JURY TRIAL DEMANDED
COMPLAINT
AND NOW, come the Plaintiffs, by their attorneys Mancke,
Wagner, Hershey & Tully, and file the following Complaint:
1. Plaintiffs David K. Huffer and Suanne Huffer, his wife,
are adult individuals residing at 117 East Keller Street,
Mechanicsburg, Cumberland County, Pennsylvania.
2. Defendant Donald L. Hoffler, is an adul t individual
residing at 5208 Oxford Circle, No. 87, Mechanicsburg, Cumberland
County, Pennsylvania.
3. At all times relevant herein, the facts and occurrences
occurred on or about June 27, 1993, at or about 9:00 a.m., on South
Market
Street,
Upper
Allen
Township,
Cumberland
County,
Pennsylvania.
4. At the above-mentioned time and place, the Plaintiff
David Huffer, was operating a 1990 Honda and travelling south on
South Market Street, at the intersection of Gettysburg Pike, Upper
Allen Township.
5. At the aforement ioned time and place, the Defendant
Donald L. Hoffler, was operating a 1992 Chevrolet, travelling north
on South Market Street, Upper Allen Township, Cumberland County,
Pennsylvania.
6. At the aforementioned time and place, the Defendant did
make a left hand turn into the path of the Plaintiffs' vehicle,
violently colliding with the Plaintiffs' vehicle.
7. The Plaint iff Suanne Hu ffer, at all times relevant
herein, was a passenger in the vehicle operated by her husband,
Plaintiff David Huffer.
8. As a result of the aforementioned collision, the
Plaintiff Suanne Huffer, did suffer the following injuries:
a. Trauma to the nervous system;
b. Chondromalacia of the patella;
c. Medial lateral meniscectomy; and
d. Arthritis.
9. As a result of the aforementioned injuries, Plaintiff
Suanne Huffer underwent great pain and suffering and will in the
future undergo great pain and suffering.
10. As a result of the aforementioned injuries, Plaintiff
Suanne Huffer did suffer discomfort and in the future will suffer
discomfort.
11. As a result of the aforement ioned injuries, Plainti ff
Suanne Huffer suffered a loss of life's pleasures and will in the
future suffer a loss of life's pleasures.
12. As a result of the aforementioned injuries, Plaintiff
Suanne Huffer has suffered a permanent injury in that she sustained
post-traumatic arthritis in the knee, which is permanent in nature.
13. As a resuit of the aforementioned injuries, Plaintiff
Suanne Huffer has suffered inconvenience and will in the future
suffer inconvenience.
14. As a result of the aforementioned injuries, Plaintiff

Suanne Huffer will suffer a permanent loss of earning capacity and
will undergo, in the future, medical costs as a result of the post-

traumatic arthritis in the knee.
15. The aforementioned injuries and loss were a direct result
of the Defendant's negligent and careless operation of his motor
vehicle in:
a. Failing to observe Plaintiffs' vehicle;
b. Turning left in front of Plaintiffs' vehicle;
c.
Fai ling to yield the
right of way to the
Plaintiffs' oncoming vehicle;
d. Failing to stop so as to avoid a collision with
Plaintiffs' vehicle; and
e. Colliding with the vehicle of Plaintiffs.
16. As a result of the aforementioned conduct and the
operation of the vehicle by the Defendant, Plaintiffs sustained the
injuries as aforementioned.
WHEREFORE, Plaintiffs pray This Court to grant Judgment in
favor of the Plaintiffs and against the Defendant in an amount in
excess of $20,000.00.

17. As a result of the aforementioned collision, the

Plaintiff David K. Huffer has been deprived of and will continue to
be deprived of the care, companionship, consortium, and society of
his wife, all of which is to his great detriment.
WHEREFORE, Plaintiffs pray This Court to grant judgment in
favor of the Plaintiffs and against the Defendant in an amount in
excess of 520,000.00.

