COMPLAINT IN CIVIL ACTION
AND NOW,
comes Plaintiff, PNC National Bank, by its
Attorney,Murray A. Felder, Esq., and files this Complaint in
Civil Action of which the following is a statement:
1. Plaintiff is PNC National Bank, a national banking
association with an office located at 103 Bellevue Parkway,
Wilmington, Delaware 19809.
2. Defendants are BENJAMIN J PARISER AND ISHWOREE M PARISER
individuals residing at 625 W OLD YORK RD., CARLISLE PA 17013
and 37 W. Ridge Street, Carlisle, PA 17013, respectively.
3. On or about November 21, 1989, defendants opened a
Mastercard/Visa Account with Plaintiff bearing account number
4081704011008126.
4. Defendants made use of said account and have a balance
due and owing to Plaintiff in the amount $4,490.38.
.
5. Plaintiff has made repeated demands for payment, but
defendants have steadfastly refused to pay the balance due to
the Plaintiff.
6. The application and contract for the charge account
provided for the addition of reasonable attorney fees if the
account is referred for collection to outside counsel and it is
alleged that attorney fees based on 20% of the principal balance
due is reasonable.
7. The following amounts are currently due and payable:
Principal amount due:
$4,490.38
Reasonable Attorney fees of 20%:
$ 898.08
Total amount due:
$5,388.46

1. MOTION FOR A MORE SPECIFIC PLEADING.
In paragraph number four (4) of said Complaint, reference is
made to user of said account and a particular balance owing
to the Plaintiff in the amount of $4,490.38. There is no
specificity as to what items were purchased, by whom they were
purchased, when they were purchased, and so on and so forth.
In order to properly defend herself, Ishworee Pariser, who is
now engaged in a bitter divorce with her husband, requires and
requests this specificity in order to adequately defend herself.

opened by Defendant with a Credit Card application; this
application was attached to the complaint. Plaintiff does not have
to establish its claim in the pleadings, but merely allege the

comes Plaintiff, PNC National Bank, by its
Attorney, Murray A. Felder, Esq. and files this Motion for
Judgment on the Pleadings for the following reasons:
1. Suit was filed in the above case on or about February
27, 1995 against Defendants for collection of the balance due on
a Mastercard/Visa Account.
2. Defendant Benjamin pariser began paying Plaintiff $100
per month on or about March 15, 1995 through Plaintiff's
attorney.
3. Subesquently, both defendants refused further payments
and filed an answer denying the allegations in the Complaint, but
offering no facts to constitute a defense to the action.

4. Defendant, Benjamin Pariser, indicates in his Answer
that Plaintiff has rejected all efforts to work out a payment
arrangement.
5. Said allega~ion does not constitute a defense to this
action.
6. As neither defendant has raised any facts sufficient to
constitute a defense, the Answers are general denials entitling
. Plaintiff to Judgment on the Pleadings as a matter of law in the
amount of $5,288.46, the amount claimed in the Complaint less the
$100.00 paid on March 15, 1995.

MEMORANDUM OF LAW
Rule 1034 of the Pennsylvania Rules of Civil Procedure
provides thut, "after the pleadings are closed but within such time
as not to delay trial, any party may move for judgment on the
pleadings."
A motion for jUdgment on the pleadings should be alleged by a
party when a decision must be made on a controlling question of
law.
In this case, Benjamin J. Pariser admits to opening and using
the credit card account.
In Ishworee M. pariser' s Answer, she
generally denies opening and using the Credit Card account without
substantiating her averment.
Thus, in accordance wi th those
matters specified by Rule 1032(2), a motion for judgment on the
pleadings is proper since the Defendants have failed to state a
legal defense to the claim alleged.

Additionally, under Rule 1029 of the Pennsylvania Rules of
Civil Procedure, averments in a pleading to which a responsive
pleading is required are deemed admitted when not denied
specifically.
Since Benjamin J. pariser has admi tted to owing the debt,
Defendant has failed to raise any facts that constitute a defense.
Further since Ishworee M. pariser has failed to substantiate her
averments she too has failed to raise any facts that constitute a
defense.
Therefore, the Movant is entitled to judgment on
pleadings pursuant to Rules 1029, 1032(2) and 1034 of the
Pennsylvania Rules of Civil Procedure.

