PETITION FOR RETURN OF WEAPONS
NOW come Sean Smith, by his aUorney, Harold S. Irwin, III, Esquire, and presents this
petition for the return of various weapons as enumerated below, representing as follows:
1. Petitioner is Sean Smith, defendant in this previous protection from abuse action,
who is an adult individual having a mailing address in care of his mother, Carol Harris, 11 Sunset
Circle, Mechanicsburg, Cumberland County, Pennsylvania 17055.
2. On or about February 22, 1995, this Court entered a protection from abuse order
against petitioner, said order to be in effect for one year.
3. Said order of Court provided, inter alia, that the Sheriff of Cumberland County
was directed to take possession of various weapons of the defendant, your petitioner herein, as
follows: a H & R Shotgun, a .357 magnum pistol, a .32 caliber Walther pistol and a .22 caliber
Marlin rifle. The order also provided that during the term of the order, defendant/petitioner was
prohibited from acquiring or possessing any other weapons for the duration of the order.

4. The Sheriff did in fact take possession of said weapons.
5. During the term of the order, your petitioner refrained from any violations of the
order entered by this Court, including, but not limited to contact with the plaintiff, possessing or
acquiring weapons and all other provisions therein.
6. The aforesaid protection from abuse order tenninated by operation of law on or
about February 22, 1996.
7. Your petitioner is desirous of retaking possession of the weapons that were taken
by the Sheriff pursuant to the order of Court as petitioner is a hunter and because the .32 caliber
Walther is a family keepsake which is inoperable, but has been handed down through three
generations of his family.
8. Your petitioner is not a threat to society in general or plaintiff in particular, is
gainfully employed on a full-time basis and is engaged to be married during the Summer of 1996.
WHEREFORE, petitioner requests your Honorable Court direct the Cumberland County
Sheriff to release to petitioner his H & R Shotgun, .357 magnum pistol, .32 caliber Walther pistol
and .22 caliber Marlin rille as aforesaid.

AND NOW, this ,~" day of April, 1995, this Court certifies
that the attached complaint has been properly completed and
verified, and there is probable cause for the issuance of
process. In consideration of the attached Commonwealth's
Petition, a WARRANT IS ISSUED FOR THB ARRBST of the Defendant,
SEAN SMITH. The Sheriff shall re-seize the two (2) rifles
previously seized in this case.
If the defendant is found during normal Courthouse hours,
the defendant is to be brought immediately before the Court. If
not found during Courthouse hours, the defendant is to be taken
to the on-call District Justice and bail set pursuant to the
Rules of Criminal Procedure. Furthermore, after appearing before
the District Justice the defendant is advised to appear before
the Court Administrator at the open of the next business day.
Defendant has a right to be represented by an attorney. If
the defendant cannot afford an attorney, upon request one will be
assigned to represent the defendant. The assessment of costs to

1. Defendant, Sean Smith, is enjoined and prohibited
from physicallY abusing Tracy Miller and Brittney Smith or
placing them in fear of abuse.

from being at or entering into the separate residence of Tracy
Miller at 9 North Locust Point Road, Mechanicsburg, or any other
residence in which she may reside,
3. Defendant is enJoined and prohibited from having
any direct or indirect contact with Tracy Miller to include, but
not limited to, any telephone or written communications.
4. Tracy Miller may return to 6280 Carlisle Pike, lot
408. Mechanicsbur9, where she hod been living with Sean Smith,
and in the company of 0 sheriff of Cumberland County remove from

5. Tracy Miller is awarded temporary physical custody
of Brittney Smith, born September 3, 1994. If Sean Smith seeks

custody, he shall file an action in the office of the
Prothonotary.
6. Until further order of court, the Sheriff of
Cumberland County shall retain possession of all weapons seized
from Sean Smith pursuant to a temporary order entered on
February 16. 1995. Sean Smith is prohibited from or acquiring
or possessing any weapons for the duration of this order.
7. Plaintiff's counsel is awarded $100.00 in
attorney's fees from Sean Smith to be paid not later than 30
days from this date.
8. All provisions of this order. except the provision

