County, Pennsylvania, hereinafter "WISNER", and MALCOLM D. WERTZ, of 1013 West Trlndle
Road, Apt. No, 3, Mechanlcsburg, Cumberland County, Pennsylvania, hereinafter "WERTZ',
WITNESSETH:
WHEREAS, a Complaint for Divorce has been filed In the Court of Common Pleas of
Cumberland County, Pennsylvania, to No. 95-1089, Civil Term on March 2, 1995; and
WHEREAS, the parties hereto are desirous of settling fully and finally their respective
financial and property rights and obligations as between each other, Including, without limitation,
the settling of all matters between them relating to the ownership of real and personal property,
and In general, the settling of any and all claims and possible claims against the other or against
their respective estates,
NOW, THEREFORE, In consideration of these considerations, and the mutual promises and
undertakings hereinafter set forth, and for other good and valuable consideration, receipt and

sufficiency of which Is hereby acknowledged by each of the parties hereto, WERTZ and WISNER,
each Intending to be legally bound, hereby covenant and agree as follows:
1. Advice of Counsel: The parties hereto acknowledge that each has been notified
of his or her right to consult with counsel of his or her choice, and have been provided a copy of
this agreement with which to consult with counsel, WISNER Is represented by Carol J. Undsay,
Esquire, and WERTZ Is represented by Usa Coyne, Esquire. Each party acknowledges and
accepts that this agreement Is, In the circumstances, fair and oquitable, and that It Is being entered
Into freely and voluntarily, after having received such adl/ice and with such knowledge as each has
sought from counsel, and that execution of this agreement Is not the result of any duress or undue
influence, and that It Is not the result of any improper or illegal agreement or agreements,
2, Divorce: The parties agree to the entry of a Decree In Divorce. The parties will
execute, on the date of this agreement, Affidavits of Consent under Section 3301 (c) of the Divorce
Code, consenting to the entry of a Decree In Divorce, On the day of this Agreement WISNER will
withdraw her Answer asserting that the parties were not married.
3. Personal Property: The parties acknowledge that they have equitably and
satisfactorily divided all of their personal property, and that all personal property shall be the sole
and Individual property of the party In whose possession It is as of the date of this agreement.
WISNER will retain a portable C D Player, WERTZ will retain a camper, speakers, tape player,
receiver and turn-table. These Items are currently In WISNER's possession, but will be transferred
to WERn.: within ten (10) days of the date of this Agreement. The parties shall execute any
documents required In order to vest title to each In the property retained, WERTZ relinquishes any
claim which he might have on the pension, retirement or other employment benefits for WISNER
Which shall be her sole and separate property.

4. Real Property: The parties are owners of a home at 205 Willow Mill Park Road.
Mechanlcsburg, Curnberland County, Pennsylvania, Within sixty (60) days of the date of this
Agreement, WISNER shall refinance the home so WERTZ Is no longer liable for the mortgage
thereon. At the same time, WERTZ will provide to WISNER a special warranty deed transferring
to her all his right, title and Interest in said home, Within sixty (60) days of the date of this

6, Marital Debt: The parties have, in their own names, certain credit card accounts
which may Include some rnarital debt. Each party will be responsible for the debt on the credit
card accounts In his or her name, Each party will Incur no debt for which the other may be liable,
and will Indemnify and hold the other harmless for any debt so Incurred.
7, Modification: No modification, rescission, or amendment of this agreement shall
be effective unless in writing signed by each of the parties hereto.
8, Applicable Law: All acts contemplated by this agreement shall be construed and
enforced under the laws of the Commonwealth of Pennsylvania,
9, Agreement Binding on Parties and Heirs: This agreement, except as otherwise

expressly provided herein, shall bind the parties hereto, and their respective heirs, executors,
administrators, legal representatives, assigns and successors in any interest of the parties.

10, Agreement Not to be Merged: This agreement shall be Incorporated Into the final
decree of divorce of the parties hereto for purposes of enforcement only, but otherwise shall not
be merged Into said decree, The parties shall have the right to enforce this agreement under the
Divorce Code of 1980, as amended, and In addition, shall retain any remedies In law or In equity
under this agreement as an Independent contract. Such remedies in law or equity are specifically
not waived or released.
11. Documents: The parties hereto agree that they will execute and deliver one to the
other any documents necessary to give effect to the terms of this Agreement.
12, Full and Final Settlement: WISNER and WERTZ each do hereby mutually remise,
release, quitclaim and forever discharge the other and the estate of such other, for all time to
come, and for all purposes whatsoever, of and from any and all rights, tilles, interests or claims
in or against the property (Including income and gain frorn property hereafter accruing, of the
other) or against the estate of such other, of whatever nature and wheresoever situate, which she
or he now has or at any time hereafter may have against such other, the estate of such other or
any part thereof, whether arising out of any former acts, contracts, engagements or liabilities of
such other, or by way of dower or curtesy, or claims In the nature of dower or curtesy, or widows'
or widowers' rights, family exemption or similar allowance, or under the Intestate laws, or the right
to take against the spouse's will; or the right to treat a lifetime conveyance by the other as
testamentary, or all other rights of a surviving spouse to participate In a deceased spouse's estate,
whether arising under the laws of Pennsylvania, any other State, or any other Country, or any
rights which either spouse may have, or at any time hereafter have, for past, present or future
support or maintenance, alimony, alimony pendente liIe, counsel fees, costs or expenses, whether

