IN RE: LEVY OBJECTION
A levy was made by a constable on household items pursuant
to a judgement entered against Ray Holloway, All the proceedings
took place in the office of District Justice Glenn R. Farner,
The wife of Ray Holloway, Jo Ann Holloway, filed an objection to
the levy made by the constable. District Justice Farner denied
the objection, Jo Ann Holloway then filed a statement of
objection to this determination, District Justice Rule 1019
provides as follows:

shall be just and proper,
B, The matters raised by the
statement of objection shall be
considered de novo by the court of
common pleas.
NOTE: Consideration of the matters
raised by the statement of
objection will be de novo and the
court is given broad latitude and
discretion in disposing of these
matters.

A hearing was held May 19, 1995, The plaintiff William D.
Forsberg, II appeared, as well as Jo Ann Holloway. Neither party
was represented by counsel,
The parties reached the following agreement:

will pay to Mr. Forsberg the following:
( 1) One cord of wood $80.00
(2) Judgment Cost 57,50
(3) Order of Execution 50,00
TOTAL $187,50
The $187,50 is to be paid within thirty (30) days from
today, Mr. Forsberg shall notify me in writing if the amount is
paid or not paid. If paid, I will enter an order dismissing the
statement of objection. If not paid, I will enter an order
deciding the objection filed by Mrs. Holloway in accordance with
District Justice Rule 1019,

Petition for hearing on levy objection.
At the end of September of 1994, I had ordered tw,) cords of wood from Ray
Holloway. He was to deliver the wood when I was on vacation. He never did
until the day after my vacation was over. I faithfully left a check In the amount of
$165.00 In my door for two cords afwood.
When I came home from work, I found only one cord of wood that was left at my
house. I called on numerous times for about a month and he never denied he
owed me a cord of wood. But, he never took action to rectify this. I had two
neighbors come over and verify that I only received one cord of wood,
I went through the District Justice Office of Glenn R. Farner and a Objection
Denied was made on the defendant, Ray Holloway's wife. I am requesting the
amount of $217.73 for the following items:

MEMORANDUM OPINION AND ORDER OF COURT
In the instant case, Mrs. Jo Ann Holloway, the wife of
defendant, objects to the levy of certain household items,
claiming that because she shares in ownership of the property,
the items remain untouchable for the satisfaction of the judgment
against her husband,
FACTS AND PROCEDURAL HISTORY
On 11/3/94, plaintiff filed a complaint against defendant,
alleging that defendant only delivered one cord of wood when
plaintiff had paid in advance for two cords.' After a hearing
held on 12/01/94, District Justice Glenn Farner entered a
judgment against defendant in the amount of $153,60, On 1/11/95,
District Justice Farner issued an order of execution, directing
the local constable to levy on property of the defendant. After
the defendant was duly notified on 1/28/95 regarding the order of
execution, the constable levied on property to which Mrs.
Holloway claims joint ownership 1 therefore, she filed an
objection on 2/8/95 to all property levied upon,
'Testimony indicates that Mrs, Holloway plays no role in
defendant's business of landscaping, snow removal, and selling of
firewood, Furthermore, Plaintiff dealt only with defendant and
wrote the check to him, and defendant was the only party named in
the action,
NO. 95-0952 CIVIL TERM
After a hearing held on 2/13/95, District Justice Farner
denied the objection. Legal Services, Inc. filed a Statement of
Objection on behalf of Mrs. Holloway on 2/23/95, We granted
plaintiff's petition for a hearing on the levy objection, and the
Court heard testimony on May 19, 1995. At the close of
testimony, the parties made an agreement off the record which the
Court entered as an order on May 25, 1995, The parties agreed
that Mrs, Holloway would pay to plaintiff the sum of $187.50.'
When Mrs, Holloway did not make the payment within thirty days as
agreed upon, plaintiff notified the Court in writing, as he was
directed, and we must now rule upon the objection.
DISCUSSION
We first note that judgment creditors may execute on
entireties property if both spouses are joint debtors; however,
if only one spouse is a debtor, entireties property is immune
from process, petition, levy, execution or sale, Klebach v,
Mellon Bank. N,A" 3B8 Pa, Super. 203, 208, 565 A.2d 448, 450
(1989) (citations omitted),
Keeping in mind the preceding law, we find that the property
levied upon was acquired during the marriage, Although no record
was submitted as to the exact items levied upon, both parties
testified that the property constituted household items, mainly

furniture. The parties have been married for eight years, and
although Mrs. Holloway presented no receipts indicating when the
various household items were purchased, we found credible her
testimony that she and her husband purchased the property
together, and plaintiff made no attempt to rebut this testimony;
thus, it is presumed that the subject property is marital
property. Because the judgment in this case was entered solely
against Mr, Ray Holloway, the levy of the property belonging to
both parties was improper,

finding that Constable Elfren Garcia levied entireties property
of Mrs, Jo Ann Holloway and Ray Holloway in order to satisfy a
judgment entered against Mr, Ray Holloway, the Court hereby
SUSTAINS the objection of Mrs, Jo Ann Holloway to all property
envied upon,
