The plaintiff, Cindy L. McClucas, by her allomeys, Ihe Family Law Clinic, sets forth
Ihe following cause of action:
I. Plaintiff is Cindy L. McClucas, who currenlly resides at 4110 Enola Road,
Newville, Cumberland County, Pennsylvania 17241, since January 1993.
2. Defendant is Elmer K. McClucas, who currenlly resides at 412 Willow Street,
Highspire, Dauphin Counly, Pennsylvania, PA 17034.
3. Plainliff has been a bona fide resident in the Commonwealth for at least six
months immediately previous to the filing of this Complaint.
4. Plaintiff and defendant were married on June 16, 1993, at Hagerstown,
Maryland.
5. Plainliff and defendant have lived separate and apart since October 25, 1994.
6. There have been no prior actions of divorce or for annulment between the
parties.
7. The marriage is irretrievably broken.
8. Plaintiff has been advised thai counseling is available and that plaintiff may
have Ihe right to requestlhat Ihe court require the parties to participate in counseling.
The mOlher of the children is Cindy McClucas, currently residing at 4110 Enola Road,
Newville, PA 1724l.
She is married.
The father of the children is Elmer Keith McClucas, currenlly residing at 412 Willow
Street, Highspire. PA 17034.
He is married.
11. The relationship of plainliff 10 the children is that of mother. The plaintiff currently
resides with Ihe following persons:

the children in this Commonwealth in conneclion wilh a Proteclion From Abuse Order in this
county .
Plaintiff has no infonnalion of a custody proceeding concerning the children pending in
a court of this Commonwealth.
Plaintiff does not know of a person not a party to the proceedings who has physical
custody of the children or claims to have cuslody or visilation rights wilh respect to the children.
(t) Plainliff has received primary physical cuslOdy of ihe children as a result of
a Protection From Abuse Order of October 25, 1994.
15. Each parent whose parenlal righls 10 the children have not been tenninated and
ihe person who has physical cuslody of Ihe children have been named as parties to ihis action.
WHEREFORE, plaintiff requesls the court to granl her custody of ihe children, subject
to visitation as ihe parties may agree 10 in the future, and such oiher relief as ihe court deems
just.
14. The best interest and pennanent welfare of the children will be served by granting
ihe relief requesled because:
(a) Plaintiff has been primary caretaker of the children since birth;
(b) Plainliff provides the children with a home wiih adequale moral, emotional
and physical surroundings as required 10 meellhe children's needs;

2. A Conciliation Conference was held December 20,2001 wilh the
following individuals in auendance: The Father, Elmer K. McClucas, wilh his counsel,
Marylou Matas, Esquire, and Ihe MOlher, Cindy L. McClucas, with her counsel. David
Lopez, Esquire, from MidPenn Legal Services.
3. The Court previously enlered an Order daled July 31, 1995, that provided
for MOlher to have sole legal and primary physical custody oflhe children, wilh Falher
having al1ernating weekend visils from Friday at 8:00 p.m. 10 Salurday at 5:00 p.m.
4. In April, 1998 MOlher volunlarily gave Falher primary physical custody
of Ihe children via a notarized stalement. MOlher conlinued to have periodic visitation
with Ihe children until September. 2001. On Seplember 7, 200 I, Mother picked up the
children for a visit and refused 10 relum them. She enrolled Ihem in a difTerenl school.
Since that time Falher has only had minimal contact with the children.
5. Falher's position on custody is as follows: Falher seeks shared legal and
primary physical custody of the children. Father maintains Ihat he has a close relationship
with the children. thai he has cared and nurtured the children for Ihe more Ihan Ihree
years Ihat he had primary physical cuslody of them. The children were doing well in
school prior to MOlher removing them from Futher's cure und custody. Futher's wife hus
begun counseling 10 uddress uny of mOlhcr's concerns.

