COMPLAINT
NOW comes the plaintiff, by its attorneys, Harold S. Irwin, Ill, Esquire, and files this
complaint, representing as follows:
1. The plaintiff is Adam Wholesalers of Carlisle, Inc., Pennsylvania corporation with
principal offices located at 1627 Ritner Highway, Carlisle, Cumberland County, Pennsylvania
17013.
2. The defendant J.S. Turner & Son, Inc., is a North Carolina corporation with
principal offices located at West Third Street, Weldon, North Carolina 27890.
3. The defendant G. Vincent Wyche, is an adult individual with a business address at
West Third Street, Weldon, North Carolina 27890.
4. On the dates indicated on the statement of account attached hereto as Exhibit "A"
and incorporated herein by reference, defendants ordered and plaintiff delivered to defendants
various building materials as indicated on the statement.
5. The prices charged for said building materials were the usual and ordinlUy prices
therefor and the prices which defendants agreed to pay.
6. The tenns of sale to which defendants agreed were, and the invoices forwarded to
defendants by the plaintiff provided that, payment was to be made by defendants to plaintiff within
forty-five (45) days and that selVice charges at the rate of2% per month would be charged on the
unpaid balance after forty-five (45) days. A copy of plaintifi's tenns and conditions of sale is
incorporated herein by reference and attached hereto as Exhibit "B".
7. Defendant G. Vincent Wyche personally guaranteed payments for all materials
purchased by defendant 1.S. Turner & Son, Inc. and certified that they were able to pay their
debts when they come due, as shown on the credit application, a copy of which is incorporated
herein by reference and attached hereto as Exhibit "C".
8. The aforementioned personal guarantee also provided that defendants agreed that
any suit to collect unpaid amounts on this account may be brought in the county of domicile of the
plaintiff and defendants also agreed therein to pay all collection costs, attorney fees and court
costs, as reference to Exhibit "c" will show.
9. Defendants have made payments on this account as shown thereon; however,
there remains a balance due of $5,565.69, plus service charges of 2% per month on the unpaid
balance from JanulUy 23, 1995 until the date of full payment.

10. The plaintiff has made numerous requests of the defendants to pay the balance due,
but defendants have refused and neglected to pay the same or any part thereof and continue so to
refuse.
WHEREFORE, plaintiff demands judgment against defendants in the sum of Five
Thousand Five Hundred Sixty-five and 69/100 ($5,565.69) Dollars, plus service charges of 2%
per month on the unpaid principal balance from Ian 23, 1995 until the date of payment, plus
costs and attorney fees,