AND NOW, this II/P- day of February, 1995, upon
presentation and consideration of the within Petition, and upon
finding that the plaintiff, TRACY MILLER, now residing at 9 N.
Locust Point Road, Mechanicsburg, Cumberland County,
Pennsylvania, is in immediate and present danger of abuse from
the defendant, SEAN SMITH, the following Temporary Order is
entered.
The defendant, SEAN SMITH, SSN: 187-54-6406 and OOB: 11/6/66
now residing at 6280 Carlisle Pike, Lot 408, Mechanicsburg,
Cumberland County, Pennsylvania, is hereby enjoined from
physically abusing the plaintiff, TRACY MILLER, or placing her in
fear of abuse.
The defendant is ordered to stay away from the plaintiff's
residence located at 9 N. Locust Point Road, Mechanicsburg,
Cumberland County, Pennsylvania, a residence which is owned by
the plaintiff's mother.
The defendant is ordered to refrain from having any direct
or indirect contact with the plaintiff including, but not limited
to, telephone and written communications.
The defendant is enjoined from harassing and stalking the
plaintiff and from harassing the plaintiff's relatives.
The defendant is enjoined from entering the plaintiff's
place of employment.
The defendant is enjoined from removing, damaging,
destroying or selling any property owned jointly by the parties
or owned solely by the plaintiff.
A violation of this order may subjeot the defendant tOI i)
arrest under 23 Pa. c.s. 56113; ii) a private oriminal oomplaint
under 23 Pa. C.S. 56113.1; iii) a oharge of indireot oriminal
oontempt under 23 Pa. C.S. 56114, punishable by imprisonment up
to six months and a fine of $100.00-$1,000.00; and iv) oivil
oontempt under 23 Pa. C.S. 56114.1. Resumption of co-residenoe
on the part of the plaintiff and defendant shall not nullify the
provisions of the oourt order.

Temporary custody of BRITTNEY LYNN SMITH, is hereby awarded
to the plaintiff, TRACY MILLER.
The defendant is ordered to relinquish to the sheriff's
department the following weapons which he owns, possesses, has
used or threatened to use against the plaintiff and the minor
child: 2 shotguns, .357 magnum, BB gun, and an old pistol, and
the defendant is prohibited from acquiring or possessing any
other weapons for the duration of this Order.
This Order shall remain in effect until modified or
terminated by the court after

notice or hearing. A hearing shall

of fees, but service may be accomplished under any applicable

The Silver Springs and Hampden Township Police Departments
will be provided with certified copies of this Order by the

A. ABUSB
1. The plaintiff, TRACY MILLER, is an adult individual
residing at 9 N. Locust Point Road, Mechanicsburg, Cumberland
County, Pennsylvania 17055.
2. The defendant, SEAN SMITH, SSN: 187-54-6406 and DOB:
11/6/66, is an adult individual residing at 6280 Carlisle Pike,
Lot 408, Mechanicsburg, Cumberland county, Pennsylvania, 17055.
3. The defendant is the father of the plaintiff's child.
4. Since approximately 1993, the defendant has attempted to
cause and has intentionally, knowingly, or recklessly caused
bodily injury to the plaintiff, placed the plaintiff in
reasonable fear of imminent serious bodily injury, and has
knowingly engaged in a course of conduct or repeatedly committed
acts toward the plaintiff which have placed the plaintiff in
reasonable fear of bodily injury. Thia has included, but is not
limited to, the following specific instances of abuse:
a. In or around January 1995, as the plaintiff held her
five month old child, the defendant became angry, c~me up
behind the plaintiff, grabbed her neck and chin, and twisted
them, causing the plaintiff pain as well as endangering the
child's welfare. The defendant then left the room, returned
with a 357 magnum, held the gun to the plaintiff's head and
that of her five month old and threatened to kill them. The
defendant said, "I won't be happy until you're in your
graves." The defendant then grabbed the baby from the
plaintiff, grabbed the back of the plaintiff's jacket, and
threw her out the door. The plaintiff telephoned the police
who assisted her in retrieving the baby.
b. In or around December 1994, the defendant grabbed the
plaintiff by her hair and pUlled her about the house,
causing the plaintiff to fall to the gound. The defendant
then threatened the plaintiff saying that if she didn't
clean the trailer the way he wanted, he would beat her.
c. In or around August, 1994, the defendant picked the
plaintiff up and threw the plaintiff off of the porch,
causing the plaintiff to suffer lacerations and bleeding to
her knee, elbow, and foot.
d. On approximately a daily basis, the defendant abuses the
plaintiff in ways including, but not limited to, the
following: grabbing her by the hair, pushing, slapping, and
grabbing hold of the plaintiff. The defendant also has a
dog which he beats on the head with a billy club, kicks,
punches, throws around, and has also shot with a BB gun.
6. In or around January, 1995, the plaintiff and her child
left their residence at 6280 Carlisle Pike, Lot 408,
Mechanicsburg, Cumberland County, Pennsylvania, in order to avoid
further abuse.
7. The plaintiff believes and therefore avers that she is
in immediate and present danger of abuse from the defendant and
that she is in need of protection from such abuse.
8. The plaintiff desires that the defendant be prohibited
from having any direct or indirect contact with the plaintiff
including, but not limited to, telephone and written
communications.
9. The plaintiff desires that the defendant be enjoined
from harassing and stalking the plaintiff, and from harassing the
plaintiff's relatives.
10. The plaintiff desires that the defendant be restrained
from entering her place of employment.
11. The plaintiff desires that the defendant be enjoined
from removing, damaging, destroying or selling any property owned
jointly by the parties or owned solely by the plaintiff.
12. The plaintiff desires that any weapons the defendant
owns, possesses, and has used or threatened to use against the
plaintiff and the minor child be confiscated by the Sheriff's
Department.