14. Since Apri11998, Respondent has praised Petitioner and his wife for their outstanding
care of the children several times, both orally and through writings.
IS. In Apri12oo1, Petitioner accepted a vehicle from Respondent in lieu of monetary child
support payments, with the understanding and agreement that Petitioner would file a
Complaint for Support and Respondent would be wage attached in November 200 1.
16. During the interim months between April and September, Respondent angrily informed
Petitioner that he would not collect child support through wage attachment.
17. Respondent picked up the children on September 7, 2001 for a visit and has since
refused to return the children to Petitioner's primary care.
18. Respondent made an allegation that Petitioner's wife abused the parties' older child,
Tyler, but there are no criminal charges pending against Petitioner's wife and
Petitioner's wife has been advised by Cumberland County Children & Youth Services
that the allegation is unfounded.
19. Respondent refused contact between Petitioner and the children since September 7,
2001.
20. Only after Petitioner informed Respondent that he intended to institute formal custody
proceedings did Respondent offer to abide by the prior Order.
21. Petitioner chose not to engage in self-help and take the children back to his primary
care, as Respondent did, but rather chose to proceed through the judicial process.
22. Petitioner has learned that the children have not attended school since September 7,
2001 at the Filbert Elementary School in Mechanicsburg where they have attended
since April 1998.

children greatly improved. In addition, Father made certain that the children were examined by
the family doctor regularly and received all appropriale medications.
During the time pcriod Ihal Falher had primary cuslody, MOlher visited sporadically.
Prior to the summcr of200l, MOlher had no overnighl visitation wilh the children. Often times,
Mother would call the children to schedule a visitation and then nol appcar. Furthermore,
Mother was not involvcd in Ihe children's cducation or with Ihcir mcdical care. MOlher's living
condition, social situation and employmcnl situation were unstable allhat time, and continue to
be today. During the time that Father had cuslody of the children, Mother wrote letters to Falher
and Falher's current wife expressing her gratitude toward them for laking such wonderful care of
the childrcn.
In approximately April 2001, Falher told MOlher that hc would have to take her to
Domestic Relations for child support ifshe did not bcgin regular paymcnls. In September 2001,
Mother picked up the children for a weekend period of visitation and refused to return them to
Father. Mother alleged thaI Tyler told her Ihal Father's wife punched him in Ihe mouth that day.
MOlher contacted local authorities, who charged Ihe slepmolher with simple assault and
harassment. Children and Youlh Services also iniliated contact with Falher and his family.
Father attempted contact with the children repeatedly, but Mother refused all
communications between Father and the children. Mother immediately pulled Ihe children out
of the school district they had attcndcd for Ihree years and away from Ihe friends they made
Ihere, and cnrollcd them in South Middlelon School District. Father retained counsel and
attempled negotiations for Ihe children's safe return. Mother conlinued 10 refuse all conlact.
Father was not permitted to have contact with Ihe children for approximately three months,
despite continued and ongoing requesls and negotialions. Almosl immediately aller taking Ihe
children, MOlher filed a Complaint for Support against Father.
Father filed a Pelition to Modify Ihe 1995 Order, requesting thallhe Court award him
primary physical custody of Ihe children. A cuslody conciliation conference was held on
December 20, 2001, aller which an Order was enlcred awarding shared physical custody of the
children to both parties on an alternating weekly basis. Allhough this requires Father to drive the
children back and forth to school in Boiling Springs from Mechanicsburg, he does so willingly.
Their continued educalion is importanl 10 him and he believes that allowing them to finish the
school year without annlher change is best allhis lime. At Ihe time of the conciliation, criminal
