COMPLAINT
1. The plaintiff, State Farm Mutual Automobile Insurance Company,
hereinafter called State Farm, is an nlinols corporation, having a place of business
at 115 Limekiln Road, New Cumberland, York County, Pennsylvania.
2. The defendant, Brenda Sell, is an individual residing at 33 South
27th Street, Camp Hill, Cumberland County, Pennsylvania.
3. On June 27, 1992, Kirk Sell, who was insured by State Farm, was the
owner of a 1987 Ford Tempo.
4. At or about 11:30 A.M. on the aforesaid date, Kirk Sell's car was
parked along Greenwood Drive, one-tenth of a mile west of Erford Road, in East
Pennsboro Township, Cumberland County, Pennsylvania.
5. At or about the same time, the defendant was operating a Ford
Escort, and collided with Kirk Sell's parked vehicle. The defendant then left the
scene.
6. The collision was caused by the negligence of the defendant in the
following respects:
(a) in failing to have her vehicle under control, and
(b) in running into the parked vehicle.
7. As a result of the colllsion, Kirk Sell sustained $1,424.04 in damages
to his said vehicle, which the defendant has reduced by payments to $1,024.04.
WHEREFORE, the plaintiff claims of the defendant the sum of $1,024.04,
an amount requiring compuisory referral to arbitration under the local rules of
Court.