The father of the child is SEAN SMITH, currently residing at
6280 Carliele pike, Lot 408, Mechanicsburg, Pennsylvania.
He is single.
The defendant currently lives by himself.
15. The plaintiff has not previously participated in any
litigation concerning custody of the above mentioned child in
this or any other Court.
16. The plaintiff has no knowledge of any custody
proceedings concerning this child pending before a court in this
or any other jurisdiction.
17. The plaintiff does not know of any person not a party
to this action who has physical custody of the child or claims to
have custody or visitation rights with respect to the child.
18. The best interests and permanent welfare of the minor
child will be met if custody is temporarily granted to the
plaintiff pending a hearing in this matter for reasons including:
a. The plaintiff is a fit parent who can best take
care of the minor child.
b. The defendant has shown by his abuse of the
plaintiff that he is not an appropriate role model for
the minor child.
c. The defendant's behavior has adversely affected
the child.
WHEREFORE, pursuant to the provisions of the "Protection
from Abuse Act" of October 7, 1976, 23 P.S. S 6101 n JilG., as
amended, the plaintiff prays this Honorable Court to grant the
following relief:
A. Grant a Temporary Order pursuant to the "Protection from
Abuse Act:"
1. Ordering the defendant to refrain from abusing the
plaintiff or placing her in fear of abuse;
2. Ordering the defendant to refrain from having any
direct or indirect contact with the plaintiff including, but
not limited to, telephone and written communications.

from acquiring or possessing any other weapons for the
duration of the order.
B. Schedule a hearing in accordance with the provisions of
the "Protection from Abuse Act," and, after such hearing, enter
an order to be in effect for a period of one year:
1. Ordering the defendant to refrain from abusing the
plaintiff or placing her in fear of abuse.
2. Ordering the defendant to refrain from having any
direct or indirect contact with the plaintiff including, but
not limited to, telephone and written communications.

AND NOW COMES the Defendant, Sean Smith, by and through his attorney, Robert J. Mulderlg,
Esquire, moves the Court to re-open the hearing on the Protection from Abuse and alleges:
1. On or about February 24, 1995. Defendant was served with a notice of a hearing echeduled
for February 27. 1995.
2. A1J suggested In the paperwork served on him, the Defendant contacted So1\)'8 HInkel, a
paralegal at Lega1 Services.
3. He explained to Ms. Hinkel that he would be unable to attend the hearing on the 27th.
4, Ms. HInkel told the Defendant that that was 'no problem, they could get a continuance.'
5. On February 27, 1995, when the Defendant returned from work, he found the foUowIng
message on his answering machine: 'Mr. Smith, this is Sonya Hinkel from Lega\Servicea. Aner speaking
with our client, we are not agreeing to a continuance and there will be a hearing ~ at 2:30. You should
bring with you Tracy's welfare payatuba, anything like that. We will see you at the hearing. It is your
responsibility to arrange for t1'8ll8portation.'
6. At that time, the Defendant was unrepresented by counsel.
7. Apparently on the 27th at 2:30, an Order was entered against the Defendant by default.
8. Members of the legal profession must be extra IICI'\Ipuloua when dealing with layman.
9. Plalntiff'a counsel lell the impression with Defendant that a continuance was being
granted.
