Dethlefs, Esquire, and make this Complaint agalnst the Defendants as follows: 1. 'l'he Plaintiff, ROBERT BAYLER is an adult individual currently residing at 530 Carol Street. New Cumberland. Cumberland County. Penn~ylvania. 2. 'l'he Plaintiff, LAVIDA BAYLER is an adult indlvldual currently residing at 530 Carol Street, New Cumberland, Cumberland county, Pennsylvania. 3. The Defendants. ARNOLD W. GRADEK and JILLETHA GRADEK, are adult individuals residing at 1301 Third Avenue, New Brighton. Beaver County, Pennsylvania. 4. Plaintiffs entered into an Agreement of Sale with Defendants dated June 21, 1~94, whereby Plaintiffs were to purchase and Defendants were to sell 530 Carol Street, New Cumberland, Cumber land Count y, Pennsylvania. here ina fter called the "Premises", A true and correct copy of sald Agreement of Sale IS attached and incorporated hereIn and marked as Exhl.blt "A", . The Plaintiffs paid cash for the property at settlement, 6. Since September 15, 1994, Plaintlffs have been residing at the Premises and have been maintainlng it as their primary residence. 7, Prlor to clOSIng on this property, Plaintiffs were advised by the Defendants and/or their agents, employees and/or servants that an inspection of the property by a qualified home lnspector was not requlred. 8, The Defendants and/or their agents, servants and/or employees prepared a questionnaire regarding the condition of the property and presented this questionnaire to the Plaintiffs, 9. The questionnaire stated that the roof of the Premises ln question had been repaired and replaced during the Defendants I ownerShip. A true and correct copy of said questionnaire is attached hereto and marked as Exhibit "B". 10. The questlonnaire also indicated that a leak around the chimney had been repaired, 11, Defendants and/or ltS agents, servants and/or employees knew that Plaintlffs had no speclal knowledge of such matters and would rely on Defendants' mlsrepresentatlon, 12. NEW MATTER 17. In paragraph 16 of the Agreement, Plaintiffs acknowledge having inspected the property or having waived the right to do so and that they were purchasing the property as a result of their own inspection and "not because of or in reliance of any representation made by the seller or any other person or employee of seller or by the agent of the seller or any of the latter's sales persons and employees or by a cooperating broker, if any, or any of his/her sales persons and employees" and that they [Plaintiffs] have "agreed to purchase it in its present condition unless otherwise specified herein ...". 18. Plaintiffs further set forth in paragraph 16 of the Agreement their understanding that the sellers, agents and cooperating agents were not qualified to render opinions on the construction or engineering of the said property. 19. The aged condition of the roof was apparent to Plaintiffs. 20. At or about the time of the execut10n of the subject Agreement of Sale and up to the time of transfer of possession, Defendants, who resided within the subject premises, did not detect or know of any leaking as complained of by Plaintiffs. 21. Pursuant to an Addendum to the Agreement of Sale executed August 16, 1994, Defendants granted Plaintiffs possession of the premises to store personal effects and for the purpose of making alterations. 22. In years previous to the subject transfer of title, Defendants detected a leak in the area of the chimney. 23. Plaintiffs engaged a contractor to repair the leak. said contractor estimated the cost of repair to be $500.00. During the repair the contractor identified $800.00 of additional work to be done which was undertaken pursuant to the express authorization of Defendants. 24. Subsequent to the aforesaid repairs Plaintiffs experienced no leak despite the harsh conditions that existed during the winter of 1994 and at other times. 25. On June 20, 1994, Plaintiffs completed a Seller's Property Disclosure Statement on which they disclosed the prior problem with the leaking roof. 26. On or about September 10, 1994 Plaintiff's identified a roof leak near the chimney which they communicated to the selling real estate agent. 27. Defendants real estate agent advised that the property was priced to reflect the aged condition of the premises, including the roof, but that Defendants were willing to credit Plaintiffs with $500.00 to be applied to the replacement or repair of the roof. 28. Plaintiffs agreed to Defendants' offer of $500.00 and in accepting the same have reached accord and satisfaction. 29. The accord and satisfaction of the subject dispute bars the instant action.
