IN THE COURT OF COMMON PLEAS CUMBERLAND COUNTY . LUCIE S. CLARK DEFENDANT CIVIL ACTION NO. 95-970 COMPLAINT 1. The plaintiffs herein are patricia K. Wooten and C. Riley Wooten, adult individuals whose address is 956 Cedars Road, Lewisberry Road, Lewisberry, York County, Pennsylvania 17339. 2. The Defendant herein is Lucie S. Clark, 9 Forge Road, Camp Hill, Cumberland County, Pennsylvania 17011. 3. The Plaintiffs entered into a Written Agreement with the Defendant on December 1, 1989, to Lease a house located at 32 Sussex Road, Camp Hill, Cumberland County, Pennsylvania 1701l. 4. The plaintiffs give the Defendant a security deposit in the amount of five hundred and twenty-five dollars ($525.00). 5. On July 15, 1994, plaintiffs gave the Defendant written notice that they were terminating their tenancy effective September 3, 1994. 6. plaintiffs had also on July 15, 1994, provided the Defendant their new address in which to forward their security deposit, plus interest. 7. On September 13, 1994, plaintiffs sent a notice by First Class u.s. Mail and Certified Mail (unclaimed), to the Defendant, demanding return of the plaintiffs security deposit in the amount of $525.00, plus interest. 8. On November 3, 1994, Plaintiffs sent by First Class, U.S. Mail, a letter to the Defendant, demanding the return of the Plaintiffs security deposit in the amount of $525.00, plus interest. 9. On December l2, 1994, plaintiffs attorney, sent by First Class U.S. Mail, a letter to the Defendant, demanding the return of the Plaintiffs security deposit in the amount of $525.00, plus interest. ~ 10. On January 5, 1995, Plaintiffs attorney, sent by First Class U.S. Mail, a letter to the Defendant, demanding the return of the Plaintiffs security deposit in the amount of $525.00, plus interest. 1l. The Defendant failed to respond to the plaintiffs repeated demands for the return of their security deposit. 12. On January 19, 1995, pursuant to the Landlord and Tenant Act of 1951, P.S. sections 250.101 et seq., the Plaintiffs filed a civil complaint, Docket No.: CV-0000030-95, against the Defendant. 13. Personal service was effectuated on the Defendant by a Pennsylvania state Constable through the Office of District Justice Charles A. Clement, Jr., 1106 Carlisle Road, Camp Hill, Cumberland County, Pennsylvania 17011. 14. On February 6, 1995, the District Court entered Judgment for the Plaintiff, particia K. Wooten against the Defendant Lucie Clark, in the amount of $1,208.55. 15. Thereafter, on February 24, 1995, the Defendant filed with the Court, Notice of Appeal from the District Justice Judgment and a Praecipe to Enter Rule to File Complaint and Rule to File. 16. The Defendant failed to respond to the Plaintiffs' demands for the return of their security deposit. 17. The Defendant has refused to return the $525.00 security deposit to the Plaintiffs. 18. The Plaintiffs due to the Defendant's failure to respond to the demand for return of the security deposit, is entitled to double damages pursuant to the Landlord and Tenant Act, 68 P.S.
