The pertinent information pertaining to the Child who is the subject of this litigation is as follows: NAME CURRENTLY IN CUSTODY OF BIRTH DATE Kelli Marie Johnson plaintiff/Mother June 22, 1992 2. A Conciliation Conference was held on March 22, 1995, with the following individuals present: The Mother, Michelle L. Anthony, with her counsel, Richard C. Snelbaker, Esquire. The Father, who resides in Shippensburg, did not attend the Conciliation Conference. The Mother's counsel advised the Conciliator that he had mailed the Custody Complaint by regular and certified mail to the Father. The certified mail envelope was returned unclaimed, but the envelope forwarded by regular mail was not returned, In addition, the Mother stated that she was present when the Father received the Custody Complaint by regular mail and that subsequently, the Father advised that he would not attend the Custody Conciliation Conference. Finally, the Mother's counsel has submitted the attached Affidavit with regard to the service of the Custody Complaint. 3. The parties were not married at the time of the Child's birth and are not currently married. The Mother resides with her parents and the Child and the Father resides with his parents. 4. The Mother's position with regard to Custody is as follows: According to the Mother, the Father told her that he does not want the Child to live with him, but would like to see her occasionally. The Mother stated that she takes the Child to the Father's residence mainly because the Father wants to ensure that the Child has contact ... with her paternal grandparents. The Mother believes that the Father has been ambivalent with regard to his parental responsibilities and rights. For that reason, the Mother is seeking sole legal custody as well as primary physical custody of the Child. s. Based on the Mother's representations as to the Father's attitude toward custody, and statements that he would not attend the Conciliation Conference, the Conciliator recOllltlends an Order in the form as attached.