M~ORANDUM OF LAW
In addlllon lo lhe general rules of applicability, the
Pennaylvanld Rules of Civil Procedure contain speCific rules
governing depoBillons by nral examination.
Rule 4007.1 stales that a party desiring to take the
depoBltion of another person upon oral examination shall give
roasonable notice, in writing, containing the time and place of
taking the deposi tion and the name and address of each person to be
examined if known, to every other party to the action. A party
noticed to be deposed is required to appear without subpoena.
The Explanatory Notes to Rule 4007.1 state that notice is
sufficient to support the subsequent sanction procedures provided
under Rule 4019 for failure to appear.
Pursuant to Rule 4019(a)(I)(iv), entitled Sanctions, the court
may, upon a motion, order the party, who after notice under Rule
4007.1 fails to appear for a deposition, to be examined. Section
(c) of Rule 4019, lists the orders that a court may make upon the
deponent for the failure to appear for a deposition. Among this
list of orders, the court may issue such an order as is just to
facilitate discovery.
Subsection (g)(l) of Rule 4019, provides that the next step in
compelling compliance of a deponent who fails to submit to a
diacovery request after notice, ia to file a motion with the Court
to compel compliance.

NOW comes Benjamin J. Parlser, by and through his attorneys, FLOWER, MORGENTHAL,
FLOWER & LINDSAY, P.C., and answers the Motion to Compel Deposition as follows:
1. Admitted that Benjamin J. Pariser was served with a Notice of Deposition on June
21, 1995.
2. Admitted that Benjamin J. Parlser failed to attend the deposition on August 16, 1995.
By way of further answer, Defendant Benjamin J. Pariser was unable to attend the deposition at
the time and place stated and so notified the Plaintiff who refused to reschedule.
3. Plaintiff seeks to take the deposition of Benjamin J. Pariser at the office of Its attorney,
at 2 Logan Square, Suite 1520, Philadelphia, Pennsylvania 19103. The location of the office, some
2 1h hours from Defendant Benjamin J. Pariser's residence and place of employment places an
undue burden on Defendant Benjamin J. Pariser.
4. On or about October 2. 1995, Plaintiff filed a Motion for Judgment on the Pleadings.
Said Motion was filed approximately two weeks before the filing of the Motion to Compel Discovery

which is before the Court. A copy of the Motion for Judgment on the Pleadings is attached hereto
as Exhibit "A".
5. The Motion for Judgment on the Plec:dings is presently before the Court and

is successful, there will be no need for a deposition. If the Motion Is unsuccessful, Plaintiff can
arrange to take Defendant Berjamin J. Pariser's deposition at that time.
WHEREFORE, Defendant Benjamin J. Pariser prays this Honorable Court to deny the

1. DENIED. Ishworee M. pariser was not served with a :Iotice
of Deposition on June 21, 1995.

3. Plaintiff seeks to take the deposition of Ishworee M.
pariser at the office of its attorney, at 2 Logan Square, Suite
1520, Philadelphia, Pennsylvania. The travel distance to
Plaintiff I s office from the Defendant I s residence is in excess
of 100 miles.
4. Defendant Ishworee M. Pariser is currently undergoing
the treatment for medical prOblems. Defendant Ishworee M. Pariser
does not have the income to go to Philadelphia with her attorney
as her only source of income is Alimony pendente lite from
her husband at this time. The deposition of her in Philadelphia
would cause an undue medical hardship as well as financial
hardship on her.
5. On or about october 2, 1995, Plaintiff filed a Motion
for Judgment on the Pleadings. The Hotion for Judgment on the
Pleadings is presently before the Court and undecided.
6. The Hotion for Judgment on the Pleadings is scheduled
for the Argument Court on December 6, 1995. Plaintiff can
arrange to take Defendant Ishworce M. pariser I s deposition at
that time.
WHEREFORE, Defendant Ishworee M. Pariser respectfully prays
