NOTICE
You have been sued in court. If you wish to defend against the claims set forth
in the following pages, you must take action within twenty (20) days after this complaint
and notice are served, by entering a written appearance personally or by attorney and
filing in writing with the court your defenses or objections to the claims set forth against
you. You are warned that if you fail to do so the case may proceed without you and a
judgment may be entered against you by the court without further notice for any money
claimed in the complaint or for any other claim or relief requested by the plaintiff. You
may lose money or property or other rights important to you.

3. On or about May 31, 1994, Defendants purchased a 1994 Redman,
manufactured home, Serial No. 12225593, (the "Mobile Home"), from Carlisle Mobile
Homes Inc., (the "Seller"), and entered into a written Manufactured Home Retail
!nstallment Contract and Security Agreement, (the "Security Agreement") for the payment
of a portion of the purchase price thereof. A true and correct copy of the Security
Agreement is attached hereto as Exhibit "A."
4. Seller assigned its interest in the Security Agreement to Plaintiff, Green
Tree Consumer Discount Company. Green Tree Consumer Discount Company
perfected its security interest in said Mobile Home by having an encumbrance placed on
the title thereto. A true and correct copy of the Certificate of Tille is attached hereto as
Exhibit "6."
5. Plaintiff avers that the approximate retail value of said Mobile Home is
$31,000.00 and that the said Mobile Home is in Defendants' possession but its exact
whereabouts are uncertain.
6. Defendants defaulted under the terms of the Security Agreement by failing
to make payments when due. As of February 9, 1995, the Defendants' payments of
interest and principal were in arrears in the amount of $1,116.45. Pursuant to the
Acceleration Clause in the Security Agreement the amount outstanding as of February
9, 1995, is $32,849.72.
7. Plaintiff provided Defendants with thirty (30) days notices) of intent to
repossess the Mobile Home. A true and correct copy of the notices of intent to
repossess the Mobile Home is attached hereto as Exhibit "C."

8, Defendants failed to cure the default or return the Mobile Home upon
Plaintiffs demand.
9. Plaintiff avers that under the terms of the Security Agreement and
Pennsylvania law it is now entitled to immediate possession of said Mobile Home.
10. The Security Agreement provides that in the event of default:
a. Defendants will pay seller's reasonable attorney's fees, provided
that prior to commencement of legal action such fee shall not
exceed $50.00;
b. Court costs and disbursements; and
c. Costs incurred by seller to foreclose on the Mobile Home including
the costs of storing, reconditioning and reselling the Mobile Home.
11. In order to bring this action Green Tree Consumer Discount Company was
required to retain an attorney and did so retain Attorney Erin P. Dyer.
WHEREFORE, Plaintiff, Green Tree Consumer Discount Company, requests
judgment against Defendants to recover the Mobile Home, plus detention damages,
special damages consisting of inter alia, detaching and transporting the Mobile Home,
shipping fees, any cost for insurance placed on the Mobile Home by Plaintiff, late
charges per the Security Agreement, any further costs for repossession and sale, and
attorney's fees and costs of litigation in order to obtain possession of the Mobile Home.
COUNT II - DAMAGES
By way of separate and alternative pleading, Plaintiff, Green Tree Consumer
Discount Company, alleges the following:

COUNT I - REPLEVIN
AND NOW comes Green Tree Consumer Discount Company, by and through its
attorney Erin P. Dyer and avers the following in support of its Complaint in Replevin:
1. Green Tree Consumer Discount Company, hereinafter referred to as
"Plaintiff," is a corporation duly authorized to conduct business in the Commonwealth of
Pennsylvania and has its principal place of business located at 300 Weyman Plaza,
Suite 480, Pittsburgh, PA 15236-0306.
2. Steve Wiser and Robin Wiser, hereinafter referred to as "Defendants," are
individuals whose last known address is at 61 Peachy Ann Drive, Newville, PA 17241.
3. On or about May 31, 1994, Defendants purchased a 1994 Redman,
manufactured home, Serial No. 12225593, (the "Mobile Home"), from Carlisle Mobile
Homes Inc., (the "Seller"), and entered into a written Manufactured Home Retail
Installment Contract and Security Agreement, (the "Security Agreement") for the payment
of a portion of the purchase price thereof. A true and correct copy of the Security
Agreement is attached hereto as Exhibit "A."
4. Seller assigned its interest in the Security Agreement to Plaintiff, Green
Tree Consumer Discount Company. Green Tree Consumer Discount Company
perfected Its security interest in said Mobile Home by having an encumbrance placed on
the title thereto. A true and correct copy of the Certificate of Title is attached hereto as
Exhibit "B."
5. Plaintiff avers that the approximate retail value of said Mobile Home is
$31,000.00 and that the said Mobile Home is in Defendants' possession but its exact
whereabouts are uncertain.
6. Defendants defaulted under the terms of the Security Agreement by failing
to make payments when due. As of February 9, 1995. the Defendants' payments of
interest and principal were in arrears in the amount of $1,116.45. Pursuant to the
Acceleration Clause in the Security Agreement the amount outstanding as of February
9, 1995, is $32,849.72.
7. Plaintiff provided Defendants with thirty (30) days notices) of intent to
repossess the Mobile Home. A true and correct copy of the notices of intent to
repossess the Mobile Home is attached hereto as Exhibit "C."