20. To the extent that losses were paid or payable under any
group plan or other arrangement, 51722 of the Motor Vehicle
Financial ReSp?nsibi1ity Law prohibits the Plaintiffs from
recovering said amounts in this action.

Her diagnoses at the time of discharge were left knee complex medial menisca1 tear, left knee
lateral meniSCf&! tear and Grude II chondromalacia of patellar articular surface. These injuries
were treated with the operative arthroscopy, with partial medial and lateral meniscectomies
and chondroplasty of patellar articular surface. She has an excellent result from the surgical
intervention. As well as the patient has done postoperatively, I do not anticipate any further
treatment necessary in the near future. Statistically, the patient is at greater risk for post-
~umatic arthritis in the knee, but no one can say whether she will definitely develop this.
Her prognosis is excellent. :

Our office billings for Suanne's orthopedic care total $3,026.10. The adjusted allowable
amount for reimbursement according to Act VI is $1,104.13. This has been paid in full
yielding a balance of zero dollars and zero cents. In that the patient has an excellent result
from my surgical intervention and is essentially asymptomatic, it is my medical opinion that
no immediate future treatment will be necessary. Therefore, costs of future treatment are
zero.
I believe this answers all your questions and concerns regarding Suanne Huffer's orthopedic

This casc arose out of a motor vchic1c accident that occurred in Junc of 1993.
Mr. Nealon has recently bcen advised that thc dcfendant, Mr. Hofflcr, is schcduled to
work in Tennessee for the three-wcek pcriod commencing January 20, 1997. In addition, counsel
for the defcndant has another casc on thc Cumbcrland County trial list and also a case on the
Dauphin County trial list whcrc cascs will also bc tried during the week of January 27th. Mr.
Wagner indicated that, dcspitc having given thc dcfendant amplc notice of the time of trial, he
was not informed of the defendant's unavailability until rccently. In addition, thc plaintiffs desire
to concludc this mattcr. For these reasons, the plaintiffs' counsel opposcd any continuance of
the matter.
We will grant Mr. Nealon's request and continuc the case until March with thc
understanding that further rcquests for continuance from the defendant will not be entertaincd.

I. J'ACTSa
On or about June 27, 1993, at 9:00 a.m., on Market
Street, Upper Allen Township, Pennsylvania, the Plaintiff, DAVID
K. HUFFER, was operating a motor vehicle with the Plaintiff
SUANNE HUFFER, his wife, a passenger.
The Defendant, DONALD L. HOFFLER, made a lefthand turn
on Market Street directly in the path of Plaintiffs' vehicle
violently colliding with the Plaintiffs' vehicle.
The accident was investigated by Offier Thompson of the
Upper Allen Township Police Department.
Officer Thompson interviewed the Defendant and obtained
a statement from the Defendant that he was traveling north on
South Market Street when he executed a lefthand turn cOlliding
with the vehicle of the Plaintiffs that was traveling south on
Market Street.

witness, Janice Wonders, confirmed the same that the
Defendant failed to yield the right of way and did turn into the
path of the Plaintiffs' vehicle.
II. DAMAGBSa
As a result of the aforementioned accident, the
Plaintiff, SUANNE HUFFER, suffered a chondromalacia of the
patella, medial lateral meniscectomy as well as trauma to the
nervous system, and further, is a likely candidate for the
development of arthritis.
The plaintiffs were extremely active athletically prior
to the accident.
Of particular interest the the Plaintiffs was the sport
of golf in which they participated on a regular basis.
Of course, because of the condromalacia of the patella,
the Plaintiff was unable to golf for a considerable period of
time, and now suffers difficulty in attempting to golf, and has
extreme difficulty in bending and/or flexing.
She was also an avid gardner, boater, hiker, and
jogger, all of which have been extremely limited as a result of
the injury to her knee.
As a result of the aforementioned injuries, SUANNE
HOFFER sought treatment with the cumberland Orthopaedic
Associates, Dr. craig Fultz. Dr. Fultz diagnosed the

condromalacia of the patella, and the meniscal tears as noted
above.