charges were still pending againsl the stepmother. Those charges were wholly dismissed al a
dislrict justice hearing in January 2002, aller Ihe child, Tyler, testified that his stepmolher never
hit him. Cumberland County Childrcn and Youlh Services discontinued their investigation.
Father does not believe that this shared arrangemenl is in the best interests of the
children. Their schoolwork has suffered tremendously since beginning school in September in
Mother's care. Both children are receiving failing gmdes for this school year, aller excelling in
Mechanicsburg School District. In addition, Father has received many reports from the school
Ihat the children are not lurning in Iheir homework assignments aller spending weekends with
Mother. Additionally, MOlher has made false claims of criminal activily against Tyler. She
auempted to involve Ihe school in Ihis claim, further inlerrupling their educalion.
Moreover, Father does not believe Ihat MOlher's currcnt living arrangement is suitable
for the children. Mother lives in a two-bedroom apartment above a restaumnt. Until
approximately one week ago, MOlher lived in Ihal residence wilh Ihe two children al issue and
wilh her sister's two minor children. Falher understands Ihat !he other two minor children were
removed from Mother's home.
Falher does not believe that the currenl situalion is best for the children's medical care
and health, in general. Mother refuses to take the children to Ihe family doclor !hey saw for
more than three years, causing a disruplion in Tyler's receipt of prescribed medicines. Father,
however, continues to lake the children 10 see thaI doctor during his periods of custody, when
needed. That doctor believes Ihat Tashia is suffering from anxiety, which is interfering with her
school performance. Father agrees.
Father believes Mother's actions arc pulling a great deal of slress and anxiety on Ihe
children. Their health and schoolwork are obviously suffering. In addition, MOlher has taken
them from the stable environment they have enjoyed for many years. Father has two young
children with his currenl wife, with whom Ihe children al issue enjoy a close emotional
attachment. Mother's refusal to allow the children to relum to that environment has interrupted
and affecled their sibling relationship, as well.
Father believes thaI Tyler has told MOlher on more than one occasion that he wants to go
home, but that Mother refuses. Father is eager to have Ihe children relurned to his primary
custody. He would encourage a relationship between the children and Mother, as he has always
done. He would prefer, however, Ihat Mother maintain a consistent visitation schedule,
something she did not do in the past.
Based on all oflhe above, Defendanl submits thaI il is in Ihe children's best interests to
be relurned to his primary care immediately, with alternating weekend and possible evening
custodial periods of time awarded 10 Plaintiff.
B, Witnesses
Elmer K. McClucas: Mr. McClucas will teslify to the circumstances surrounding the
children's behavior and school performance while in his primary care, including Iheir
relalionship with their siblings. He willteslify 10 the children's adaptation to their
move to Boiling Springs school district and their performance and behavior since
being removed from his primary care. Mr. McClucas will testify to his position thaI
an Order selling oul specific lime periods for MOlher's periods of cuslody should be
entered, due to MOlher's past failure 10 maintain consistenl visitation.
Jennifer McClucas: Mrs. McClucas is Father's current wife. She will testify regarding her
relationship wilh the children. Mrs. McClucas will testify to the various and recent
allegations Mother has made regarding Mrs. McClucas's discipline of the children,
Kelly Greer: Ms. Greer is a close family friend 10 Ihe McClucas family. She will testify to
her observalions of the relationship between Father, stepmother and the children
while in Father's primary care. She further will lestify to her observations and
conversations with Ihe children since they have been removed from Father's primary
care.
Debbie Anthony: Ms. Anlhony is a close family friend and neighbor to Ihe McClucas
family. She will lestify to her observations of Ihe relationship between Father,

