COMPLAINT
1. Plaintiff, Charles A. Harvey is an adult individual residing
at 493 State Road, West Fairview, Cumberland County, Pennsylvania,
17025.
2. Defendant Deb Roblyer is an adult individual residing at 634
Geary Street, Harrisburg, Dauphin County, Pennsylvania, 17110.
3. Plaintiff is the owner of a residential property located at
493 State Road, West Fairview, Cumberland County, Pennsylvania, 17025.
4. plaintiff leased to Defendant a second floor apartment located
at 493 State Road, West Fairview, Cumberland county, Pennsylvania, 17025
(hereinafter "Leased Premises"). A copy of the Lease is attached hereto
as Exhibit "A".
5. Pursuant to the lease, Defendant had the obligation to keep
the Leased Premises in as good repair and condition as when the property
was leased and to surrender the leased property in like repair and
condition.
6. The Defendant subsequently vacated the Leased Premises on or
about the period of November 27, 1994 through November 29, 1994.
7. At or prior to the time when the Defendant vacated the Leased
Premises, Defendant damaged the Leased premises and otherwise breached
the Lease by failing to surrender the Leased Premises in sUbstantially
the same condition in which the Leased Premises was leased to Defendant
and that Defendant broke various windows, gorged holes in the walls and
ceilings throughout the apartment, damaged various door knobs, stole
various door knobs, broke roof slate and damaged the downspouts on the
front and side porches.
8. The fair and reasonable costs of repairing and replacing the
broken and missing items described above is $2,164.42, as shown more
particularly by the estimate attached hereto as Exhibit "B".
9. The damages causes to the Leased Premises by Defendant were
much greater in extent than ordinary wear and tear of the Leased
Premises.
10. The damages caused to the Leased Premises by Defendant were
not caused by fire, storm or other casualties.
WHEREFORE, Plaintiff Charles A. Harvey demands judgment against
Defendant Deb Roblyer in the amount of $2,164.42 together with costs and
interest.

TO THE PROTHONOTARY:
Please enter judgment of default in favor of Plaintiff, Charles
Harvey and against Defendant Deb Roblyer for her failure to plead to the
Complaint in this action within the required time.
The Complaint
contains a Notice to Defend within twenty (20) days from the date of
service thereof. Defendant was served with the Complaint on March 6,
1995, and her Answer was due on March 27, 1995.
Attached as Exhibit "A" is a copy of Plaintiff's written Notice of
Intention to File Praecipe for Entry of Default Judgment which I certify
was mailed by Certified Mail to Defendant at her last known address,
which is at least ten (10) days prior to the filing of this Praecipe.