arising as a result of the marital relation or otherwise, except and only except, all right~! and
agreements and obligations of whatsoever nature arising or which may arise under this Agreement
or before the breach of any thereof. It is the Intention of WERTZ and WISNER to give to each
other by the execution of this Agreement a full, complete and general release with respect to any
and all property of any kind or nature, real, personal or mixed, which the other now owns or may
hereafter acquire, except and only except, all rights and agreements and obligations of
whatsoever nature arising or which may arise under this Agreement, or for the breach of any
thereof, subject, however, to the Implementation and satisfaction of the condition precedent as
set forth herein above,
13, BREACH: In the event that either party breaches any prOVision of this Agreement;
he or she shall be responsible for any and all costs Incurred to enforce the Agreement, Including,
but not limited to, court costs and counsel fees of the other party, In the event of breach, the
other party shall have the right, at his or her election, to sue for damages for such breach or to
seek such other and additional remedies as rnay be available to him or her,

COMPLAINT UNDER SECTION 3301(0) OF THE DIVORCE CODE
1, Plaintiff is Maloolm 0, Wertz, who ourrently
resides at 1013 W. Trindle Road, Apartment No, 3,
Mechaniosburg, Cumberland County, Pennsylvania.
2, Defendant is Kelly L. Wisner, who ourrently
resides at 205 Willow Mill Park Road, Meohaniosburg,
Cumberland County, Pennsylvania.
3, Plaintiff and Defendant have been bona fide
residents in this Commonwealth for at least six (6) months
immediately previous to the filing of this Complaint.
4. Plaintiff and Defendant entered a oommon law
marriage in Summer of 1986 in Meohaniosburs, Cumberland
County, Pennsylvania, and separated in November, 1994.
5. There have been no prior aotions for divoroe or
for annulment between the parties.
Count I - No Fault

I. FACTS
The parties to this action became acquainted In 1984 and dated for a year, They moved
Into an apartment together In Dauphin, Pennsylvania In June of 1985, In 1986 they purchased a
house together as Joint tenants with right of survivorship and entered Into a mortgage as "single
persons," They continued to live together during a deteriorating relationship which ended In 1994
when Plaintiff left the parties' home. In his Complaint, Plaintiff contends that the parties'
relationship was a common law marriage which commenced In the summer of 1986, Defendant
denies the existence of a common law marriage.
II. ISSUE
Whether the parties entered Into a common law marriage In the summer of 1986.

IN RE: PRETRIAL CONFERENCE
A pretrial conference was held in the chambers of
Judge Oler in the above-captioned matter on Wednesday, August
23, 1995. Present on behalf of the Plaintiff was Lisa Marie
coyne, Esquire. Present on behalf of the Defendant was Carol J.
Lindsay, Esquire.
This is a divorce action, but the issue to be
resolved in the next proceeding before the Court is whether the
parties have a common-law marriage. To that end, both counsel
have agreed that the proceeding to be scheduled by the Court
will be considered to be under Section 3306 of the Divorce Code
(Proceedings To Determine Marital Status). In the event that
the Court determines that the parties are married, the case will
then proceed in the normal course of a divorce. In the event
that the Court determines that there is no common-law marriage,
the complaint will be dismissed.
Plaintiff has filed a Motion To Strike Case from
Trial List, but pursuant to an agreement of counsel, and because
the matter cannot be heard by the Court because of its calendar
prior to December 1995, the motion will be deemed moot by a
separate Order of Court.
By separate Order of Court, the deolaratory
judgment proceeding provided for in Section 3306 of the Divorce
Code will be scheduled for Wpdnesday, December 13, 1995,

PRE-TRIAL MEMORANDUM
I. FACTS
After living together as boyfriend and girlfriend, the
parties entered into a common law marriage once Plaintiff's
divorce became final. The parties purchased and exchanged wedding
bands and resided together as husband and wife and raised together
Justin Wisner, a child from Defendant's prior relationship. The
parties resided together, exclusively cohabitated and conducted
themselves as husband and wife, held themselves out in the
community as husband and wife, and among other things, filed tax
returns as married, applied for insurance as husband and wife, and
applied for credit as husband and wife. In November 1994 after
the Plaintiff won custody of his only child from a prior marriage,
the Defendant asked Plaintiff and his minor daughter, Autumn
Wertz, to vacate the marital residence and Defendant asked
Plaintiff to take the necessary steps to formally end the marriage
by filing for divorce. When reconciliation proved futile, the
Plaintiff, at Defendant's behest, commenced this divorce action.
Subsequent to service of the divorce complaint, Defendant now
asserts that the parties are not husband and wife.
II. ISSUE
Whether the parties are common law husband and wife.
III. WITNESSES
Discovery is incomplete at this writing and as outlined in
Plaintiff's Motion to Strike which was filed on August 18, 1995.
Per Plaintiff's answer to Defendant's Interrogatories, Plaintiff
will call one or more of the following witnesses (reserving the
right to call other witnesses and produce additional documents
with adequate notice to Defendant):