1. Hlstorv and Issues:
Cindy McClucas is the mother ofTyler James McClucas, born July 5,1991, and Tashia
Marie McClucas, born July 16, 1992. On July 31, 1995, the Cumberland County Court of
Common Picas entered a Cuslody and Visilalion Agreement thaI gmnted primary physical
custody and sole legal custody of the two minor children to Cindy McClucas and partial custody
to Ihe father, Elmer K. McClucas. On April 29, 1998, both parties signed a notarized statement,
which temporarily tmnsferred cuslody of the children from Ihe mother to the father. On
Seplember 7, 2001, Ihe mother picked up Ihe children for a regularly scheduled visit. The
mOlher nOliced Ihal Tyler had red marks on his upper lip. When Ihe weekend visil ended, the
mother conlacted the falher and he agreed to lellhe molher keep Ihe children for an exlm day.
After the father became upset, he lold Ihe molher to come getlhe personal belongings of the
children and to keep Ihe kids. When the mOlher arrived 10 pick-up Ihe belongings, she found the
windows were broken on Ihe Ford Bronco, which contained Ihe personal belongings of the
children. The father later admitted to Ihe Mechanicsburg Police Department that he had broken
the windows on Ihe car, causing Ihe molher concern because of his erratic behavior,

have shared legal custody of Tyler James McClucas, born July 5,1991 and Tashia Marie
McClucas, born July 16, 1992. Each parent shall have an equal right, to be exercised
jointly with the other parent, to make all major non-emergency decisions affecting the
children's general well-being including, but not limited to, all decisions regarding their
health, education and religion.
4. The Father and Mother shall have shared physical custody on a week
on/week off basis, Saturday at 9:00 a.m. to Saturday at 9:00 a,m. Father's week shall
begin December 22,2001.
S. The Christmas holiday shall be divided in two Blocks. Block A shall run
from Christmas Eve at 12:00 noon to Christmas Day at 12:00 noon. Block B shall be
from Christmas Day at 12:00 noon 10 December 26 at 12:00 noon. Mother shall have
Block A in 2001.

6, Father shall be responsible for transporting the children to school during
his period of custody. Olherwise, the parties shall share transportation such that the
receiving party shall provide transportation unless otherwise agreed.
7. The non-custodial parenl shall have liberal telephone contact with the
children at reasonable times and duration.
8. Neither party shall do anything or say anything nor let anyone else do
anything or say anything that may estrange the children from the other party, or injure the
opinion of the children as to the other party, or may hamper the free and natural
development of the children's love or affection for the other party.
9. Both parties are prohibited from discussing the pending harassment
charge with the children.
10. Father shall insure thaI slepmother continues with her current counseling.

IN ACCORDANCE WITH CUMBERLAND COUNTY RULE OF CIVIL
PROCEDURE 1915.3-8, the undersigned Cuslody Conciliator submits the following
report:
1. The pertinent informalion concerning the Children who are the subjects of
this litigation is as follows:

2. A Conciliation Conference was held December 20,2001 with the
following individuals in attendance: The Father, Elmer K. McClucas, with his counsel,
Marylou Matas, Esquire, and the Mother, Cindy L. McClucas, with her counsel, David
Lopez, Esquire, from MidPeM Legal Services.
3. The Court previously enlered an Order dated July 31, 1995, that provided
for Mother to have sole legal and primary physical custody of the children, with Father
having alternating weekend visits from Friday at 8:00 p,m. to Saturday at S:OO p.m.
4. In April, 1998 Mother voluntarily gave Father primary physical custody
of the children via a notarized statement. Mother continued to have periodic visitation
with the children until September, 2001. On September 7, 2001, Mother picked up the
children for a visit and refused to relum them. She enrolled them in a different school.
Since that time Father has only had minimal contact with the children.
5. Father's position on custody is as follows: Falher seeks shared legal and
primary physical custody oflhe children. Falher maintains that he has a close relationship
wilh the children, that he has cared and nurtured the children for the more than three
years Ihat he had primary physical cuslody of them. The children were doing well in
school prior to Mother removing them from Father's care and custody. Father's wife has
begun counseling to address any of mother's concerns.
6. Mother's position on cuslody is as follows: Mother maintains that Father's
wife inappropriately disciplines the children. Harassment charges are pending against
slepmother for hitting one of the children. Other instances of mistreatment of the
children were detailed by Mother, including having the children eat off of the floor and
hanging a sign on one of the children explaining her hair. Mother maintains that
stepmother has threalened suicide in front of the children.
7. The Concilialor recommends an Order in the form as attached scheduling
a Hearing and granting the parents shared legal and physical custody, on a week on/week
off basis. It is expecled that the Hearing will require one-half day.

