Plaintiff files this complaint porsuantto Pa, R.C.P, No. 2951{b) for judgment by
confession and avers the following:
I, The Plaintiff, Advanced Concrete Systems, Inc., is a Pennsylvania
corporation with a mailing address of R,D.#2, Box 147.A. Mlddlcburg, Snyder County,
Pennsylvania,
2, The Defendant, Warner Homcs, Inc., Is a Pennsylvania corporntion with
a last known address of 3811 Claverton Road, Mechnnicsburn. Cumherland County,
Pennsylvania,
3, Allnched hereto as Exhibit "A" is a true and correct copy of the original
instrumcnt authorizing confession duly executed by the Defcndant.
4. The aUachcd instrument has not bccn assigned.
5. Judgment has not been cntcred in any jurisdiction on the allached
instrument authorizing confession,

6. Conlrary to the terms and provisions of the wriuen instrument,
Derendant failed to make the payment of the balance due to Plaintifr which was to be paid at
settlement not 10 exeeed 180 days from February 9, 1994, all of which constitutes a default
under the Instrument, nnd Plnintirr exercises It's option to declare the entire balance or the
instrument immcdiately due nnd payable,
7, Consequently, the Derendant is liable to Plaintiff as follows:
