COMPLAINT
AND NOW, come Plaintiffs, Steven R. Williams and Lynda A.
Williams, by and through their attorneys, wix, Wenger & Weidner
and file this Complaint, and state the following in support
hereof:
FACTS RELATED TO ALL COUNTS
1. Plaintiffs, steven R. Williams and Lynda A. Williams,
husband and wife, are adult individuals who currently reside
at 4154 Nantucket Drive, Mechanicsburg, Cumberland County,
Pennsylvania 17055.
2. Defendant, Triple Crown Corporation, is a Pennsylvania
corporation with a registered address located at 5351 Jaycee
Avenue, Harrisburg, Pennsylvania 17112.
3. This Court has jurisdiction over this matter because the
transactions and occurrences giving rise to Plaintiffs'
cause of action arose in Cumberland County, and because the
real estate which is the subject of this action is located
in Cumberland County.
4. The amount in controversy does not exceed Twenty-Five
Thousand Dollars ($25,000.00) as required by the Cumberland
County rules regarding compulsory arbitration.

5. On August 30, 1993, Plaintiffs purchased real estate and a
newly constructed townhouse thereon from Alp.x and Donna
Disanto located at 4154 Nantucket Drive, Mechanicsburg,
pennsylvania 17055 (the "Premises").
6. The premises was completely developed and constructed by
Defendant and/or its agents and subcontractors.
7. During the afternoon of August 30, 1993, prior to closing,
Plaintiffs conducted a pre-closing inspection of the
Premises with Defendant's job supervisor, Bob Derendinger
("Derendinger") .
8. At the time of the pre-closing inspection, the brick steps
leading up to the front door of the Premises ("brick steps")
appeared to be in good condition, structurally and
aesthetically.
9. For several days after Plaintiffs purchased and moved into
the Premises, Plaintiffs, as well as employees and
subcontractors of Defendant, walked up and down the brick
steps to gain access to the Premises.
10. Approximately one week after Plaintiffs purchased and moved
into the Premises, the brick steps began to break apart, and
the mortar holding the brick steps together began to crack
and separate from the bricks throughout the brick steps.
11. Approximately one to two weeks after Plaintiffs moved into
the Premises, Plaintiffs were advised by Derendinger that
the brick steps had been constructed during the morning
hours of August 30, 1993, the day of settlement, and that

the brick steps were not allowed sufficient time to cure.
At no time either before August 30, 1993 or thereafter, were
Plaintiffs advised or instructed not to walk on the brick
steps.
12. On several occasions within the first several weeks
Plaintiffs resided in the Premises, Defendant, or its
employees or subcontractors attempted to fix several loose
bricks by re-adjoining them with mortar.
13. At no time did Defendant attempt to rectify the condition of
the cracked and separated mortar between the bricks.
14. During the attempts to fix the brick steps, Defendant, its
employees or subcontractors, smeared mortar allover the
brick steps and allowed an excessive amount of mortar to dry
and remain between the bricks.
15. As of the date of this complaint, the brick steps are broken
and cracked and appear old, weathered, and sloppy due to the
smeared and excess mortar.
16. Immediately after the attempts to fix the brick steps,
Plaintiffs expressed their dissatisfaction with the results.
17. Over the course of the next six to eight weeks Derendinger
repeatedly acknowledged the unsatisfactory condition of the
brick steps and assured Plaintiffs that the brick steps
would be completely disassembled and reconstructed and that
a temporary ramp would be placed over the brick steps to
enable access to the premises while allowing the brick steps
to properly cure. This was never done.

lB. On or about October 25, 1993, Plaintiffs were advised by
Derendinger that Defendant did not intend to do anything
with regard to the brick steps.
19. Several days after this, Plaintiffs were advised that
Defendant would "clean" the smeared mortar off of the brick
steps.
20. Despite repeated demands by Plaintiffs, Defendant has
neither disassembled and reconstructed the brick steps nor
cleaned the smeared and excess mortar off of, and in
between, the bricks.
21. At the time of Plaintiffs' pre-closing inspection, the door
surround trim which was to be installed around the front
entrance of the Premises (the "door surround") was missing.
22. Plaintiffs were assured that the door surround would be
installed as soon as all of the other townhouse units within
the neighborhood were completed.
23. on or about October 22, 1993, Defendant, its employees or
subcontractors, partially installed a door surround onto the
premises. The door surround which was partially installed,
however, was not the style for which Plaintiffs had
contracted.
24. Upon inspection of the portion completed by Defendant, its
employees or subcontracts, Plaintiffs discovered several
hammer holes, unfilled screw-set holes, dirt and filth on
the door surround.

25. Defendant, its employees or subcontractors did not complete
the installation of the door surround; that is, the inside
trim pieces which abut the door jam and cover the exposed
brick and steel header beam surrounding the front door were
not, and to this day, have not been, installed.
26. Plaintiffs' demands to Defendant that the door surround be
replaced and installed properly and completely, and with the
correct style, have been ignored by Defendant.
27. As a result of Defendant's failure and/or refusal to
accommodate Plaintiffs' demands, Plaintiffs have contracted
with a third party to clean, repoint, and otherwise repair
the brick steps and to replace and install properly and
completely the door surround at an anticipated cost to
Plaintiffs of $ 681.50.
28. In so contracting with said third party, Plaintiffs will
incur costs associated with the third party's work which
Plaintiffs would not be required to incur if Defendant would
have performed the work.
29. In pursuit of their remedies, Plaintiffs filed a complaint
in the office of District Justice Glenn Farner on December
15, 1994 (herein, the "DJ Action"), which resulted in a
jUdgment in favor of Plaintiffs. Plaintiffs incurred costs
in the DJ Action in the amount of $ 56.00, which are
recoverable herein against Defendant. On March 2, 1995,
Defendant appealed said judgment.

30. For the reasons set forth below, Plaintiffs are entitled to
recover from Defendant, inter alia, all costs incurred by
Plaintiffs in securing the corr.pletion of the work set forth
herein.
COUNT I - BREACH OF WARRANTY
31. Paragraphs 1 through 30 are incorporated herein by reference
as if fully set forth.
32. In connection with Plaintiffs' purchase of the Premises,
Defendant provided to Plaintiffs a Triple Crown Corporation
Warranty standards pamphlet (the "Warranty").
33. Defendant's Warranty provided, inter alia, that Defendant
would construct Plaintiffs' new home "in accordance with
acceptable industry practices, which assure the home buyer
quality workmanship and materials." A true and correct copy
of the pertinent section of Defendant's Warranty is attached
hereto as Exhibit A and incorporated herein by reference.
Defendant has readily available to it the complete text of
the Warranty, and thus, Plaintiffs are not required to
attach the entire pamphlet.
34. The brick steps contain many cracked and/or broken bricks,
are covered with smeared and excess mortar, and contain
mortar joints which are excessive, cracked, broken and
uneven.
35. The condition of the brick steps does not conform to
acceptable industry standards, and does not constitute
quality workmanship and materials.

36. The condition of the brick steps does not conform to
Defendant's Warranty, and Defendant is in breach of its
Warranty with respect to the brick steps.
37. Defendant has breached its own Warranty, and has failed
and/or refused to repair the brick steps, despite demand.
38. The condition of the portion of the door surround which was
installed, and Defendant's failure to complete the
installation of the door surround do not conform to
acceptable industry standards, and do not constitute quality
workmanship or materials.
39. The incomplete and defective condition of the door surround
does not conform to Defendant's Warranty, and Defendant is
in breach of its Warranty with respect to the door surround.
40. Defendant has breached its own Warranty and has failed
and/or refused to replace and install completely the door
surround, despite demand.
41. Plaintiffs are entitled to recover from Defendant the amount
of $ 681.50, which amount Plaintiffs have to expend to have
the brick steps repaired and the door surround replaced and
properly and completely installed.
WHEREFORE, Plaintiffs respectfully request that this
Honorable Court award judgment in their favor and against
Defendant in the amount of $ 681.50, which amount shall
adequately and fairly compensates Plaintiffa for Defendant's
breach of its own Warranty, plus all costs, including the costs

