The defendant failed to report a change in her employment status, as
by paragraph 15 of the lease, and in August, 1994 it was ascertained
that defendant owed $1509.00 in back rent.
~ 7. The defendant admitted to owing the $1509.00 back rent and signed a
written statement agreeing to pay $188.63 extra rent monthly until paid in full.
A copy of said agreement is attached hereto as Exhibit "B".
~~~ B. The defendant has not complied with her promise to pay, and currently
owes the sum of $1159.10.
~() 9. Paragraph 5 of the said lease provides for penalty charges for the
late payment of rent, and further, that Landlord may terminate the Lease Agree-
ment for non-payment of rent.

Drive, any and all past due rent, costs for any damages caused by defendant to
the premises prior to leaving, together with all costs of suit.

COMES NOW the defendant, Ar1ean Porter, by counsel, Philip
C. Briganti, Esquire, Legal Services, Inc., and as her Answer to
Plaintiff's Complaint, states as follows:
1. Admitted.
2. Admitted.

4. Admitted in part and denied in part. Defendant denies
that Plaintiff agreed to rent the apartment to Defendant from
October 13, 1992 through October 31, 1993. Although this period
of time constituted the initial term of the lease, the parties'
Residential Lease Agreement provides that the lease continues for
successive terms of one month thereafter, unless terminated for
grounds set forth in Paragraph 23 of the Agreement. See
Plaintiff's Exhibit "Au. Defendant admits the remaining
averments set forth in Paragraph 4 of Plaintiff's Complaint.
5. Admitted.
6. Admitted in part and denied in part. Defendant admits
that Plaintiff ascertained that she owed $1509.00 in back rent,
but avers that Plaintiff determined this in July 1994 rather than
August 1994. Defendant denies that she failed to report her
employment status, as required by Paragraph 15 of the lease.
7. Admitted. However, Defendant further avers that she did
not sign this statement in August 1994 as set forth therein, but
rather on February 9, 1995. Moreover, Defendant avers that she
only owed $1,359.00 when she si9ned this statement, due to
previous payments she had made.
8. Denied. Defendant denies that she currently owes the
sum of $1159.10, and denies that she has hot complied with her
promise to pay. Defendant avers that she has paid more than
$188.63 per month since she executed the agreement on February 9,
1995. In fact, Defendant avers that she paid $200.00 on February
21, 1995, and $200.00 on March 30, 1995. Her current balance is
$959.10.
9. Adnlitted in part and denied in part. Defendant admits
that Para9raph 5 of the parties' lease provides for penalty
charges for the late payment of rent. However, as set forth
below in Defendant's New Matter, she avers that this portion of
the lease constitutes an unenforceable penalty clause. Moreover,
Defendant admits that Paragraph 5 of the lease provides that the
Landlord may terminate the Lease Agreement for non-payment of
rent, but only after following the procedures set forth in
Paragraph 23 of the lease, and only when the tenant fails to pay
the rent "beyond any grace period available under state law", as
set forth under Paragraph 23(b) therein.
10. Admitted in part and denied in part. Defendant admits
that she has refused to vacate the premises. However, she does
not recall being served with the written notice attached to

Plaintiff's Complaint as Exhibit "C" and therefore denies that it
was served upon her.

compliance with the agreement thereafter.
~ 14. Paragraph 5 of the par.t i es' 1 ease agreement assesses
late fees which exceed Plaintiff's actual or reasonably
anticipated losses occasioned by the late payment of rent, and
therefore constitutes an unenforceable penalty clause.

possession of the apartment in which I reside and alleged back
rent.
