Comes now the Defendants, Robert Lewis and B, & B. Enterprises, through their
attorney, Daniel M. Pennick, and files these objections slating as follows:
I. Motion to Strike for Pailure to Confonn to Rule of Court
I. Plaintifrs Complaint fails to confonn to Rules of Court as follows:
A. Rule 1019(1): It does not refer to the place of the making of the contract;
B. Rule 1022: It is not divided into paragraphs which are numbered consecutively.
C. 10l9(h): It does not state whether the agreement is based upon a writing.
II. Insufficient Specificity of a Pleadinl!
2. The Complaint does not state the identity and addresses of the parties nor the place
of the making of the contract.
III. Motion to Strike for Inclusion oflmpertinent Matter
3. The Complaint refers to an alleged offer to settle the matter by Robert Lewis.
[V. Improoer Venue

AND NOW, this (~~. day of April, 1995 comes the Plaintiff,
Kevin P. Culley, by counsel, William A. Fetterhoff, and presents
the following:
1. The Plaintiff is Kevin P. Culley, an adult individual
resident of 6979 Wertzville Road, Enola, Cumberland County,
Pennsylvania 17025.
2. The Defendant Robert Lewis is an adult individual with
a business office at R.D. #2, Waughtel Road, Box 2815, Felton,
York county, Pennsylvania 17322.
3. The Defendant Robert Lewis conducts business as a sole
proprietorship with a principal place of business at the address
set forth in paragraph 2 hereof, under the name of B. & B.
Enterprises.

4. On June 8, 1994 the Plaintiff purchased from the
Defendants a 780 Case Extenda Hoe, 336 Turbo, a back-hoe used for
earth moving and digging, for a purchase price of $8,r,00.00.
5. The transaction referred to in paragraph 4 hereof
occurred at the residence of the Plaintiff in Cumberland County,
at which time and place the Defendant Lewis with his agents
delivered the back-hoe and the Plaintiff handed a check directly
to the Defendant Lewis for the full amount of the purchase price.
6. The back-hoe had been advertised by the Defendant Lewis
in the Auto Locator for a price of $10,000.00, with a photograph
and description as a "1978" 780 Case Extenda Hoe, with a "New
Short Block 326 Turbo" motor. Exhibit A.
7. The receipt signed by the D(.fendant Robert Lewis on
June 8, 1994 identified the back-hoe as a "Case 780, 336 Turbo,
1978 Extenda Hoe, Motor #A5850." Exhibit B.
8. At and before the time of purchase the Defendant Robert
Lewis expressly represented to the Plaintiff that the back-hoe
was manufactured in 1978.
9. At and before the time of purchase the Defendant Robert
Lewis expressly represented to the Plaintiff that the back-hoe
had a new engine.
10. The serial number of the back-hoe is 5500872.
11. The back-hoe was manufactured in 1973. Exhibit c.
12. On June 8, 1994 the Defendant Robert Lewis either knew
that the back-hoe was manufactured in 1973 or had no actual
knowledge of the year of manufacture of the back hoe and
nonetheless intentionally and fraudulently represented to the
Plaintiff that as a matter of fact the back hoe was manufactured
in 1978.
13. The Defendant Robert Lewis purchased the back-hoe from
one Stanley MCKinsey, also of Felton, York County, Pennsylvania.
14. Stanley McKinsey purchased the back-hoe on February 24,
1993 for a price of $7,500.00. Exhibit D.
15. The Defendant Robert Lewis did not place a new short
block 326 turbo or any other new motor in the back-hoe.
16. On June 8, 1994 the Defendant Robert Lewis either knew
that Stanley McKinsey had not placed a new motor in the back-hoe
or had no actual knowledge whether or not stanley McKinsey had
ever placed a new motor in the back-hoe, and the Defendant
nonetheless intentionally and fraudulently represented to the
Plaintiff that the back-hoe had a new motor.

17. The fair market value of a 1973 Case 780 Extenda Hoe on
June 8, 1994 was approxImately $6,500.00, if the same were in
good operating condition.
18. on and before June 8, 1994 the Defendant Robert Lewis
intentionally and fraudulently represented to the Plaintiff that
the back-hoe was in good operating condition.
19. since the date of purchase the Plaintiff has spent a
total of $1,237.21 on parts and repairs to the back-hoe.
Exhibits E-1 through E-11.
20. The Defendant agreed at and before the time of sale to
weld the front bucket brace at his own expense, but upon later
request of the Plaintiff to fulfill that agreement the Defendant
refused.
21. The
cost to weld the front bucket brace is
approximately $250.00.
22. The cost for a rebuilt short block 326 turbo motor for
the back-hoe is $8,000.00 with an installation cost of $1,728.00,
for a total of $9,728.00. Exhibit F.
WHEREFORE, the Plaintiff requests jUdgment against the
Defendant for breach of contract and fraud, with damages in the
amount of $3,487.21, being the difference between the purchase
price and the fair market value, ($2,000.00) plus the cost of the
repairs set forth at paragraphs 19 and 21 hereof, ($1,487.21).
