NOW COMES the plaintiff, John D. Anderson, sr., by his
attorney, John Wesley Weigel III, Esq., to file this complaint and
allege as follows:
l. Plaintiff John D. Anderson, Sr. is an adult individual
residing at 2 W. Oakwood Drive, carlisle, Cumberland county,
Pennsylvania.
2. Defendant Sheetz, Inc. is a corporation trading and doing
business at Store #l95,
located at 6558 Carlisle pike,
Mechanicsburg, Cumberland county, Pennsylvania.
3. On December ." 1994, plaintiff purchased gasoline from
Defendant at Store #195.
4. After Plaintiff left Defendant's premises, Defendant
contacted the police to make a false and defamatory report that
Plaintiff had stolen gasoline from Defendant.
5. Shortly thereafter, police officer Brian Kluck of silver
spring Township, stopped plaintiff and interrogated him about
Defendant's report.
plaintiff was able to avoid arrest only
because he had retained a receipt as proof of purchase.
6. As a result of Defendant's defamatory statement and the
resulting police interrogation, plaintiff suffered personal
humiliation and mental pain and SUffering.

7. Defendant's false and defamatory statement was motivated
by ill-will, knowledge of the statement's falsity, or reckless
disregard for the truth.
WHEREFORE, Plaintiff requests judgement in his favor against
Defendant, compensatory damages of $6,000 and punitive damages.

NOW COMES the Plaintiff, John D. Anderson, Sr., by his
attorney, John Wesley Weigel III, Esq., to file this Amended
Complaint and allege as follows:
1. Plaintiff John D. Anderson, Sr. is an adult individual
residing at 2 W. Oakwood Drive, Carlisle, Cumberland County,
Pennsylvania.
2. Defendant Sheetz, Inc. is a corporation trading and doing
business at Store #195, located at 6558 Carlisle Pike,
Mechanicsburg, Cumberland county, Pennsylvania.
3. On December 7, 1994, Plaintiff purchased gasoline from
Defendant at Store #195.
4. After Plaintiff left Defendant's premises, Defendant
contacted the police to make a false and defamatory report that
Plaintiff had stolen gasoline from Defendant.
5. Shortly thereafter, police officer Brian Kluck of Silver
Spring Township, stopped plaintiff and interrogated him about
Defendant's report.
Plaintiff was able to avoid arrest only

DEFENDANT'S PRELIMINARY OBJECTIONS
TO PLAINTIFF'S AMENDED COMPLAINT
AND NOW COMES Defendant, Sheetz, Inc., by and through ANDREWS AND
WAGNER, 3366 Lynnwood Drive, P. O. Box 1311, Altoona, Pennsylvania 16603-1311,
and preliminarily objects to Plaintiffs Amended Complaint and in support thereof avers
the following:
MOTION TO STRIKE
1. Plaintiff initiated this action by the filing of a Complaint on or about
February 21, 1995 in the Court of Common Pleas of Cumberland County,
Pennsylvania,
2. Thereafter, Defendant filed Preliminary Objections to Plaintiffs Complaint
on March 13, 1995, requesting that Plaintiffs WHEREFORE clause be stricken as
violative of Pennsylvania Rule of Civil Procedure 1021(b).
3. Plaintiff, in response to Defendant's Preliminary Objections, filed an
Amended Complaint on March 21,1995.
4. Plaintiff purports to set forth a cause of action for defamation arising from
events which occurred on December 7, 1994.
5. Plaintiffs Amended Complaint at Paragraph B states that the amount in
controversy does not exceed the jurisdictional amount requiring compulsory arbitration.
6. Thereafter, in Plaintiff's WHEREFORE paragraph, Plaintiff requests
compensatory damages and punitive damages.
7. Cumberland County, pursuant to Local Rule 1303-1., ARBITRATION
RULES, requires cases with an amount in controversy of twenty-five thousand dollars
($25,000.00) or less to be submitted to arbitration.
8. Plaintiff's demand for punitive damages contradicts Paragraph 8 which
states that the amount in controversy in less than $25,000.00., requiring compulsory
arbitration.
WHEREFORE, Defendant Sheetz, Inc. respectfully requests that Plaintiff's
WHEREFORE clause be stricken and Plaintiffs request for punitive damages
dismissed with prejudice so that this matter may be submitted to compulsory arbitration
pursuant to Pennsylvania Rule of Civil Procedure 1021 and Cumberland County Local
Rule 1303 -1.

Defendant, Sheetz, Inc., by and through its counsel, ANDREWS AND WAGNER,

answers Plaintiffs Amended Complaint, as follows:
1. Denied. Defendant is without present information sufficient to form a betief
as to the truth of the averment contained in Paragraph 1 of Plaintiffs Amended Complaint.
, Strict proof of the same Is demanded at the time of trial.
2. Admitted in part. Denied In part. It is admitted that Defendant Sheetz, Inc.
is a corporation with a store located at 6558 Cartisle Pike, Mechanicsburg, Cumberland
County, Pennsylvania. However, it is specifically denied that it is a corporation trading and
doing business at Store #195, located at 6558 Carlisle Pike, Mechanlcsburg, Cumberland
County, Pennsylvania. Strict proof of the same Is demanded at the time of trial.
3. Admitted.
4. Denied. It is specifically denied that Defendant contacted the police to make
a false and defamatory statement that Plaintiff had stolen gasoline from Defendant. To

the contrary, Defendant at all times acted In a reasonable and proper manner based upon
its belief that Plaintiff had failed to pay for gasoline. Strict proof of the same is demanded
at the time of trial.
5. Denied. Defendant Is without present information or knowledge sufficient to
form a belief as to the truth of the averments contained in Paragraph 5 of Plaintiffs
Amended Complaint. Strict proof of the same is demanded at the time of trial.
6, Denied. It Is denied that as a result of Defendant's defamatory statement,
which statement is specifically denied, and the resulling police interrogation, Plaintiff
suffered personal humiliation and mental pain and sUffering. Defendant is without present
Information or knowledge sufficient to form a belief as to the truth of the averment
contained in Paragraph 6 of Plaintiff' Amended Complaint. Strict proof of the same is
demanded at the time of trial.
7. Denied. It is specifically denied that Defendant's statement was motivated
by ill-will, I<nowledge of the statement's falsity, or rer.kless disregard for the truth. To the
contrary, Defendant at all times acted in a reasonable and prudent manner based upon
the information Defendant possessed at the time of the incident. Strict proof of the same
is demanded at the time of trial.
B, Admitted in part. Denied in part. Paragraph 8 of Plaintiffs Amended
Complaint constitutes a legal conclusion to which no responsive pleading Is necessary.
Further, Defendant admits that Plaintiff's claim does not exceed the jurisdictional amount