COUNT XI - VIOLATION OP UNFAIR TRADE PRACTICES
AND CONSUMER PROTECTION LAW
42. Paragraphs 1 through 41 are incorporated herein by reference
as if fully set forth.
43. The brick steps and door surround were not constructed and
installed, respectively, in a good workmanlike manner or
using quality materials.
44. Despite Defendant's knowledge to the ~ontrary, Defendant has
repeatedly represented that the brick steps and door
surround were constructed and installed, respectively, in a
good workmanlike manner using quality materials.
45. Defendant knew that these representations were false.
46. Defendant made these false representations with the intent
that Plaintiffs would rely upon them.
47. Plaintiffs did rely upon Defendant's false representations
to their detriment.
48. Defendant's conduct in this regard constitutes a violation
of the Unfair Trade Practices and Consumer Protection Law,
73 P.S. SS201-1 et seq. ("UTPCPL"), in that Defendant has
wilfully and knowingly falsely represented that the brick
steps and door surround were constructed and installed using
quality workmanship and materials. 73 P.S. S201-2(v,vii,
and xiv).

49. Plaintiffs are entitled to recover their actual damages
against Defendant for Defendant's violation of the UTPCPL.
50. Plaintiffs are entitled to treble damages pursuant to
Section 201-9.2 of the UTPCPL.
51. In the prosecution of this action, Plaintiffs have incurred
reasonable attorneys' fees in the approximate amount of
$ 1,779.00 as of the date of this Complaint which Plaintiffs
are entitled to recover from Defendant pursuant to the
UTPCPL because of Defendant's continual and willful
violations of the UTPCPL as set forth herein. In addition,
in the further prosecution of this case, Plaintiffs will
incur additional attorneys' fees, which are likewise
recoverable.
WHEREFORE, Plaintiffs respectfully request that this
Honorable Court grant judgment in their favor and against
Defendant and award actual damages in the amount of $ 681.50,
treble damages, attorneys' fees in the amount of $ 1,779.00,
additional attorneys' fees incurred after the date of this
Complaint, all costs of this action, including costs incurred in
the OJ Action, interest and such other relief as this.Court deems
just and appropriate.
COUNT 111- BREACH OF CONTRACT
52. Paragraphs 1 through 52 are incorporated herein by reference
as if fully set forth.

53. Upon executing the agreement of sale to purchase the
Premises, Plaintiffs chose, among other things, the style of
the door surround. The door surround chosen by Plaintiffs
was the style installed on the townhouse unit known as 4132
Nantucket Drive. A true and correct copy of the agreement
of sale and Addendum "B"-Custom Horne Worksheet is attached
hereto as Exhibit B, and is incorporated herein by reference
as if fully set forth.
54. On August 30, 1993, while doing a walk-through inspection of
the Premises, Plaintiffs informed Defendant of a change in
their choice of style of the door surround to that which is
installed on the townhouse unit known as 4215 Nantucket
Drive.
55. Defendant accepted Plaintiffs' change and assured Plaintiffs
that the door surround of their choice would be installed.
A true and correct copy of Defendant's Buyer's Checklist,
which evidences Defendant's acceptance of this change, is
attached hereto as Exhibit C, and is incorporated herein by
reference as if fully set forth.
56. The acceptance by Defendant of the change indicated in
Paragraphs 51 and 52 hereof constituted a modification to
the Custom Horne Worksheet, which modification is enforceable
against Defendant.
57. Defendant's failure to install the proper door surround on
the Premises constituted a breach of the agreement of sale

and its addenda as amended by the modification to the Custom
Home Worksheet.
58. As a direct result of Defendant's breach, Plaintiffs have
been damaged in that they did not receive the product for
which they contracted.
59. As a direct result of Defendant's breach, Plaintiffs have
incurred costs to replace the door surround which they would
not have had to incur if Defendant had not breached the
agreement.
60. Plaintiffs are entitled to recover from Defendant the amount
which Plaintiffs will incur to have installed the proper
door surround, which amount is $ 387.50.
WHEREFORE, Plaintiffs respectfully request that this
Honorable Court enter judgment in their favor and against
Defendant and award damages in the amount of $ 387.50, plus
interest, all costs of this action, including the costs incurred
in the OJ Action and such other relief as this Court deems just
and appropriate.
