QUIGLEY AND BARBARA A. QUIGLEY, Defendants. COMPLAINT IN CIVIL ACTION AND NOW, comes Plaintiff, PNC National Bank, by its Attorney, Murray A. Felder, Esq., and files this Complaint in Civil Action of which the following is a statement: 1. Plaintiff is PNC National Bank, a national banking association with an office located at 103 Bellevue Parkway, Wilmington, Delaware 19809. 2. Defendants are Richard A. Quigley and Barbara A. Quigley, individuals residing at 1009 Swarthmore Road, New Cumberland, PA 17070-1730. 3. On or about October I, 1990, defendants opened a Mastercard/Visa Account with Plaintiff bearing account number 4081704011017549. 4. Defendants made use of said account and had a balance due and owing to Plaintiff in Lhe amount of $5,455.78. 5. Plaintiff has made repeated demands for payment, but defendants have steadfastly refused to pay the balance due to the Plaintiff. 6. The application and contract for the charge account provided for the addition of reasonable attorney fees if the account was referred to outside counsel and it is alleged that a fee based on 20% of the principal balance due is reasonable. 7. The following amounts are currently due and payable: Principal amount due: $5,455.78 $1,091.15 25.00] Reasonable attorney fees @ 20%: Less payments: Total amount due: $6,521.93 WHEREFORE, Plaintiff demands judgment against defendants, jointly and severally, in the amount of $6,521.93 plus costs and interest. OUIGLEY TO PNC NATIONAL BANK'S COMPLAINT IN LAW AND NOW, comes the Defendants, Richard A. Quigley and Barbara A. Quigley, (hereinafter "Quigleys"), by and through their undersigned counsel, Mirin , Jacobson, and hereby preliminarily object to the complaint of Plaintiff, PNC National Bank and in support thereof, avers as follows: DEMURRER AND MOTION TO STRIKE COMPLAINT IN ITS ENTIRETY 1. The Plaintiff is this matter is PNC National Bank with an office located at 103 Bellevue Parkway, Wilmington, DE 19809. 2. The Defendants are married adult individuals residing at 1009 Swarthmore Road, New Cumberland, PA 17070-1730. 3. The present civil action was commenced in the Court of Common Pleas for Cumberland County Pennsylvania by a complaint filed by the Plaintiffs on or about the 27th day of March 1995. A true and correct copy of the Complaint is attached hereto as Exhibit "A". 4 . The defendants preliminarily object to this complaint because the Plaintiff failed to attach a writing upon which this complaint is based. 5. The Plaintiff's cause of action allegedly arises from . the breach of a valid contract. 6. Pennsylvania Rule of Civil Procedure 1019(h) specifically states as follows I "A pleading shall state specifically whether any claim ... set forth therein is based upon a writing. If so, the pleader shall attach a copy of the writing, or material part thereof." 7. The Plaintiff in this matter has failed to establish whether the contract in question is an oral contract or a written contract. 8. If the contract in question is an oral contract, the defendant is entitled to a more specific pleading pursuant to Pa.R.C.P S1019(h) and pursuant to Pa.R.C.P. S1028(a)(3) for failure to plead with specificity. 9. If the contract in question is a written contract then the Plaintiff is required under Pa.R.C.P. S1019(h) to include a copy of the writing or the material part thereof. Wherefore, the Defendants pray that the Court dismiss this complaint in its entirety or in the alternative, require the Plaintiff to file an amended complaint which is in compliance with the Pennsylvania Rules of civil Procedure 1019(h) and 1028(a)(3).