in the later part of 1995 and did not tell the father where she was. He did not then see
the children until the spring of 1998, At that time. the mother took a job as an over-the-
road truck driver. She asked the father to take care of the children, and on April 29,
1998, the parents entered a written agreement:
I Cindy L. McClucas Herman, give E. Keith McClucas primary physical
custody of Tyler James McClucas & Tashia Marie McClucas for at least one
year. Under the following conditions. We must consider the children's best
interest. I will have unlimited visitation under mutal (sic) agreement of both
parties, Children will be permitted to see family members as mutualy (sic)
agreed upon. I will give Keith my '87 Chevy Conversion Van & $500 in payment
of child support for 14 mths. Keith agrees not to request any child support until
at least JUly 1999. Bolh parties agree that Keith will claim Tyler on 1998 taxes.
And Cindy will claim Tashia for taxes 1998. These agreements are to be in the
best interest of the kids & are subject to change due to that reason.
The children were attending kindergarten in the Susquenita School District in
Perry County when they started living with the father,2 The father kept them in that
district for the remainder of that school year. He enrolled them in the Mechanicsburg
School District in the fall of 1998. The children attended first, second, and third grade in
Mechanicsburg. They did fairly well in school. In the second grade, Tyler was placed in
a special education program because of difficulty with written language. He is
diagnosed with ADD, for which he is prescribed Ritalin, The mother was having periods
of temporary physical custody when she returned from work trips. She testified that
these periods were generally for several days every other week, although there were
times that she missed. She kept in regular telephone contact with her children. The

punched him In order to get his mother's attention "because she never paid any
attention to me so I said that so that maybe she would pay attention more to me
because she was only paying attention to my sister."
When the mother moved the children to the South Middleton School District,
shortly after they had begun the fourth grade, the Mechanlcsburg School District was
already in the process of taking Tyler out of special education. After Tyler was in the
South Middleton School District for two weeks, he was moved out of special education,
but was still monitored. Both children did fairly well in the first marking period, but not
as well In the second marking period, One of the problems has been a lack of
preparation of homework. Tyler has failed remedial reading, and the school district
wants to do some additional testing, The mother has consented, but the father has not.
He testified that he has not agreed to new testing because he is already aware of the
language difficulties that Tyler has. The children are now seeing a counselor twice a
month, The maturity of Tyler and Tashia is consistent with their young ages. Tyler said
he wants to live with his father because he doesn't like some things that his mother Is
saying about him. Tashia said she wanted to live with her mother, but she did not know
why,
A custody order must be In the best interest of the children, and Is to be
premised upon consideration of all factors that legitimately affect the children's physical,
intellectual, moral and spiritual well-being. Alfred v. Braxton. 442 Pa. Superior 381
(1995), It is apparent that Tyler and Tashia were doing well in the father's stable

household, His wife treated these children Just like her own.- We do not believe that
she struck Tyler In the mouth. The mother's precipitous removal of the children from
the father's home, and from their two brothers, was not warranted. Nor was the mother
warranted in then keeping the children from the father,
The mother also removed Tyler and Tashla from contact with their father for a
little over two years starting in the later part of 1995. When it suited her purpose, she
then had Tyler and Tashia live with the father and his wife starting in the spring of 1998.
She later acknowledged that the children were doing very well with them, The
mother's conduct in September 2001, resulted in a change of schools where the
children have not been doing as well as they had been. The disruption In their lives has
adversely affected them. The temporary shared custody arrangement is not working
well, The father has a stable home in which the children are established. We are
satisfied the children should live there. The mother Is in a more stable situation than
she was previously, and it is Important that the children have contact with her.
Therefore, we will award her substantial periods of temporary physical custody.
Because the end of the school year is not that far away, the children shall stay enrolled
in the South Middleton School District until the end of the year. The father shall also
consent to such testing of Tyler as the school district wishes. Further clarifying Tyler's
status can only help him in the long run.
For the foregoing reasons, the following order is entered:
- She has sought some counseling regarding appropriate discipline,

ORDER OF COURT
AND NOW, this ~
day of March, 2002, It Is ordered:
1. All prior custody orders are vacated and replaced with this order,
2. Elmer K, McClucas and Cindy L. McClucas shall have shared legal custody of
Tyler McClucas, born July 5, 1991, and Tashia McClucas, born July 16, 1992.
3. The father shall have primary physical custody of Tyler and Tashla.
4. The mother shall have temporary physical custody of Tyler and Tashla:
(a) during the school year:
(i) every other weekend from Friday after school until Monday at
the beginning of school. If Monday Is a school holiday, this period shall
extend to Tuesday at the start of school.
(ii) on the Monday following the weekend that she does not have
the children, from after school until Tuesday at the start of school.
(b) during the summer school recess, every two weeks out of three.
(c) each December 26th through January 1st.
5. The parents shall share Thanksgiving and Christmas. ,
