The contract provided for the Plaintiff to provide labor and material for the drilling of caissons at the Giant Food store No. 28 Project located in Lancaster, Pennsylvania, and on behalf of the Defendant. 5. Under the terms of the contract, Defendant agreed to pay Plaintiff for the performance of the work in the sum of $24,850.00. 6. The Plaintiff performed its obligations under the contract in a good and workmanlike manner, and completed its work in a timely manner. 7. On November 11, 1993, Plaintiff and Defendant executed a Change Order for existing contract No. SCI802-7, providing for the Plaintiff to provide labor and materials for rock excavation and percussion drilled test holes at the Giant Food store No. 28, project located in Lancaster, Pennsylvania, on behalf of Defendants. A true and correct copy of the Change Order is attached hereto, made a part hereof and marked Exhibit "2". 8. In accordance with the terms and provisions of the Change Order, Defendant agreed to pay Plaintiff for the performance of the work the additional sum of $40,351.20. 9. The Plaintiff performed its obligations under the Change Order in a good and workman like manner and completed its work in a timely fashion. 10. The total amount charged for services rendered by Plaintiff on behalf of the Defendant totalled the sum of $65,201.20. 11. The prices charged for the labor and materials were fair and reasonable, and market prices were the same at the time the services were contracted and performed for the Defendant, and, further, are what the Defendant agreed to pay for services rendered by the Plaintiff. 12. To date, Defendant has forwarded a total of $54,865.00 to Plaintiff for services performed by the Plaintiff under the contract. 13. Plaintiff has credited Defendant's account in the amount of $54,865.00 for payments received from the Defendant. 14. There remains due and owing to the Plaintiff the sum of $10,336.00 for services rendered by Plaintiff on behalf of Defendant. A true and correct copy of Plaintiff's invoice showing payments received and credited to Defendant's account and the amount due is attached hereto, made a part hereof and marked Exhibit "3". 15. Plaintiff has demanded payment of $10,366.00 from Defendant, but Defendant has refused and continues to refuse to pay the same or any part thereof. 16. The amount in controversy herein requires mandatory reference to arbitration. VERIFICATION I verify that the foregoing facts are true, upon my personal knowledge or information and belief.
