COMPLAINT
The Plaintiff, Kevin M. Davis, by his attorneys, KNUPP & KODAK, P.C., brings
this action of Assumpsit against the Defendant Nizarali M. Moosa Individually and
trading as M&S Grocers and formerly trading as M&S Sweets N' Spices to recover the
sum of TWENTY EIGHT THOUSAND THREE HUNDRED NINE DOLLARS ($28,309.00),
along with Interest at the rate of ten and one half percent (10.5%) thereon from
October 1, 1994, and a ONE HUNDRED DOLLAR ($100.00) per week penalty from
July 12, 1993, upon a cause of action of which the following is a statement:
1. The Plaintiff, Kevin M. Davis, is an adult Individual who has an address
of Post Office Box 384, Newark, Delaware 19715.

2. The Defendant, Nlzarali M. Moosa, 15 an adult Individual who is trading
and doing business as M&S Grocers and who was formerly trading as M&S Sweets
N' Spices and has an office and place of business at 501 Market Street in Lemoyne,
Cumberland County, Pennsylvania 17043.
3. On October 12, 1 992, Defendant did execute a written agreement
borrowing the sum of TWENTY-FIVE THOUSAND DOLLARS ($25,000.00) at an
annual interest rate of TEN AND ONE-HALF PERCENT (10.5%) to be paid In its
entirety by July 12, 1993, as shown on Plaintiff's Exhibit "A" attached hereto, made
a part hereof and marked Exhibit" A".
4. Due to Defendant's default in payment of said amount due and owing as
aforesaid, interest and penalties have been added to said account as allowed by
Exhibit "A" attached hereto and made a part hereof.

5. The balance due and owing by Defendant to Plaintiff is the sum of
TWENTY-EIGHT THOUSAND THREE HUNDRED NINE DOLLARS ($28,309.001.

6. Plaintiff has frequently demanded payment from Defendant of said
amount due and owing as aforesaid, but Defendant has refused and neglected and still
refuses and neglects to pay said amount or any part thereof, in fact Defendant
attempted to pay SEVENTEEIIJ THOUSAND SIX HUNDRED TWENTY-FIVE DOLLARS
($17,625.00) as full settlement of this claim, but said check was returned unpaid for
Insufficient funds. A copy of said NSF check is attached hereto as Exhibit "B" and
made a part hereof.
WHEREFORE, Plaintiff brings this suit to recover from Defendant the sum of
TWENTY EIGi"1T THOUSAND THREE HUNDRED NINE DOLLARS ($28,309.00),
together with Interest at the rate of ten and one half percent (10.5%) thereon from
October 1,1994, and a ONE HUNDRED DOLLAR ($100.00) per week penalty from
July 12, 1993.

Nizarali M. Moosa, t/a M&S Grocers, formerly trading as M&S Sweets
N' Spices, by and through his attorney, Joseph J. Dixon, Esquire,
who respectfully responds to the Complaint as follows:
1. Denied. After reasonable investigation, the Defendant is
unable to ascertain the truthfulness of this averment and proof of
same is demanded at trial.

5. Denied. The Defendant does not owe the Plaintiff $28,309.
The Defendant has made a substantial payment to the Plaintiff and

at 1 :30 p.m. and, further, as our request to withdraw our Objections to the Sheriff's Determination
of Ownership In regard to the above-captioned Property Clelm. The reason for this being that the
Defendant In this case has absconded with all the personal property In question and, hence, there
Is no need to determine the validity of Mr. Ella's security Interest In the aforesaid personalty.
I have spoken with Mr. Ella this dato and advised him that I was going to request cancellation
of the above Hearing based upon this most recent turn of events. I am confirming this with Mr. Ella
via copy of this leuer. I am also advising the Sheriff's Office as well by copy of this letter that Mr.
Moosa has committed the criminal offense of moving this property under levy and either disposing
of It or concealing its whereabouts.
