Irwin, III, Esquire, and presents this petition for the return of various weapons as enumerated below, representing as follows: 1. Petitioner is Sean Smith, defendant in this previous protection from abuse action, who is an adult individual having a mailing address in care of his mother, Carol Harris, 11 Sunset Circle, Mechanicsburg, Cumberland County, Pennsylvania 17055. 2. On or about February 22, 1995, this Court entered a protection from abuse order against petitioner, said order to be in effect for one year. 3. Said order of Court provided, inter alia, that the Sheriff of Cumberland County was directed to take possession of various weapons of the defendant, your petitioner herein, as follows: a H & R Shotgun, a .357 magnum pistol, a .32 caliber Walther pistol and a .22 caliber Marlin rifle. The order also provided that during the term of the order, defendant/petitioner was prohibited from acquiring or possessing any other weapons for the duration of the order. .! : 4. The Sheriff did in fact take possession of said weapons. 5. During the term of the order, your petitioner refrained from any violations of the order entered by this Court, including, but not limited to contact with the plaintiff, possessing or acquiring weapons and all other provisions therein. 6. The aforesaid protection from abuse order tenninated by operation of law on or about February 22, 1996. 7. Your petitioner is desirous of retaking possession of the weapons that were taken by the Sheriff pursuant to the order of Court as petitioner is a hunter and because the .32 caliber Walther is a family keepsake which is inoperable, but has been handed down through three generations of his family. 8. Your petitioner is not a threat to society in general or plaintiff in particular, is gainfully employed on a full-time basis and is engaged to be married during the Summer of 1996. WHEREFORE, petitioner requests your Honorable Court direct the Cumberland County Sheriff to release to petitioner his H & R Shotgun, .357 magnum pistol, .32 caliber Walther pistol and .22 caliber Marlin rille as aforesaid. The defendant, SEAN SMITH, SSN: 187-54-6406 and OOB: 11/6/66 now residing at 6280 Carlisle Pike, Lot 408, Mechanicsburg, Cumberland County, Pennsylvania, is hereby enjoined from physically abusing the plaintiff, TRACY MILLER, or placing her in fear of abuse. The defendant is ordered to stay away from the plaintiff's residence located at 9 N. Locust Point Road, Mechanicsburg, Cumberland County, Pennsylvania, a residence which is owned by the plaintiff's mother. The defendant is ordered to refrain from having any direct or indirect contact with the plaintiff including, but not limited to, telephone and written communications. The defendant is enjoined from harassing and stalking the plaintiff and from harassing the plaintiff's relatives. The defendant is enjoined from entering the plaintiff's place of employment. The defendant is enjoined from removing, damaging, destroying or selling any property owned jointly by the parties or owned solely by the plaintiff. The defendant is the father of the plaintiff's child. 4. Since approximately 1993, the defendant has attempted to cause and has intentionally, knowingly, or recklessly caused bodily injury to the plaintiff, placed the plaintiff in reasonable fear of imminent serious bodily injury, and has knowingly engaged in a course of conduct or repeatedly committed acts toward the plaintiff which have placed the plaintiff in reasonable fear of bodily injury. Thia has included, but is not limited to, the following specific instances of abuse: a. In or around January 1995, as the plaintiff held her five month old child, the defendant became angry, c~me up behind the plaintiff, grabbed her neck and chin, and twisted them, causing the plaintiff pain as well as endangering the child's welfare. The defendant then left the room, returned with a 357 magnum, held the gun to the plaintiff's head and that of her five month old and threatened to kill them. The defendant said, "I won't be happy until you're in your graves." The defendant then grabbed the baby from the plaintiff, grabbed the back of the plaintiff's jacket, and threw her out the door. The plaintiff telephoned the police who assisted her in retrieving the baby. b. In or around December 1994, the defendant grabbed the plaintiff by her hair and pUlled her about the house, causing the plaintiff to fall to the gound. The defendant then threatened the plaintiff saying that if she didn't clean the trailer the way he wanted, he would beat her. c. In or around August, 1994, the defendant picked the plaintiff up and threw the plaintiff off of the porch, causing the plaintiff to suffer lacerations and bleeding to her knee, elbow, and foot. d. On approximately a daily basis, the defendant abuses the plaintiff in ways including, but not limited to, the following: grabbing her by the hair, pushing, slapping, and grabbing hold of the plaintiff. The defendant also has a dog which he beats on the head with a billy club, kicks, punches, throws around, and has also shot with a BB gun. 6. In or around January, 1995, the plaintiff and her child left their residence at 6280 Carlisle Pike, Lot 408, Mechanicsburg, Cumberland County, Pennsylvania, in order to avoid further abuse. 7. The plaintiff believes and therefore avers that she is in immediate and present danger of abuse from the defendant and that she is in need of protection from such abuse. 8. The plaintiff desires that the defendant be prohibited from having any direct or indirect contact with the plaintiff including, but not limited to, telephone and written communications. 9. The plaintiff has no knowledge of any custody proceedings concerning this child pending before a court in this or any other jurisdiction. 17. The plaintiff does not know of any person not a party to this action who has physical custody of the child or claims to have custody or visitation rights with respect to the child. 18. The best interests and permanent welfare of the minor child will be met if custody is temporarily granted to the plaintiff pending a hearing in this matter for reasons including: a. The plaintiff is a fit parent who can best take care of the minor child. b. The defendant has shown by his abuse of the plaintiff that he is not an appropriate role model for the minor child. c.
