing business at 47 W. Pomfret Street, Carlisle, Cumberland County, Pennsylvania l70l3. .' 2. The Defendant David S. Hamilton is an adult individual residing at 418 Ricky Road, Mechanicsburg, Cumberland County, Pennsylvania l70l3. 3. The Defendant Catherine A. Hamilton is an adult individual residing at 609 Grantham Road, Mechanicsburg, Cumberland County, Pennsylvania l7055. 4. Defendants Everett W. VanDan Eeden and Yolanda VanDan SAIDIS, GUIDO, snUFF & MAS LAND 26 W. IlIgh S"<<I C41lisle. IlA Eeden, his wife, are adult individuals residing at 98 Millers Gap Road, Enola, Pennsylvania. 5. On or about June 22, 1994, the Defendants David S. Hamilton and Catherine A. Hamilton entered into a listing agreement with the Plaintiff for the sale of the premises known as 1019 E. Lisburn Road, Mechanicsburg, Cumberland County, Pennsylvania 17013; a copy of said listing agreement is attached hereto and made a part hereof marked as Exhibit "A". 6. Pursuant to said listing agreement, the Plaintiff was to receive a commission for procuring a ready, willing and able buyer for said premises, at the commission rate of 6.5% of the agreed sale price. 7. On or about July 12, 1994, the Defendants David S. Hamilton and Catherine A. Hamilton entered an agreement for the sale and purchase of the said real estate with the Defendants Everett W. and Yolanda VanDan Eeden, for the amount of One Hundred Twenty Thousand Five Hundred and OO/lOO ($l20,500.00) Dollars; a copy of said agreement is attached hereto and made a part hereof marked as Exhibit "B". 8. The VanDan Eedens, the proposed purchasers under said agreement, defaulted under the terms of said agreement and the sale was never consummated. 9. A commission due on this amount was Eight Thousand Four Hundred Thirty Five and OO/lOO ($8,435.00) Dollars, which was not paid by reason of a defaulting purchaser. lO. Paragraph II of the listing agreement provides as follows: SAJDIS, GUIDO, snUFF & MASLAND 26 W. IIigh SIlt" ClUlil1c,I'A BUYER DEFAULT: Agent's fee in the event of buyer default is 50% of/from any monies paid on account; however, under no circumstances shall Agent's portion thereof exceed the amount of the commission. ll. The amount paid by the prospective purchasers on account was Ten Thousand and OO/lOO ($10,000.00) Dollars, which was to be held in escrow. The VanDan Eedons subsequently stopped payment on a check in this amount. 12. Pursuant to Paragraph 11 of the listing agreement, with 50% of this amount owed, the Plaintiff would have been entitled to Five Thousand and 00/100 ($5,000.00) Dollars. COUNT I THE PRUDENTIAL STEWART REAL ESTATE V. DAVID 5. HAMILTON AND CATHERINE A. HAMILTON l3. Paragraphs 1 through 12 are incorporated herein and made a part hereto by reference. l4. Pursuant to Paragraph II of the listing agreement, with 50% of the amount owed, the Plaintiff would have been entitled to Five Thousand and 00/100 ($5,000.00) Dollars, which represented 50% of the Ten Thousand and OO/lOO ($lO,OOO.OO) Dollars paid. l5. Defendants David S. Hamilton and Catherine A. Hamilton breached their contract known as the listing agreement by refusing to pay the Five Thousand and OO/lOO ($5,000.00) to the Plaintiffs. l6. Despite repeated demands to the Defendants David S. Hamilton and Catherine A. Hamilton have refused to pay this amount. SAIDIS. GUIDO, SHUFF & MAS LAND 26 W. Hamilton in the amount of Five Thousand and OO/lOO ($5,000.00) Dollars, costs on the underlying District Justice Complaint, and costs of this action. COUNT II PRUDENTIAL STEWART REAL ESTATE V. EVERETT W. VANDAN EEDEN AND YOLANDA VANDAN EEDEN l7. Paragraphs 1 through 16 are incorporated herein and made a part hereto by reference. 19. Pursuant to the agreement of sale between the Hamiltons and the VanDan Eedens (Exhibit "B" hereto), the VanDan E0dens paid under Paragraph 4(b) a deposit cash marked "upon acceptance" in the amount of Ten Thousand and 00/100 ($lO,OOO.OO) Dollars. 20. This money was paid on account by the VanDan Eedens. 2l. The VanDan Eedens breached the contract agreement of sale between themselves and the Hamiltons, and did not follow through with the transaction. 22. In addition, the VanDan Eedens stopped payment on the Ten Thousand and OO/lOO ($lO,OOO.OO) Dollars check they had tendered and held by the Plaintiff. 23. The Plaintiff Prudential stewart Real Estate is a SAlOIS, GUIDO, SnUFF & MAS LAND 26 W. lIi&h 511<<1 Cllfllslcll'A third party beneficiary under the agreement of sale between the Hamiltons and the VanDan Eedens, as far as the 50% of the deposit as to be paid under the contract. 24. By stopping payment on the check, or in the alternative, by not paying the amount of deposit in cash, the Plaintiff has suffered a loss as a third party beneficiary in the amount of Five Thousand and OO/lOO ($5,000.00) Dollars. 25. In addition, the Plaintiff had to pay the sum of Seven and 50/100 ($7.50) Dollars to their escrow account because the VanDan Eedens stopped payment on the check. WHEREFORE, the Plaintiff demands judgment in favor of the Plaintiff and against the Defendants Everett W. VanDan Eeden and Yolanda VanDan Eeeden in the amount of Five Thousand and Seven and 50/100 ($5,007.50) Dollars, plus interest and costs of this suit. That The Hamilton - Van Den Eeden Agreement (Exhibit "B" of Plaintiff's Complaint) does not indicate an intent that performance under the Agreement is to benefit Plaintiff. 3. That the Van Den Eedens never undertook any obligation as expressed in Exhibit "B" to benefit Plaintiff. 4. That Plaintiff is identified solely as agent or fiduciary for Seller in the Agreement, Exhibit "B", and not as having any independent rights or obligations thereunder except as an agent of Sellers. 5.