B. Defendants failed to cure the default or return the Mobile Home upon
Plaintiff's demand.
9. Plaintiff avers that under the terms of the Security Agreement and
Pennsylvania law it is now entitled to immediate possession of said Mobile Home.
10. The Security Agreement provides that In the event of default:
a. Defendants will pay seller's reasonable attorney's fees, provided
that prior to commencement of legal action such fee shall not
exceed $50.00;
b. Court costs and disbursements; and
c. Costs incurred by seller to foreclose on the Mobile Home including
the costs of storing, reconditioning and reselling the Mobile Home.
11. In order to bring this action Green Tree Consumer Discount Company was
required to retain an attorney and did so retain Attorney Erin P. Dyer.
WHEREFORE, Plaintiff, Green Tree Consumer Discount Company, requests
judgment against Defendants to recover the Mobile Home, plus detention damages,
special damages consisting of inter alia, detaching and transporting the Mobile Home,
shipping fees, any cost for insurance placed on the Mobile Home by Plaintiff, late
charges per the Security Agreement, any further costs for repossession and sale, and
attorney's fees and costs of litigation in order to obtain possession of the Mobile Home.
COUNT II - DAMAGES
By way of separate and alternative pleading, Plaintiff, Green Tree Consumer
Discount Company, alleges the following:

PETITION TO ENTER DEFICIENCY JUDGMENT
AGAINST STEVE WISER ONLY
AND NOW, comes Green Tree Consumer Discount Company, by and through its
attorney Erin P.Dyer and files their Petition to Enter Deficiency Judgment against Steve
Wiser only, as follows:
1. On or about February 16, 1995, Plaintiff filed an action in Replevin, seeking
the return of a certain mobile home more fully described as follows: 1994 Redman
manufactured home, Serial No. 12225593.
2. Defendant Steve Wiser was served with the Complaint, although service
on Defendant Robin Wiser was returned "not found."
3. Defendants subsequently abandoned or otherwise voluntarily removed
themselves from the said mobile home.
4. On or about April 25, 1995, Plaintiff repossessed said mobile home from
Defendants.
WHEREFORE, Plaintiff demands judgment in the amount of $5,433.88, pius costs
and interest.
5. On or about August 24, 1995, Plaintiff resold the said mobile home by
private sale, for the amount of $34,500.00, which Plaintiff believes and therefore avers
is the fair market value of said mobile home. A copy of the loss report whereby Plaintiff
resold the said mobile home is attached hereto and incorporated herein as Exhibit "I".
6. As a result of the repossession and resale of the said mobile home, Plaintiff
incurred certain reasonable expenses which are recoverable pursuant to the original
contract between Plaintiff and Defendant. Said expenses were reasonable and
necessary for the recovery of said mobile home and are set forth in Exhibit I, which is
attached hereto and incorporated herein by reference. The expenses associated with
the repossession of the mobile home totalled $2,661.50 while the costs associated with
this resale amounted to $3,450.00.
7. Plaintiff moves this Honorable Court to enter a judgment in its favor in the
amount of $5,433.88, which constitutes the difference between the amount owed by
Defendant pursuant to the original contract plus the expenses associated with the
repossession and sale of said mobile home less the amount received in the resale of
said mobile home (minus expenses). The calculations used to determine the amount
of the deficiency judgment are set forth in Exhibit I, which is attached hereto and
incorporated herein by reference.

4. Plaintiff served a copy of the Petition, with the Rule to Show Cause
completed by the Court to Defendant Steve Wiser on February 14, 1996, by regular and
certified mail.
5. On February 20, 1996, Plaintiff filed a Certificate of Service attesting
to service of the petition on Mr. Wiser on February 14, 1996.
6. Mr. Wiser received the certified mail copy ofthe Petition on February
16, 1996, as evidenced by the U.S. Postal Service return receipt, a copy of which is
attached hereto and incorporated herein by reference.
7. At the time of filing of this application, more than twenty (20) days
have passed since service of the Petition. Defendant Steve Wiser has not filed an
answer or other response to Plaintiffs petition.
8. Pursuant to the Rules of Court of the Ninth Judicial District,
Cumberland County Pennsylvania, Local Rule No. 208-2, if no answer is filed and proof
of service is submitted, upon application to the Court, a final decree may be entered.