PLAINTIFF'S MOTION TO STRIKE CASB FROM TRIAL LIST
AND NOW comes the Plaintiff, Malcolm D, Wertz, by and
through his attorney, Lisa Marie Coyne, Esquire, and moves
to strike this case frcm the current trial list as discovery
is not conoluded and avers in support thereof the following;
1. On March 2, 1995, Plaintiff filed his Complaint
For Divorce under Section 3301(c) of the Divorce Code
together with a claim for equitable distribution,
2, On March 21, 1995, Defendant filed a Petition to
Dismiss the Divorce Complaint and JUdge Hoffer issued a Rule
upon the Plaintiff.
This Petition was subsequentlY
withdrawn by Defendant and the Rule became moot.
3, On May 3, 1995, Defendant filed her Answer to the
Complaint and, without notice to Plaintiff's counsel, listed
the case for trial,
4, On June 13, 1995, Call of the Civil List was held
by this Court at which time Plaintiff objected to the case
being listed for trial as discovery had not commenced nor
conoluded beoause the parties were attempting to negotiate a
settlement. Accordingly, the Court issued a continuance.
(Exhibit "A")
5, On June 13. 1995. Plaintiff filed a Motion for
Leave of Court to allow discovery when Defendant's counsel
indioated she would objeot to discovery, On June 16, 1995,
this court issued a Rule upon the Defendant to show oause
why the discovery relief should be be granted, (Exhibi t
"8")
6, On or about June 26, 1995, Defendant answered the
Rule. (Exhibit "C")
7. On July 3, 1995, this Honorable Court heard
argument on the said Motion and granted Plaintiff's motion;
however, the Court limited discovery to the issue of common-
law marriage, (Exhibit "0")
8, On July 3. 1995, Plaintiff propounded upon
Defendant his Revised First Set of Interrogatories which
were due to be answered and served upon Plaintiff's counsel
no later than August 7. 1995. (Exhibit "E")

9. Plaintiff did not receive the said Answers nor did
Defendant request an extension within to complete the
Answers.
10, On or about August 10. 1995. the undersigned
oalled Attorney Lindsay'g office regarding the status of the
Answer and was only then informed that Attorney Lindsay was
out of the office and on vacation and was not due back to
work until August 14, 1995,
11, On Ausust 14. 1995. the undersisned contacted
At torney Lindsay's off ice and left a message for a return
telephone call.
12, On August 15. 1995. Call of the Civil List was
held by this Court at which time Plaintiff objected to the
listing of the Case since discovery was not completed and
was, indeed, outstanding,
13, At the subsequent conference in Judge Sheely's
chambers following the Call of the List, Attorney Lindsay
indicated that. the "Answers were ready" and waiting in her
office, Based on that assurance. Plaintiff's oounsel agreed
to part iall y wi thdraw her object ion. however. the
undersigned informed the Court that follow on discovery may
be neoessary given the Answers from the Defendant,

Again, Attorney Lindsay indicated that, "the

15, On August 16, 1995, Plaintiff's counsel received
no discovery material from Defendant.
16. On August 17, 1995, Plaintiff's counsel received
copies of various documentsl however, she reoeived no
Answers to the Interrogatories, (Exhibit "F"l
17. On August 17, 1995, Attorney Lindsay contacted
Plaintiff's attcrney's office and informed her that the
"Interrogatories were just about done and she can mail them
and that she would agree to have Pretrial Memorandum due
Monday rather than Friday, August 8, 1995,"
18. To date, Plaintiff has not received Answers to
Interrogatories frcm Defendant and Plaintiff is not in a
position to prepare a Pretrial Memorandum without the
benefit of fully developed discovery.

19, With the unauthorized delays,
Defendant
has

attempted to thwart Plaintiff's development of this oase for
trial.
20, Defendant, in listing this oase as ready for trial
on May 3, 1995, misrepresented the status of the oase to
this Court,
21, Looal Rule of Court No, 213-2 provides that,
"oounsel for all parties shall indioate that discovery has
been oompleted, that all pretrial aotions have been taken,
and that the case is ready for trial in all respects. Any
case not ready for trial in all respeots ahall, at the
option of the Court, be placed at the foot of the list or be
stricken troA it."
WHEREFORE, Plaintiff respectfullY requests that this
case be stricken from the trial list and that the Pretrial
Conference soheduled for August 23, 1995 be generally
concluded until discovery in this oase is concluded,
